Pursuant to due call and notice there of, a special meeting of the
Village Council of the Village of Golden Valley, IIinn., was held at
the Viil&gg Hall in said Village on the 29th Day of July 1941 at
81oclock P..
The following ilieJoers were present Raskop, Frandsen, and 'Wilson
and the following were absent. Reiss, and Busch.
The Village Attorney, IWILT. Baadley,eras also present.
The nresident then announced that the Counoil would hear from YIr. Bensen
of the Right of vvay Division. -Linn. State Highway Dept. about resurfaoig
the Belt Lime Highway throuvh Golden Valley, and that bids for the
constzutttgg of Cobble Stone Gutters in Glen Urban and Glen Urban 2nd
Addition would be received and Opened.
�r. Benson n_resented proposed plans to the Council for the resurfacing
of the Belt Llne Highway.
Lotion by dvilson seconded by Frandsen to adopt the Following Resolution.

designated the location of Trunk Highi y No. 100 , formerly designated as Trunk
Highymy TTo. 130 , through the_ Village ___. of Golden Valle
as shorom,upon the plan which is presented herevith and made a part hereof, and
71IM-REAS, Said Commissioner of Highi,7ays is desirous of constructing, re-
constructing and improving said Trunk Highvray through said Village
and has prepared plans for said construction, reconstruction and improverrent, a
copy of Thich said plans are presented herewith and made a part of this resolution;
and
IFIIEP]AS, The construction, reconstruction_ and improvement of said Trunk
Highi.-ray requires a change in the grade of the streets in said
Village
along and upon which said Trunk Hight -ray passes, said change of grade being desig-
nated and shown on said plans, and

` HEREASP said Commissioner of Highw€.,ys proposes to construct and improve
said Trunk Highway ?�?o; 100,m._ through said Villas and has
prepared plans, specifications, and special provisions for said construction and
WHEREAS, said construction and i.mprovoment is to be accomplished with
the Lid of Federal funds; and
WHEREAS4 said project and said pluns, in order to participate in Foderul
funds, require the approval of the Federal Public Roads Administration,' and
WHEREAS, said Public Roads Administration requires ais a condition pro.'
cedent to such approval the assurance and covenant that the Vil_lat-,� of Golden Valley
will not license or permit hereafter, any encroachment of any nature, including
curb gas pumps or gas stations or billboards or other structures of any kind what
soevery on the right of way of said Trunk Highway Yo:.100_____ within the corporate
limits of said Village of Golden Valley as shown upon the plan and maps hereto
a"Itached, and
WHEREAS; in the
furtherance of the
public
well being and
safety it is
desirable and necessary to
eliminate traffic
hazards
by eliminating
any encroach-
M=nU whatsoever now or hereafter existing in or upon the said Trunk Highway right of
way;
NOVI, THEREFORE :
BE IT RESOLVED, that said Village does hereby agree and
covenant that it will never permit or suffer, irithin its corporate limits, any
encroachment of any kind whatsoever, -including curb gas pumps and gas stations,
billboards or other structures of any kind i4hatsoever, upon the right of way of
Trunk Highvmy No, 100 as shoTm on the plan and maps hereto attached and sub-
mitted by the Department of Highymys, State of I.linnesota; and that to the above
end said Village hereby agrees that it z -rill never issue any license,
permit, or grant, or give any leave or liberty or any other consent of .Thatever
form for the construction or maintenance of any encroachment whatsoever, including
curb gas pumps and gas stations, billboards or other structures 'of any kind
whatsoevers upon said right of way; and that said.- Village vVil.
cooperate insofar as possible to eliminate existing enoroaclmnents constituting
traffic hazards and will further take any necessary action to eliminate any
encroachment that may hereafter exist on said Trunk Highvmy right of vmyo

and Glen Urban 2nd Addition were opened.
