Nov.1,1940 144 Pursuant to due adjournment an adjourned regular meeting of the Village Council of the Village of Golden Valley, Hennepin Uounty, ?Minnesota, was held at the Village Hall in the Village of Golden Valley, Minnesota, on the 1st day of November, 1940, at eight o'clock IF. M. The following members were present: Raskob, Tolg, Frandsen and Wilson. The following were absent: Reiss. Mr. Bradley, Village Attorney, Mr. Howard, Special Bond Counsel, and Mr. Gronvall were also present. The President announced that the meeting was convened and open for the purpose of considering the assessment for Street Improvement No. 1. The Clerk reported that no written objections to the assessment had been filed in his office. The President then stated that the meeting would be open to an informal discussion of the assessment. Mr. Howard and Mr. Gronvall were called upon to explain the method of assessment. A number of property owners were present and several stated that the sentiment of the District was in favor of an assessment against all property on a front foot basis. The attorneys pointed out that under the law the assessment must be in accordance with benefits and Mr. Gronvall stated that in his opinion a straight front foot assessment would not be in proportion to benefits to all property because of the unusual shape and size of the various lots. No formal objections were offered but a few owners called attention to disparity in the assessment on their lots. Mr. Gronvall was asked to consider these objections. He recommended the assessment be reduced as follows: Block 1, Lot 2 Block 1, Lot 3 Block 1, Lot 4 Block 4, Lot 1 Block 4, Lot 2 Block 6, Lot 5 Block 11,Lot 5 reduced to $102.05 reduced to $131.52 reduced to $178.06 reduced to $ 59.95 reduced to $100.72 reduced to $ 44.79 reduced to $117.34 2 • Nov. 1; 1940 5 After consideration of all of said objections, Trustee Tolg introduced the following resolution and moved its adoption; A RESOLUTION CO-LeIRMING ASSESSMENTS FOR STREET IT,1PROVEi:-:ENT NO. I. BE IT RTSOLTED by the Village Council of the Village of Golden Valley, Hennepin County, T;Iinnesota, as -follows; 1. The Clerk, with the assistance of Arnold Gronval, a competent person, duly selected by this Council for such purpose, has calculated the proper amounts to be specially assessed for the construction of Street Improvement No. 1 of said Village against every assessable lot, piece or parcel of land in accordance with the provisions of lave, and has prepared anal filed with the Village Clerk tabulated statements in duplicate showing the proper description of each and every lot, piece or parcel of land to be specially assessed and the amount calculated against the same. 2. Notice has been duly published as required by law that this Council would meet at this time and ;lace to pass on the proposed assessments. 3. Said proposed assessment has at all times since its filing been open to inspection and copying by all persons interested, and an opportunity has been given to all interested persons to present their objections, if any, to such proposed assessment, or to any item thereof. 4. That the assessments specified in the proposed assessments are changed and altered as follows: Block 1, Lot 2 reduced to $102.05 Block 1, Lot 3 reduced to 131.52` Block 1, Lot 4 reduced to 17$.06 Block 4, Lot 1 reduced to 59.95 Block 4, Lot 2 reduced to 100.726' Block 6, Lot 5 reduced to 44.79" Block 11,Lot 5 reduced to 117.34" 1 3 `f ,/3 5. This Council finds that each of the lots, pieces or parcels of land enumerated in said proposed assessment was and is specially benefited by the construction of said Street Improvement No. 1 in the amount in said proposed assessment set opposite the description of each such lot, piece or parcel of land respectively, and that said amount so set out is hereby levied against each of the respective lots, pieces or parcels of land therein. described. 6. Such proposed assessment is affirmed, adopted, and confirmed, and the sums fixed and named in said proposedassessment, with the changes and alterations hereinabove maa,, are affirmed, adopted and confirmed as the proper special assessment for each of said lots, pieces or parcels of land respectively. 7. The Clerk shall forthwith deliver a certified copy of the assessment roll to the Village Treasurer. T -,e Treasurer shall thereupon cause notice to be published of receipt of the assessment roll, and of the due date. 1-116 6 3, Nov.1.1940 8. The amounts assessed against each lot, piece or parcel of land shall bear interest from the due date until the same have been paid at the rate of six (6) per cent per annum and such assessments shall be payable in seven equal annual installments payable on the 1st day of January in each year, beginning in the year 1941 and continuing until all of said install- ments shall have been paid, each installment to be collected with taxes collectible during said year by the County Auditor. 9. That the Village Clerk is hereby directed to make up and file in the office of the County Auditor of Hennepin County a certified statement of the amount of all of such unpaid assessments and the amount which will be due thereon on the 1st day of January each year. Presiae-rit of Village ouncil The motion for the adoption of the foregoing resolution was duly seconded by Trustee Frandsen , and upon vote being taken thereon the following voted in favor thereof: Raskob, Tolg, Frandsen and Arilson and the following voted against the same: None whereupon said resolution RTas declared duly passed and adopted, and the President of the Village Council being present affixed his signature thereto in approval thereof.
