Section 5.09: Sale by Employee
Any sale of an alcoholic beverage in or from any premises licensed under this
Chapter by any employee authorized to make such sale in or from such place is the
act of the employer as well as of the person actually making the sale; and every
such employer is liable to all of the penalties, except criminal penalties, provided by
law for such sale, equally with the person actually making the sale. The City
encourages all licensees and their employees to check the identification of anyone
who appears thirty-five (35) years old or younger. However, there shall be no
penalty for failure to check the identification of a person twenty-one (21) years old
or older or if no sale is associated with a failure to check the identification of a
person under the age of twenty-one (21).
