04-18-44 Council Minutesto order. MINUTES OF THE REGULAR MEETING OF THE GOVALLEY VILL 6E COUNCIL FOR AER—IL 18, 1944 George E. Hanson, President of the Council, called the meeting Those present were: George E. Hanson, Hans Reiss, Charles Franzen and Curtis V. Moe. Application for a non -intoxicating malt beverage license was made by Mrs. Esther Dols. Mr. Edgar Buckley addressed the Council in favor of granting the application. Mr. Reiss moved that the application be referred to the License Committee and which motion was thereupon seconded by Charles Franzen and the roll call taken was as follows: George E. Hanson - Yes Hans Reiss - Yes Charles Franzen w Yes Curtis V. Moe w Yes An off -sale and on -sale non -intoxicating malt beverage license aliplication was presented by one Chester Toncheck. Mr. Charles Bank appeared as attorney for Mr. Toncheck, advocating the granting of the application. Mr. Reiss moved that the application be referred to the License Committee and motion was duly seconded by Charles Franzen and the roll call on said motion being taken was as follows: George E. Hanson - Yes Hans Reiss - Yes Charles Franzen Yes Curtis V. Moe •- Yes. Application for a non -intoxicating malt beverage license was presented by Mrs. Fred Heter, which application was turned over to Curtis V. Moe, Chairman of the License Committee. The matter of re -zoning a certain property on the request of Mr. Finn was considered and the petition opposing said change was filed by the Council. Mr. Jacobson spoke on behalf of the objectors and after discussion it fas unanimously agreed by the members of the Council present that the of this application for re -zoning be made the subject of business y the third Tuesday in May. The matter of the Fire Department, particularly as to delays, was considered, and Fire Chief Lovering reported and Mr. Sane made a statement on behalf of Mr. Rascob denying that any delWospital, relaying the Brown fire call was caused by Mr. Rascob or anyone at and on behalf of Mr. Rascob, Mr. Kane offered the further use of the switchboard at the hospital for fire calls. At the request of the President of the Council, Mr. Arthur Nelson, Pillage Attorney, made a statement as to his opinion on the rights of members of the Fire Department to have sirens and red lights on their cars, and stated that it was his opinion that the Fire Department officers re"d be authorized by the Council to have sirens and red lights on their cars, and Mr. Nelson further stated that at the scene of the fire, the fire Chief or his assistants have the right to issue orders to all persons there, including police officers, and that away from the seen of thefire, the police officers have authority'. "to regulate traffic and handle police matters, and at such places the police officers' orders should be obeyed by all persons, including firemen. The Council then instructed Mr. Nelson to prepare an amendment to the Volunteer Fire Department Ordinance authorizing the use of sirens and red lights by the Fire Department officials or those designated by such officials. George E. Ranson, President of the Council, reported on the matter of expenses of the Police Department and vacated his office as chairman tem- porarily to move the adoption of the attached resolution as to eliminate the expense of two of the police officers of the Village. Said motion was seconded. Mr. Nelson, Village Attorney, objected to the language and resolution relating to the laying -off of two policemen, pointing out that the Village Council could reduce the budget of the Police Department and that the Civil Service Commission would have to determine the matter of employment of police officers to keep within such allowance or budget. The roil call on the resolution was as follows: George E. Hanson - Yes Hans Reiss - No Charles Franzen -- No Curtis V. Moe - Yes The said resolution, failing to attain a majority vote, was declared lost. In response to the duly published notice for bids for a police automobile, the Carlson Motor Company offered to sell one 1942 Ford, Eight - cylinder Deluxe two -door automobile for $1240.09 and offered to allow the sum of $487.09 on the old 1942 DeSoto Sedan; and Slavik Motors, Inc. offered to sell a 1942 DeSoto, two -door Sedan for $1709.77 and allow $600.00 on the old 1942 DeSoto Sedan, and after considering the .matter, Mr. Moe moved that the bid by the Carlson Motor Company of the sale of a 1942 Ford be accepted FAand motion was seconded by Hans Reiss and roll call on said motion was as a X©llows, George E. Moe - Yes The matter of lowering the grade on the Wilcox property at Glenwood and Westwood Drive in the Village of Golden Valley was considered and Arthur Nelson, Village Attorney, said that Mrs. Wilcox was willing to permit the grading -down of her lot with the understanding that the removed soil will be placed on low spots on her own land and that the trees cut down would be left on her property.
