Adjournment JOINT WATER COMMISSION MINUTES Golden Valley - Crystal - New Hope Meeting of June 9, 2021 The Golden Valley – Crystal – New Hope Joint Water Commission (JWC) meeting was called to order at 1:30 pm. Presentation from Bolton and Menk on the Reservoir (North Tank) Realty Capture Data Representatives from Bolton and Menk presented the Commission and staff with slides of the Reservoir (North Tank Realty Capture Data. Representatives requested permission from the Commission to use the video to present to other cities. TAC will discuss and examine what might be considered confidential. Bolton and Menk will work with TAC for approval. Approve the City of New Hope Contract with Dave Perkins Contracting, Inc. and Approve the Additional Materials for the Ductile Iron Pipe and Bends Staff reported that in the spring of 2020, the City of New Hope repaired a watermain break on 42nd Avenue North. During the repair, it was discovered that the 16” gate valve did not operate efficiently, creating delays in the repair. It was determined that the valve was in need of replacement. This project was scheduled to be completed in 2020. Due to the unexpected bends in the 16” water main, this project was Joint Water Commission June 9, 2021 Page 2 of 3 put on hold until the Technical Advisory Committee (TAC) developed a plan to replace the bends and straighten the pipe alignment. This would be funded using the annual trunk valve replacement budget. Moved by McDonald seconded by Cruikshank to approve the City of New Hope Contract with Dave Perkins Contracting Inc. for $24,952 and approve the additional materials for the ductile iron pipe and bends in the amount of $5,407.61. Upon a roll call vote the following voted in favor: Norris McDonald and Cruikshank. The following voted against: None. Motion carried. Approve Crystal Pump House External Valve Replacement Parts Staff reported that part of the on-going effort to replace the valves in the Joint Water Commission distribution system, the valves on the outside of the Crystal pump house have been identified for replacement. Staff is gathering costs for additional parts needed and the labor to do the work. Due to the lead time for the delivery of parts it is important that this order be placed while pricing is still being obtained for the other project components. This project will be funded using the capital project fund for valve replacements. Moved by Cruikshank seconded by McDonald to approve the purchase of the replacement parts for the valve replacement Project from Boys water Products I the amount of $136,421.79. Fiber Connection to the Medicine Lake Water Tower Annually, the Joint Water Commission (JWC) allocates funding to the improvement of security at JWC facilities. Late 2017 and early 2018, staff worked with the Department of Homeland Security’s Protective Security Advisors to do an assessment of all JWC facilities. One of the themes in the assessment is that the existing buildings depended on keys (which can lost or locks not changed regularly), do not have camera surveillance /monitoring, and do not really have access control for who is there when (since keys are used for entry). Staff have been looking for ways to implement the recommendations in the report. What became apparent in this effort is that long term the JWC should plan on having fiber to all facilities to allow for SCADA communication (with cellular backup), fob-controlled access for better access management, and security cameras. As the proposed system would be owned and operated by LOGIS, they were the only vender to provide a quotes for this project. The Joint Water Commission Capital Improvement Project has allocated $100,000 for this project. Motion to approve the contract with LOGIS to provide the fiber connection to the Medicine Lake Water Tower in the amount of $57,031. Earlier this year the JWC approved the purchase of the valve, hydrant parts, pipe, tees, and sleeves from Boys Water Products for a total cost of $136,421.79. A quote was obtained from Thompson Pipe group for the adapters needed to connect the existing 24” pipe to the pipe that is being replaced. The cost for these adapter parts is $18,852. The reason that only one quote was obtained is that Thompson Pipe group is the only company in the United States that makes the adapters. The only remaining items that still need to be purchased for this valve replacement project are the replacement manhole structures and a contractor to actually do the replacement work. However, the actual replacement work will not occur until the Golden Valley Water Tower painting project is completed as the Crystal reservoir will be down while the valve replacement work is taking place. This project will be funded using the capital project fund for valve replacements. Damage In Transit Shipments must be inspected by you before unloading to ascertain any damage en route. Charges for inspections or tests are your expense. Shipping damage claims will not be accepted after goods are unloaded. Force Majeure We are not responsible or liable for any delays or nonperformance in the event of fire, flood, explosion, the elements, or other catastrophe, acts of God, war, riot, civil disturbance, strike, lockout, refusal of employees to work, labor disputes, shortage or inability to obtain raw materials including energy requirements, failure of carriers to deliver either machinery, equipment or material, in the event any legislative, executive, or judicial act of any political or governmental authority substantially affects our operations, in the event we suspend or discontinue business for any reason, or any other reason beyond our control. 7. Cancellation Charges In the event any order accepted by us in writing is cancelled by you, you shall be liable for and shall pay to us all charges incurred in connection with such order, including but not limited to the cost of all purchased materials, expenses incurred for the engineering, fabrication, production, and assembly of such materials and anticipated profits. 