Member Grayson introduced the following resolution and moved its adoption:
RESOLUTION ADOPTING HEALTH INFORMATION PORTABILITY AND
ACCOUNTABILITY ACT OF 1996 (HIPAA) PRIVACY POLICIES AND PROCEDURES,
APPOINTING A PRIVACY OFFICIAL AND ASSIGNING DUTIES
WHEREAS, the Health Information Portability and Accountability Act of 1996 sets
federal standards for the protection of personal health information collected by entities
covered under the act; and
WHEREAS, the City of Golden Valley recognizes that it offers the following health
plans including medical and dental plans, a flexible spending plan and a post-employment
health care savings plan and is a covered entity under the Health Insurance Portability and
Accountability Act of 1996 (HIPAA), 45 CFR 164.530 (a), for purposes of complying with
HIPAA's privacy mandates; and
WHEREAS the City of Golden Valley recognizes that as a covered entity under
HIPAA that it is required to appoint a privacy official who shall:
• develop, implement and coordinate policies and procedures for protected health
information under HIPAA's privacy rules,
• monitor and decide any issues that occur under the rules, and
• receive complaints about any failure to comply with either the policies and
procedures or the privacy rules; and
WHEREAS, the Golden Valley City Council shares concerns over privacy of health data
protected by the Act and wishes to comply with the requirements of the law; and
NOW, THEREFORE, BE IT RESOLVED, that the City Council of Golden Valley hereby
adopts the HIPAA Privacy Policies and Procedures and designates Human Resources
Coordinator Paula Graff as the City's HIPAA privacy official.

The motion for the adoption of the foregoing resolution was seconded by Member Freiberg
and upon a vote being taken thereon, the following voted in favor thereof: Freiberg,
Grayson, Loomis, Pentel and Shaffer; and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted, signed by the Mayor
and her signature attested by the City Clerk.
