04-34 - 05-18 - Denial of Rezoning 2 Family Resential 3370-72 Lilac Drive Resolution 04-34 May 18, 2004 Member Grayson introduced the following resolution and moved its adoption: RESOLUTION FOR DENIAL OF REZONING TO TWO FAMILY RESIDENTIAL (R-2) ZONING DISTRICT 3370-72 LILAC DRIVE NORTH WHEREAS, the City Council for the City of Golden Valley, pursuant to due notice, has heretofore conducted a public hearing to consider the change in the rezoning of the property located at 3370 Lilac Drive North from R-1 (Single Family Residential Zoning District) to R-2 (Two Family Residential Zoning District); and WHEREAS, after the public hearing was held, the Council verbally expressed its rationale to deny the rezoning of 3370 Lilac Drive North, legally described as Lot 4 the North Y2 of Lot 3, Block 3, Dahindens 3rd Addition. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Golden Valley that it denies the rezoning for 3370 Lilac Drive North and memorializes its rationale as follows: 1. The surrounding neighborhood is zoned R-1 (Single Family Residential Zoning District). When the City Council adopted the Zoning Map for the City in the early 1980's and created a separate R-2 (Two Family Residential Zoning District), it was the intent of the City Council to provide areas of the City exclusively for single family homes and exclusively for two family homes. 2. If this one lot was to be rezoned to R-2 (Two Family Residential Zoning District) in the midst of neighborhood zoned R-1 (Single Family Residential Zoning District), this would constitute "spot zoning" and be inappropriate for the area. Taylor, City Clerk The motion for the adoption of the foregoing resolution was seconded by Member Shaffer and upon a vote being taken thereon, the following voted in favor thereof: Freiberg, Grayson, Loomis, Shaffer and Tremere; and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted, signed by the Mayor and her signature attested by the City Clerk.
