Member Grayson introduced the following resolution and moved its adoption::
RESOLUTION AUTHORIZING FLOOD HAZARD MITIGATION
GRANT AGREEMENT BETWEEN THE CITY OF GOLDEN VALLEY
AND THE MINNESOTA DEPARTMENT OF NATURAL RESOURCES
(2655 SCOTT AVENUE NORTH)
BE IT RESOLVED by the City Council of the City of Golden Valley, Minnesota, as
follows:
WHEREAS, the Minnesota Department of Natural Resources has available funding
for local governments for flood mitigation efforts in Minnesota cities;
WHEREAS, the City of Golden Valley has identified the home at 2655 Scott Avenue
North as being located in a designated floodplain within this community; and
WHEREAS, it has been determined that the appropriate method of preventing future
flood damage at the subject property is to acquire and demolish the home.
NOW, THEREFORE, BE IT RESOLVED by the City Council for the City of Golden
Valley that the City of Golden Valley, hereinafter referred to as the "Applicant" act as legal
sponsor for the project contained in the Flood Damage Reduction Grant Assistance
Program Application to be submitted on or about October 19, 2005, and that the Director of
Public Works is hereby authorized to apply to the Department of Natural Resources for
funding of this project on behalf of the Applicant.
BE IT FURTHER RESOLVED that:
1. The Applicant has the legal authority to apply for financial assistance, and the
institutional, managerial and financial capability to ensure adequate acquisition,
maintenance and protection of the proposed project.
2. The Applicant has not incurred any costs, and has not entered into any
written agreements to purchase property proposed by this project.
3. The Applicant has not violated any Federal, State, or local laws pertaining to
fraud, bribery, graft, kickbacks, collusion, conflict of interest or other unlawful or corrupt
practice.
4. Upon approval of its application by the state, the Applicant may enter into an
agreement with the State of Minnesota for the above-referenced project, and that the
Applicant certifies that it will comply with all applicable laws and regulations as stated in the
contract agreement.
5. The Mayor and City Manager are hereby authorized to execute such
agreements as are necessary to implement the project on behalf of the applicant.

The motion for the adoption of the foregoing resolution was seconded by Member Shaffer
and upon a vote being taken thereon, the following voted in favor thereof: Freiberg,
Grayson, Loomis, Pentel and Shaffer; and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted, signed by the Mayor
and her signature attested by the City Clerk.
