Resolution 98-12

Commissioner LeSuer introduced the following and moved its adoption:
RESOLUTION AUTHORIZING ENTRY ONTO PROPERTY
FOR PURPOSES OF INVESTIGATION, MONITORING,
TESTING, SURVEYING, ETC.
(Treasure Island Inc., 5740 Wayzata Boulevard)
WHEREAS, the owner of the Treasure Island Inc. parcel located in the
Central Area of Golden Hills has refused entry by the HRA for purposes of
investigation, monitoring, testing, survey, boring, etc.; and,
WHEREAS, it is necessary to enter the Treasure Island Inc. property as
well as the other properties in the Central Area for purposes of determining the
feasibility of the Duke Realty project.
NOW, THEREFORE, BE IT RESOLVED by the HRA that:

1. It finds that it is necessary to enter upon the Treasure Island's property
located at 5740 Wayzata Boulevard, Golden Valley, Minnesota for purposes of
investigating, monitoring, testing, surveying, boring or other similar activities
necessary or appropriate to identify the existence and extent of a release or
threat of release of any hazardous substance, pollutant or contaminant of the
property and to make such other tests as are necessary for its investigation of
the feasibility of the Duke Realty project.
2. That the Director and HRA attorney are authorized to take all steps
necessary to obtain the appropriate permissions and/or court orders for entry
onto such property for such purposes.
Motion for t option of the foregoing resolution was seconded by
Commission r Bakken; and upon a vote taken thereon, the following voted in
favor thereof: Anderson, Bakken, Johnson and LeSuer; and the following voted
against the same: Micks: whereupon said resolution was declared duly passed
and adopted, signed by the Chair and her signature attested by the Director.
