04-26-48 Special MeetingI S 2 April 260 1948 A special meeting of the Village Council of Golden Valley was held at the Village Hall April 26, 1948 at 7:30 P.M. with the following members present: President Cordner, and Trustees Frandsen, Pinch, Putnam and Reiss. Minutes of the meeting of April 20 were read and on motion by Reiss seconded by Pinch approved. Following the appearance of Mr. and Mrs. Ambrose Socher, 405 Meadow Lane, to whom the building inspector had refused a permit for dwelling in and remodeling a sub -standard structure previously condemned, and the report of the building inspector Mr. Erickson, motion by Pinch seconded by Reiss sustaining the action was carried. Yr. Kane read an attorney general's opinion stating that the Village was unable to contract with the City of Minneapolis for fire protection for a small group of home -owners and was instructed to relay the information to Mr. Piazza. On motion by Reiss seconded by Frandsen a first readin` was given to an ordinance entitled: AN ORDINANCE AMENDING AN ORDINANCE ENTITLED "AN ORDINANCE REGULATING THE ERECTION, CONSTRUCTION, ENLARGEI,,4ENT, ALTERATION, REPAIR, MOVING, REMUVAL DEMOLITION, CONVERSION, OCCU- PANCY, EQUIPMENT HEIGHT AND TJIAI'11TE11rP 17CE OF :mLDINGS AND/OR STRUCTURES INTHE VILLAGE OF GOLDEN VALLEY, MINNE- SOTA; PROVIDING FO'? THE ISSUANCE OF PERMITS AND COLLFCTION OF FEES THEREFOR; PROVIDING PENALTIES FOR THE VIOLATION THEREOF, AND REPEALING CERTAIN ORDINANCES AND/OR PARTS OF ORDINANCES ITT CONFLICT THEREWITH." On motion by Putnam seconded by Reiss a first reading was given to an ordinance entitled: AN ORDI- NANCE AMENDIUG AN ORDINANCE ENTITLED "AN ORDINANCE REGULATING PLUMBING, AND LICENSING PLUMBERS, INCLUDINC REGULATION OF INSTALLATION OF CESSPOOLS AND SEPTIC TANKS AND REQUIRI TG A PERMIT TO PERFORM SUCH PLUMBING AND CESSPOOL WORK AND ADAPTING THE MINNESOTA PLUMBER'S CODE." On motion by Putnam seconded by Reiss and approved a first reading was given to an ordinance entitled: AN ORDINANCE AMENDING AN ORDINANCE ENTITLED "AN ORDINANCE CREATING THE OFFICE OF ELECTRICAL INSPECTOR FOR SAFE- GUARDING PERSONS AND PROPERTY AND PROMIOTING THE WELFARE OF THE PUBLIC; AND PRESCRIBING HIS DUTIES, RIGHTS AND AUTHORITY; ESTABLISHING STANDARDS FOR ELECTRICAL EQUIP- MENT AND FOR ITS INSTALLATION AND REQUIRING COTFORMITY THEREWITH; MAKING IT UNALTFUL TO UNDERTAKE THE INSTALLA- TION OF ELECTRICAL EQUIPMENT WITHOUT A PERMIT THEREFOR, X83 EXCEPT AS OTHERWISE PROVIDED; PROVIDING PENALTIES FOR THE VIOLATION OF THIS ORDINANCE AND REPEALING ALL ORDINANCES AND PAR -T^ OF ORDINANCES IN CONFLICT WITH THIS ORDINANCE." Following a discussion of undertaking a program of park development in the Village using at least in part revenue from the cigarette and liquor tax refund, and the determination that the Council retain jurisdiction over expenditures, Trustee Reiss offered the following resolu- tion: A RESOLUTION ACCEPTING THE PROVISIONS OF SECTIONS 448.43 to 448.48 M.S.A. CREATING A PARK BOARD BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF GOLDEN VALLEY: That the Village of Golden Valle y expressly accept the provisions of Sections 448.43 to 448.48 Minnesota Statutes Annotated and the acts amendatory thereof creating a park board in and for said Village as provided in said sections. The said board shall consist of three members appointed by the president of the Village Council and confirmed by the Village Council. When the board is first appointed one member shall be appointed for one year, his term.to expire December 31, 1948, one for two years, his term to expire December 31, 1949, and one for three years, his term to expire December 31, 1950; thereafter all appointments shall be for three-year terms. RESOLVED, further , That the board when createdhere- under shall be known as the Park Board of the Village of Golden Valley and shall have all the powers over the management, control and operation of all real estate now owned or hereafter acquired for park or boulevard purposes as authorized under the statutes aforesaid. Passed by a majority of all the members of the Village Council this 26th