13-094 - 10-15 - authorize submittal of application - metropolitan council tax base revitalization accoutn - the xenia project Resolution 13-94 October 15, 2013 Member Schmidgall introduced the following resolution and moved its adoption: RESOLUTION AUTHORIZING SUBMITTAL OF AN APPLICATION TO THE METROPOLITAN COUNCIL TAX BASE REVITALIZATION ACCOUNT— THE XENIA PROJECT WHEREAS, the City has identified a contamination cleanup project within the City that meet the Tax Base Revitalization Account's purposes and criteria and are consistent with and promote the purposes of the Metropolitan Livable Communities Act and the policies of the Metropolitan Council's adopted metropolitan development guide; and WHEREAS, the City of Golden Valley is a participant in the Livable Communities Act's Housing Incentives Program for 2013 as determined by the Metropolitan Council and is therefore, eligible to make application for funds under the Tax Base Revitalization Account; and WHEREAS, the City finds that the required contamination cleanup will not occur through private or other public investment within the reasonable foreseeable future without Tax Base Revitalization Account grant funding; and WHEREAS, the City represents that it has undertaken reasonable and good faith efforts to procure funding or the activities for which Livable Communities Act Tax Base Revitalization Account funding is sought but was not able to find or secure from other sources funding that is necessary for cleanup completion; and WHEREAS, the City has the institutional, managerial and financial capability to ensure adequate project and grant administration; and WHEREAS, the City certifies that it will comply with all applicable laws and regulations as stated in the contract grant agreements; and BE IT RESOLVED that the City Council of the City of Golden Valley hereby approves the contamination cleanup grant application submitted to the Metropolitan Council, the Department of Employment and Economic Development and Hennepin County on November 1, 2013 for the Xenia Project; and BE IT FURTHER RESOLVED that the City of Golden Valley agrees to act as legal sponsor for the project contained in the cleanup grant applications submitted to the Department of Employment and Economic Development, Hennepin County Environmental Response Fund, and the Metropolitan Council on November 1, 2013 and that the Community Development Director is hereby authorized to apply to these agencies for the funding of the Xenia project; and BE IT FURTHER RESOLVED that the sources and amounts of the local match identified in the applications are committed to the projects identified; and Resolution 13-94 - Continued October 15, 2013 BE IT FURTHER RESOLVED that the City certifies that it has not violated any Federal, State or local laws pertaining to fraud, bribery, graft, kickbacks, collusion, conflict of interest or other unlawful or corrupt practice and that it will comply with all applicable laws and regulations as stated in the contract agreements; and BE IT FURTHER RESOLVED that if the City is awarded a grant by the Department of Employment and Economic Development, Hennepin County and/or the Metropolitan Council, the City of Golden Valley will be the grantee and legal sponsor and its Community Development Department will act as recipient and administrator of and be responsible for the grant funds expended for the project contained in the Contamination Cleanup grant, the Hennepin County Environmental Response Fund grant, and the Tax Base Revitalization Account grants submitted on November 1, 2013; NOW THEREFORE BE IT FINALLY RESOLVED that the Mayor and City Clerk of the City of Golden Valley are hereby authorized to execute such agreements as are necessary to implement the projects on behalf of the applicant. hep d M.
