EXTENDING A LOCAL EMERGENCY AND AUTHORIZING THE CITY OF
GOLDEN VALLEY TO MAKE A CONTRACT DURING A LOCAL EMERGENCY
WHEREAS, the Mayor of the City of Golden Valley has found that the following
situation exists:
On Wednesday, May 29, 2019, contractors working on a public project for the
Metropolitan Council at Natchez Avenue North and Roanoke Road, alerted City
staff that they had discovered a City-owned 24-inch sanitary sewer pipe
between Natchez Avenue and Ottawa Avenue North that was severely
compromised (the "Compromised Pipe"). City staff took immediate action to
assess the Compromised Pipe and have concluded that the Compromised Pipe
creates an imminent, serious threat to the health and safety of persons
because the Compromised Pipe is needed to maintain full sewer capacity to the
section of the City located south of TH 55 and east of Winnetka Avenue.
Furthermore, if the City does not take immediate action to repair the
Compromised Pipe, the Compromised Pipe is likely to fail, resulting in sewer
back-ups and leakage and catastrophic loss to property or the environment.
Whereas, the Mayor has declared that the situation is a local emergency; and
WHEREAS, the City Council agrees with the Mayor's findings and further finds that
the situation will last for more than three days; and
WHEREAS, the City Council finds that immediate action to respond to the situation
is needed in order to protect the health, safety, and welfare of the community; and
WHEREAS, the immediate purchase of labor and supplies necessary to repair the
Compromised Pipe by installing a structural liner inside the Compromised Pipe between
Natchez Avenue and Ottawa Avenue North is needed in order to protect the health, safety,
and welfare of the community; and
WHEREAS, Minnesota Statutes, sections 12.29 and 12.37 provide that an
emergency contract is not subject to the normal purchasing and competitive-bidding
requirements because of the emergency; and
WHEREAS, City staff have located a reputable contractor, Minger Construction
Companies, Inc., that has the resources and expertise to perform the required repair work,
is already mobilized for another project adjacent to the site, and can perform the work on
an emergency basis at an approximate cost of$250,000.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Golden
Valley, Minnesota as follows:
The City Council declares that the local emergency is recognized as continuing until the
Compromised Pipe is fully repaired by placement of a structural liner inside the
Compromised Pipe between Natchez Avenue North and Ottawa Avenue North.

This declaration of a local emergency will invoke the city's disaster plan. The portions that
are necessary for response to and recovery from the emergency must be used.
The City Council hereby authorizes the purchase of the labor and supplies necessary to
complete the required repair from Minger Construction Companies, Inc. in an amount not to
exceed $250,000.