8. Governing Law The contract formed pursuant to these terms, conditions, and specifications and the obligations thereby imposed on us and you shall be governed by and construed according to the laws of the State of Texas. You hereby expressly and irrevocably agree that we may bring any action or claim to enforce the contract formed pursuant to these Terms and Conditions in the State or Federal Court of competent jurisdiction for Dallas County, Texas, and you hereby irrevocably consent to jurisdiction in that Court. You hereby further irrevocably consent to service of process in accordance with the provisions of the laws of the State of Texas. 9. Miscellaneous a. Once we have accepted any order from you, in writing, all changes in the order must be in writing, showing the change and the order number. All costs for changes in the order will be at your expense, subject to the terms and conditions herein. b. Our failure to insist upon strict performance of any provision of this Agreement shall not constitute a waiver of that or any other provision or of any of our rights under this Agreement, nor shall it constitute a waiver by us of any subsequent default by you in the performance of this Agreement. c. Our field representative may, from time to time, be present on a job site where products you have purchased from us are being installed and he or she will be glad to work with you and be of assistance to you. The field representative, of course, has no authority to modify this Agreement or bind us however; and since the installation is your responsibility under your supervision or that of your customer or his contractor, we shall not be responsible for any instructions or technical advice in connection with the design, installation or use of the materials sold hereunder. d. You agree to pay any and all costs, expenses, and attorney fees which we may incur or become liable for by reason of our enforcing or attempting to enforce the terms of this Agreement, including lien claims and foreclosure of liens filed. e. Should any part or provision of this Agreement be declared invalid, unenforceable, illegal, or in conflict with any law, the validity and enforceability of the remaining or provisions shall not be affected. f. The prices listed are unit prices for the quantities listed. We reserve the right to change unit prices in the event of quantity changes. g. Neither this Agreement nor any of the rights or responsibilities arising hereunder may be assigned by you without our express written consent to the assignment. h. General Fund The General Fund is the main operating fund of the Joint W ater Commission. The main expense is the cost of water purchased from the City of Minneapolis. The main revenue source for this fund is the distribution of expenses to the cities based on water usage. Large, non-recurring capital outlay expenditures are planned out using this CIP so that the Joint W ater Commission can pay for the capital item without bonding. Water CIP Fund The Water CIP Fund is a capital projects fund that receives revenue from the three cities and pays for the planned projects with current revenues or reserves. Towers - Golden Valley • GV Tower work to take place summer of 2021. Late July start date. • New altitude valve is $13,000 and has been ordered for timing purposes. Will include valve and installation approval at next JWC meeting. o Finalizing installation quotes, TAC recommends low quote. This is the time to do the work when the tower is out. 2. Pumps • No pump work occurring at this time. 1. Valves • New Hope - valve replacement near 42nd & Louisiana. Dave Perkins was low quote for $25,000. Additional parts are $5,400. Talked to Perkins to get on their calendar, mid- August start. o Crystal – valve replacement around pump house was moved to summer of 2021 to finalize scope of work and logistics. Wait until GV tower is done. Keep projects separate. o Costs have increased – working to price out parts and labor and obtaining quotes for this work. 2. SCADA • No SCADA updates at this time. 3. Miscellaneous A. Medicine Lake Tower Parts Storage - Tenants currently using MLR Tower for storage are beginning to move items out to create space for JWC part storage. Will be purchasing more pallet racking, everything is out for the most part. Matt will work with tenants to remove. B. Emergency Action Plan - Map critical zones and valves (GV). Zones will be broken down by 12 inch AND larger mains (distribution mains). GV working on updated maps broken down by larger mains. Working on Map. Look at number of valves (max of 6?) C. Fiber - TAC agreed running fiber to all facilities is a long-term goal. o Existing Fiber - both emergency wells in Crystal, GV Tower, North Tower, and Crystal reservoir. o Proposed Fiber – MLR Tower (2021) – in the works, working with LOGIS and GV reservoir (2022). Golden Valley Meter Pit Issues either install electronic actuators or install pressure reducing/anti-cavitation valves (possible long-term fix). Joe’s getting numbers then will bring it to Minneapolis. West pipe gasket and meter is not operable. o Issue with dissipater plates hitting butterfly valves causing vibrations. o TAC working with Minneapolis to determine flow needs and long term solution. o No updates at this time, probably put in rotork valve with electric operation like Crystal. o Need to talk to Mpls and maybe hire someone to model the system in the pit. E. CIP – TAC walked through 2022-2031 CIP. Will work with Sue V on final recommendation to Commissioners. F. TAC discussed meeting in person versus virtual meeting. The virtual meetings seem to save on travel time so will plan to continue to meet virtually moving forward. G. Talked through potential Mpls water usage restrictions. None at this time or anticipated, however, Mpls will be educating on smart water use. JWC Cities will promote same message. JWC will also be ready if Mpls does implement any water usage restrictions.
