Resolution 86-9

Commissioner Anderson introduced the following resolution and moved its adoption:
RESOLUTION AUTHORIZING THE ACQUISITION BY PURCHASE OR
CONDEMNATION AND CERTIFYING THE VALUE FOR ACQUISITION
BY PURCHASE OR CONDEMNATION OF CERTAIN REAL PROPERTY
FOR EFFECTUATION OF A PORTION OF AREA B OF THE
VALLEY SQUARE REDEVELOPMENT PLAN
(IRENE HENDERSON RESIDENCE - 8030 MAREN LANE)
WHEREAS, the Housing and Redevelopment Authority in and for the City of
Golden Valley, Minnesota (the "HRA") has determined that there exists an area in
the City of Golden Valley which is a deteriorated and deteriorating area within
the meaning of Minnesota Statutes, Section 462.421; Subd. 13, and has determined
that it is necessary to initiate a revitalization program in order to eliminate
and prevent the spread of such deterioration; and
WHEREAS, the HRA and the City Council of the City of Golden Valley have
approved the Valley Square Redevelopment Plan to eliminate and prevent the spread
of such deterioration; and
WHEREAS, it is necessary and desirable to acquire the real estate hereinafter
described in order to carry out and implement the plan of revitalization as
defined in said Plan, thereby making the land described therein useful and
valuable for contributing to the public health, safety and welfare; and
WHEREAS, it is necessary and desirable to acquire said lands in order to
eliminate the conditions found to exist in the Plan and to carry out the
redevelopment projects as defined therein; and
WHEREAS, the HRA has had a certain parcel of real property to be acquired
appraised for its fair market value by a qualified independent professional real
estate appraiser, who has completed a written report documenting said value; and
WHEREAS, another qual i fi ed apprai ser has revi ewed thi s apprai sal report,
made a personal on-site inspection of this property, and has on file a written
report setting forth his opinion as to fair market value; and
WHEREAS, the work of the appraiser and review appraiser with respect to
this property has been performed in a competent manner in accordance with
applicable State Law, and the Uniform Relocation Assistance and Real Property
Acquisition Act, the Department of Housing and Urban Development policies and
requi rements;
NOW, THEREFORE, BE IT RESOLVED by the HRA as follows:
1. That the land hereinafter described be acquired by purchase or condemnation
and the HRA's Director and its Attorney, or such other person(s) as shall be duly
designated and di rected, are hereby authorized and di rected to take all necessary
steps and to execute all necessary documents in connection with the acquisition
of said real estate, to-wit:
Lot 5, Olsen Manor, Hennepin County, Minnesota

2. That the HRA hereby certifies the market value of said property to be
$90,500, such value set for the purpose of making an offer to purchase or acquire
by condemnation;
3. The market value is considered the amount that would be paid to a
willing seller by a willing buyer presuming special assessments, liens and other
encumbrances, if any, are paid by the seller prior to transfer of title and
disregarding any before value of the property caused by the proposed improvements.
BE IT FURTHER RESOLVED that the acquisition of the above-described real
estate is necessary and desirable, and the purposes aforesaid for which said
lands are to be acquired are proper and necessary public urposes.

he adoption of the foregoing resolution was seconded by
Commissioner J nson and upon a vote being taken thereon, the following voted
in favor thereof: Anderson, Bakken, Johnson, Stockman and Thompson; and the
following voted against the same: none, whereupon said resolution was declared
duly passed and adopted, signed by the Chair and his signature attested by the
Director.
