Section 10.65: Shoplifting
Subdivision 1. Unlawful Act
It is unlawful for any person to take and carry away any goods, wares or
merchandise, from any business establishment, with intent to deprive the true and
lawful owner thereof, and without paying the purchase Price therefor.
Subdivision 2. Penalties
A. If the purchase price of such goods, wares or merchandise is twenty-five
($25.00) dollars or less the defendant, upon conviction, shall be subject to a
fine not to exceed two hundred ($200.00) dollars for the first offense.
B. If the defendant has previously been convicted of shoplifting, theft or
burglary, or if the purchase price of such goods, wares or merchandise
exceeds twenty-five ($25.00) dollars the defendant, upon conviction, shall be
punished as for a misdemeanor.
