94-08 HRA Resolutions Log Resolution 94-8 July 12, 1994 - Commissioner Russell introduced the following resolution and moved its adoption: RESOLUTION ORDERING ENVIRONMENTAL TESTING OF THE PROPERTY LOCATED AT 6010 WAYZATA BOULEVARD, GOLDEN VALLEY, MINNESOTA WHEREAS, Midland Welding is located at 6010 Wayzata Boulevard, Golden Valley, Minnesota, and is legally described in attached Exhibit A; WHEREAS, the Golden Hills Redevelopment Plan adopted by the City of Golden Valley and the Golden Valley Housing and Redevelopment Authority (HRA) in 1984 provides for the acquisition of property for redevelopment; WHEREAS, said property is within the Golden Hills Redevelopment area and the HRA intends to exercise its power of eminent domain to condemn said prop- erty to further the public purpose set forth in the Golden Hills Redevelopment Plan; WHEREAS, the HRA has passed resolutions: (1) authorizing either the negotiated purchase of the property or the commencement of condemnation pro- ceedings to acquire it; and (2) authorizing an environmental investigation of the property; WHEREAS, the HRA needs to know whether the property is contaminated before exercising its power of eminent domain; and e WHEREAS, under these circumstances, the HRA has the right to enter the property and perform environmental testing pursuant to Minn. Stat. 9 117.041, Subd. 2, and the HRA has authorized its staff to provide notice to the owner of its intent to enter the property and perform environmental testing pursuant to Minn. Stat. 9 117.041; NOW, THEREFORE, be it resolved by the Housing and Redevelopment Authority in and for the City of Golden Valley: 1. That it has reason to believe that acquisition of the property shall be required pursuant to eminent domain proceedings as described above; 2. That it has reason to believe that a hazardous substance, pollutant or contaminant may be present on the property and that the release of a hazardous substance, pollutant or contaminant may have occurred on the property, because paint and paint solvents have been used on the property for many years; 3. That entry on the property for environmental testing is rationally related to health, safety or welfare concerns of the HRA in connection with such eminent domain proceedings; 4. That the HRA Director shall direct its environmental consultant to enter the property to perform appropriate environmental tests (including, without limitation, soil borings and chemical analysis of the borings); e 5. That all such testing shall be conducted in accordance with the legal procedures set forth in Minn.
