18-90 - 12-18 - Vacate Right of Way at 701 Lilac Drvie north RESOLUTION NO. 18-90 RESOLUTION VACATING RIGHT OF WAY AND UTILITY EASEMENTS AT 701 LILAC DRIVE NORTH WHEREAS, the City Council of the City of Golden Valley, pursuant to due notice, has conducted a public hearing on the vacation of certain utility, drainage and right of way easements on the property commonly known as 701 Lilac Drive North, legally described as follows: See attached Exhibit A (the "Subject Property"). WHEREAS, all persons present were given the opportunity to be heard; and WHEREAS, the Subject Property is being re-platted to facilitate development; and WHEREAS, a portion of the right-of-way easement over part of the Subject Property is considered excess property not needed by the City; and WHEREAS, the City has evaluated its interest and use of the property; and WHEREAS, the Council has determined that the vacation will benefit the public interest because the vacation is predicted to foster economic growth in the City of Golden Valley and, on a greater scale, the State of Minnesota benefits by the projected measurable increase in tax revenue and general prosperity. NOW THEREFORE, BE IT RESOLVED, by the City Council of the City of Golden Valley that said drainage and utility and right of way easements located in the Subject Property and legally described below be vacated: All of the drainage and utility easements over Lot 1, Block 1 dedicated in the plat of Tennant Companies PUD No 114, Hennepin County, Minnesota; and That part of the Drainage and Utility Easement as set forth in Document Number 1031441 and that part of the Public Right of Way Easement as set forth in Document Number 1476756 described as the west 25.00 feet of Tract E lying south of the easterly extension of the south line of Tract C, Registered Land Survey No. 11, filed of the Registrar of Titles, Hennepin County, Minnesota.
