06-14 - 02-21 - Support Eminent Domain by Three Rivers Park District for Trail Resolution 06-14 February 21, 2006
Member Pentel introduced the following resolution and moved its adoption:
RESOLUTION SUPPORTING USE OF EMINENT DOMAIN BY
THREE RIVERS PARK DISTRICT FOR REGIONAL TRAIL WITHIN THE CITY
WHEREAS, the City and the Three Rivers Park District (Park District) are
contemporaneously entering into a Cooperative and Joint Powers Agreement for the
development of a regional trail system within the City;
WHEREAS, a portion of the trail will not fall within City right-of-way and the Park
District may need to utilize eminent domain procedures for the acquisition of some of the
property necessary for the trail;
NOW, THEREFORE, BE IT RESOLVED by the City Council in and for the City of
Golden Valley that it hereby declares its support for the use of eminent domain procedures,
if necessary, by the Three Rivers Park District for the acquisition of trail right-of-way in
areas where City right-of-way is not available for the location of a regional trail within the
City.

The motion for the adoption of the foregoing resolution was seconded by Member Scanlon
and upon a vote being taken thereon, the following voted in favor thereof: Loomis, Pentel,
Scanlon and Shaffer; and the following voted against the same: Freiberg, whereupon said
resolution was declared duly passed and adopted, signed by the Mayor and her signature
attested by the City Clerk.
