Member Scanlon introduced the following resolution and moved its adoption:
RESOLUTION ADOPTING FINDINGS QF FACT AND ISSUING
A STATEMENT OF PUBLIC PURPOSE FOR MNDOT ALLEY PARCELS
(NORTHWEST CORNER I-394 AND TH 100)
WHEREAS, the Minnesota Department of Transportation (hereinafter "MnDQT")
owns property located at the northwest corner of the intersections of Interstate Mighway
394 and Minnesota Highway 100; and
WHEREAS, such property includes certain portions af Tracts H, I, and K of
Registered Land Survey No. 106, Hennepin County, Minnesota, shown on the attached
MnDOT Alley Parcels Location Map and legally described in the legal description attached
hereto (hereinafter "the triangular Alley Parcel"), that abut a public alley; and
WHEREAS, such property includes certain portions of the Vacated Park parcel in
Block 2 of Spring Green South, Hennepin County, Minnesota, shown on the attached
MnDOT Alley Parcels Location Map and legally described in the legal description attached
hereto (hereinafter "the parallel Alley Parcel"), that abut a public alley; and
WHEREAS, Minnesota Statutes 161.44 authorizes the Commissioner of
Transportation to convey land to any political subdivision for public purposes, if the land is
owned by the State but not needed for trunk highway purposes; and
WHEREAS, the City of GQlden Valley is a public corporation organized under
Minnesota Stat. 412; and
WHEREAS, upon review and inspection the City has determined that it is in its best
interest to accept the conveyance of the Alley Parcel and the Easement from the
Commissioner of Transportation, and to possess, occupy, own, and use the Alley Parcel
and Easement as public right-of-way for public purposes, including but not limited to
transportation, access, utilities, and drainage.
NOW, THEREFORE, BE IT RESOLVED, the City of Golden Valley has determined
that the triangular Alley Parcel and parallel Alley Parcel, when conveyed to the City, shall
be possessed, owned, and used by the City as public right-of-way for public purposes.

The motion for the adoption of the foregoing resolution was seconded by Member
Schmidgall and upon a vote being taken thereon, the following voted in favor thereof:
Clausen, Harris, Scanlon and Schmidgall; and the following was absent: Pentel, and the
following voted against the same: none, whereupon said resolution was declared duly
passed and adopted, signed by the Mayor and his signature attested by the City Clerk.

Beginning at a point of the west line of the above property, distant 25 feet north of the
