12-076 - 10-16 - waive public hearing - order certification - assessments - 2012 driveways Resolution 12-76 October 16, 2012 Member Scanlon introduced the following resolution and moved its adoption: RESOLUTION WAIVING THE PUBLIC HEARING PURSUANT TO MINNESOTA STATUTES 429.031 ANQ ORDERING CERTIFICATION OF SPECIAL ASSESSMENTS ON PRIVATE DRIVEWAYS THAT INVOLVE 2012 CITY STREET IMPROVEMENTS Pro'ect Years Interest Rate First Year Lev Total Assessed 2Q12 10 6% 2013 $38,135.55 Driveways 1. Each individual address (lots) will be assessed the full value of the signed contract with the homeowner for the various driveway improvement(s). 2. The proposed assessments are hereby adopted and confirmed as the proper assessments for each Qf said property respectively together with interest at the rate of six (6) percent per annum accruing on the full amount thereof unpaid, shall be a lien concurrent with general taxes upon parcel and all thereof. The total amount of each such assessment not prepaid shall be payable in equal annual principal installments extending over a periad of 10 years, as indicated in each case. 3. The first of said installments, together with interest on the entire assessment for the period of January 1 through December 31, 2013, will be payable with general taxes for the year of 2012, collectible in 2013, and one of each of the remaining installments, together with one year's interest on that and all other unpaid installments, will be paid with general taxes for each consecutive year thereafter unless the entire assessment is paid in full by November 16, 2012. 4. The owner may pay off the assessment in full after November 16, 2012 with interest accrued to Qecember 31 of the year in which such payment is made. Such payment must be made before November 15 or interest will be charged through December 31 of the succeeding year. 5. The City Clerk shall, as soon as may be, prepare and transmit to the County Auditor a certified duplicate of the assessment roll, with each installment and interest on each unpaid assessment set forth separately, to be extended upon the proper tax lists of the County and the County Auditor shall thereafter collect said assessment in the manner provided by law.
