04-67 - 09-21 - PH for Vacate for Drainage Easement JLO PUD Resolution 04-67 September 21, 2004 Member Grayson introduced the following resolution and moved its adoption: RESOLUTION ESTABLISHING A PUBLIC HEARING ON OCTOBER 19, 2004 TO CONSIDER VACATION OF A RECORDED DRAINAGE AND UTILITY EASEMENT AND A PORTION OF A PLATTED DRAINAGE AND UTILITY EASEMENT IN THE JLO ADDITION P.U.D. NO. 66 PLAT WHEREAS, a recorded drainage and utility easement and a portion of a platted drainage and utility easement are no longer needed and the City desires to consider vacation of that recorded drainage and utility easement and that portion of the platted drainage and utility easement legally described as follows: A 20.00 foot easement for drainage and utility purposes over, under and across that part of: Lot 1, Block 1, JLO ADDITION P.U.D. NO. 66, according to the recorded plat thereof, and situate in Hennepin County, Minnesota. Said easement lying 20.00 feet northeasterly and easterly of the following described line: Commencing at the northwest corner of Lot 1, said Block 1; thence South 00 degrees 39 minutes 47 seconds West, assumed bearing, along the west line of said Lot 1 a distance of 134.21 feet to the point of beginning; thence South 89 degrees 58 minutes 16 seconds East a distance of 14.12 feet, thence South 73 degrees 40 minutes 59 seconds East a distance of 86.82 feet; thence South 00 degrees 36 minutes 11 seconds West a distance of 114.12 feet; thence South 44 degrees 23 minutes 49 seconds East a distance of 59.11 feet; thence South 45 degrees 36 minutes, 11 seconds West a distance of 16.23 feet; thence South 00 degrees 36 minutes 11 seconds West a distance of 82.01 feet and there terminating. Sidelines of said easement are to be prolonged and shortened to terminate on the west line of said Lot 1. AND That portion of a 20.00 foot wide drainage and utility easement, as dedicated, and as located, over, under and across Lot 1, Block 1, JLO Addition P.U.D. No. 66, according to the recorded plat thereof, and situate in Hennepin County, Minnesota. The portion to be vacated is more particularly described as lying between "Point A" and "Point B" and the centerline is described as follows: Commencing at the northwest corner of said Lot 1, Block 1; thence North 89 degrees 38 minutes 08 seconds East, assumed bearing, along the north line of said Lot 1 a distance of 25.82 feet; thence South 00 degrees 00 minutes 00 seconds East a distance of 70.68 feet to said "Point A"; thence continuing South 00 degrees 00 minutes 00 seconds East a distance of 161.41 feet; thence South 87 degrees 49 Resolution 04-67 - Continued September 21, 2004 minutes 34 seconds East a distance of 81.56 feet; thence South 02 degrees 10 minutes 26 seconds West a distance of 13.68 feet; thence South 87 degrees 49 minutes 34 seconds East a distance of 40.00 feet; thence North 87 degrees 49 minutes 34 seconds West a distance of 40.00 feet; thence South 02 degrees 10 minutes 26 seconds West a distance of 147.82 feet; thence South 87 degrees 49 minutes 34 seconds East a distance of 31.87 feet to said "Point B" and there terminating. NOW THEREFORE, BE IT RESOLVED, that the City Council of the City of Golden Valley hereby schedules a public hearing on October 19, 2004 at 7:00 pm to consider vacation of a platted easement for the plat of JLO Addition P.U.D.
