2004 HRA RESOLUTION 04-09 Resolution 04-09 July 13, 2004 . Commissioner Freiberg introduced the following and moved its adoption: RESOLUTION EXTENDING THE CONDITIONAL DESIGNATION OF DAVID WEBB AS DEVELOPER OF A PORTION OF THE GOLDEN HILLS REDEVELOPMENT AREA (1201 SouthTurner's Crossroad and the MnDOT Parcel East of the Golden Hills Shopping Center) WHEREAS, the Golden Valley Housing and Redevelopment Authority (HRA) previously adopted Resolution 04-03, Conditionally Designating David Webb As Developer Of A Portion Of The Golden Hills Redevelopment Area (1201 South Turner's Crossroad and the MnDOT Parcel East of the Golden Hills Shopping Center); and WHEREAS, the effective date of that designation ends as of September 1, 2004; and WHEREAS, David Webb has presented a plan of the preliminary steps which need to be accomplished in order to enter into negotiations for the purchase of the designated properties; and . WHEREAS, the accomplishment of these steps cannot reasonably occur by September 1, 2004. NOW, THEREFORE, BE IT RESOLVED, by the HRA as follows: 1. The conditional designation of David Webb as developer of the HRA parcel at 1201 Turner's Crossroad and the MnDOT parcel east of the Golden Hills Shopping Center as established in Resolution 04-03 is hereby extended. 2. The HRA understands that David Webb will undertake all planning and development efforts necessary to combine these parcels with the Golden Hills Shopping Center parcel and construct a project on the combined property and that if such efforts meet the requirements of the HRA and City, Webb will enter into a negotiated development agreement with the HRA, which development agreement shall contain terms satisfactory to the HRA and Webb. . 3. The designation contained in this resolution is not an offer or an agreement to sell the development property, or the grant of an option or any other interest in the development property. The HRA reserves the right to rescind the designation at any time in its sole and absolute discretion. Subject to the foregoing, the HRA agrees to continue to discuss the development with Webb until such time as the HRA determines to terminate such discussions in its sole and absolute discretion. 4. No zoning consideration such as a change in zoning, PUD classification or variances are granted or implied by this action. Resolution 04-09 (Con't.) July 13, 2004 . 5. This designation is effective as of the date hereof and shall automatically terminate and be of no force or effect at such time as the development agreement between Webb and the HRA is executed by all parties, or October 31,2004, whichever occurs earlier. ~ Scott Grayson, Chair ATTEST: ~~ Thomas D. Motion for the adoption of the foregoing resolution was seconded by Commissioner Shaffer, and upon a vote taken thereon, the following voted in favor thereof: Freiberg, Loomis, Shaffer and Tremere; the following was absent: Grayson; and the following voted against the same: none; whereupon said resolution was declared duly passed and adopted, signed by the Chair and his signature attested by the Director. .
