Member Shaffer introduced the following resolution and moved its adoption:
RESOLUTION AUTHORIZING EXPENDITURE OF FUNDS TO
PROVIDE A TEMPORARY WATER SYSTEM, AND
AUTHORIZING STAFF TO SOLICIT QUOTES AND
ENTER INTO AN EMERGENCY CONTRACT FOR A
PERMANENT REPAIR TO THE WATER SYSTEM
(MAJOR CIRCLE AND GOLDEN VALLEY ROAD)
WHEREAS, on Monday, May 24, 2004, Public Works staff became aware of the
compromised condition of a City-owned 6 inch water main located within the right-of-way of
Major Circle and Golden Valley Road (CSAH 66); and,
WHEREAS, upon learning the condition of the water main, Public Works staff took
immediate action to make intermediate repairs, develop a plan to provide water to the three
homes through temporary means, and prepare a specification for work needed to be done
to permanently repair the 6 inch water main; and,
WHEREAS, maintaining the integrity of the water main is critical because it provides
water to single family homes in Golden Valley and long term loss of water service to these
homes is a public health and public safety issue; and
WHEREAS, on Wednesday, May 26, 2004 was determined that the expertise and
equipment of a large-scale contractor was needed to replace the water main as quickly as
possible; and
WHEREAS, staff retained the services of Palda & Sons, Inc. to mobilize and provide
a temporary water system to the homes served by the water main at an approximate cost
of $5-7,000 and this temporary work will be completed as of June 1, 2004; and
WHEREAS, Minnesota Statues 365.37 and 415.01 provide that the City can obtain
contract services to address an emergency and that the emergency contract is not subject
to the normal purchasing and competitive bid requirements.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Golden
Valley:
1. That the actions taken by staff and funds expended in the approximate amount of
$10,000 to provide temporary water service to three homes on Major Circle are
hereby ratified.
2. That the City Council hereby declares the repair of the pipe to be an emergency
for the following reasons:
a. The importance of the pipe to the City's water system;
b. The need to repair the pipe in order eliminate the a public safety threat if
the water main failed, therefore requiring staff to shut down valves in the
area resulting in a prolonged interruption of water service to three homes.

3. That the City Council waives the competitive bidding requirements set forth in
Minnesota Statues 471.345 and 412.311, and directs staff to obtain quotes for
the necessary work from contractors who have demonstrated to staff their
expertise and ability to provide the personnel and equipment necessary to
immediately make the repair.
4. That staff is authorized to proceed posthaste with the work required based on the
responsiveness of the contractor providing the quote.

The motion for the adoption of the foregoing resolution was seconded by Member Grayson
and upon a vote being taken thereon, the following voted in favor thereof: Freiberg,
Grayson, Loomis, Shaffer and Tremere; and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted, signed by the Mayor
and her signature attested by the City Clerk.
