Member Pentel introduced the following resolution and moved its adoption:
RESOLUTION AGREEING THAT ELECTRIC POWER LINES RELOCATED PURSUANT
TO THE COOPERATIVE AND JOINT POWERS AGREEMENT WITH THREE RIVERS
PARK DISTRICT NEED NOT BE PLACED UNDERGROUND
WHEREAS, the City and the Three Rivers Park District (Park District) have entered
into a Cooperative and Joint Powers Agreement for the development of a regional trail
system within the City;
WHEREAS, the location of a portion of the trail on right-of-way along Country Club
Drive and in the vicinity of 10th Avenue North and Mendelssohn Avenue North will require
the relocation of certain electric power lines; and
WHEREAS, Section 11 of the Cooperative and Joint Powers Agreement between
the Park District and the City provides that the City Council may by resolution waive the
requirement of City Code Section 7.28 and provide that the relocated electric power lines
do not need to be placed underground;
NOW, THEREFORE, BE IT RESOLVED by the City Council in and for the City of
Golden Valley that it hereby agrees that the electric power lines along Country Club Drive
and in the vicinity of 10th Avenue North and Mendelssohn Avenue North which need to be
relocated as a result of the construction of the regional trail pursuant to the Cooperative
and Joint Powers Agreement between the Park District and the City do not need to be
placed underground when relocated.
BE IT FURTHER RESOLVED that by this resolution the City Council has waived the
requirements of City Code Section 7.28 to the extent of the relocation of electric power
lines along Country Club Drive and in the vicinity of 10th Avenue North and Mendelssohn
Avenue North.

The motion for the adoption of the foregoing resolution was seconded by Member Scanlon
and upon a vote being taken thereon, the following voted in favor thereof: Freiberg,
Loomis, Pentel, Scanlon and Shaffer; and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted, signed by the Mayor
and her signature attested by the City Clerk.