day of April, 1948. Approved this 26th day of April, 1948. The following resolution was offered by Trustee Pinch who moved its adoption, motion seconded by Frandsen and carried: WHEREAS, the Village Council, of the Village of Golden Valley, pursuant to authority conferred on it by Chapter 332, Laws of 1903, desires, on its own motion, to improve the streets named below by placing; seal coat on bituminous eurfaee of said streets and by installing a bituminous surface on the curbs and gutters on said streets, which streets are as follows: The entire length of Vestwood Drive The entire length of Sunset Ravine The entire length of Sunset Ridge The entire length of Sumac Road The entire length of Janalyn Road The entire length of Glencrest Road The entire length of North Tyrol Trail The entire length of Park View Terrace Meadow Lane from its intersection with Glenwood Avenue sot`th to its inter- section with Park View Terrace The entire length of Fairlawn Way The entire length of Douglas Avenue The entire length of Valley road The entire length of Glenview Road The entire length of Tyrol Crest June Avenue from its intersection with Wayzata Boulevard south to its intersection with Douglas Avenue The entire length of South Tyrol Trail The entire length of Alpine Pass The entire length of Bridle Path The -entire length of Ortler Pass France Avenue from its intersection with Wayzata Boulevard south to its inter- section with Douglas Avenue The entire length of Kaltern Lane The entire length of Brenner Pass NOW, THEREFORE, BE IT RESOLVED by the Village Council, of the Village of Golden Valley, that it is deemed necessary and expedient to make the improvement of the streets named above, as above set forth, and that on the 18th day of May, 1948 at 7:30 o'clock P.M. this Council will meet at the Village Hall, in said Village, and will, at said time and place, hear the parties interested therein in reference to such improvement, 18.5 and will decide whether or not to undertake such an improvement in whole or in part. Attest: President of the Village Council Village Clerk Trustee Reiss moved the adoption of the following resolution, which motion was seconded by Pinch and approved: RESOLUTION SETTING ASSESSMENT HEARING WHEREAS, pursuant to resolution duly adopted by the Village Council on August 27, 19464 26th Avenue North from Xerxes Avenue North to France Avenue North (Byrd Avenue) has been improved by oiling and resurfacing by contract. Now, therefore, BE IT RESOLVED by the Village Council of the Village of Golden Valley that said improvement and work thereon is hereby accepted and that this Council will meet on the. 4th day of Jun-, 1948, at 8 o'clock P.M., at the Village Hall in said Village, and ascertain the amount of special benefits received by any property within said Village by reason of said improvement, and hear the testimony in that connection of all persons interested or whose property is affected, who may appear in person or by attorney, and present witnesses for examination. Passed by the Village Council this 26th day of April, 1948. Attest: -� President of Vilinge Council i� Village Clerk On motion by Reiss seconded by Putnam a first reading was given to "An Ordinance Amending AN ORDINANCE REGUTATI]G THE LOCATION, SIZE, USE AND HEIGHT OF BUILDINGS, THE ARRANGEMF, T OF BUILDINGS ON LOTS AND THE DENSITY OF POPU- LATION IN THE VILLAGE OF GOLDEN VALLEY, AND FOR THE PURPOSE OF PROMOTING THE HEALTH, SAFETY, ORDER, COTTVENIENCE, PROSPERITY AT?D GENERAL WELFARE IN THE SAID VILLAGE AND FOR SAID PURPOSE TO DIVIDE THE VILLAGE INTO DISTRICTS." Motion by Reiss seconded by Frandsen to adopt the following resolution was carried: i8E RESOLVED, that there is hereby created a special fund to be known as the WATER FUND, into which shall be paid all moneys received from the Golden Valley Fater Commission and all moneys received from the operation of the Village weter system and from which shall be paid all of the expenses of maintenanee and operation Of said system, including the refund, where indicated, of service deposits made by users of the water system. The attorney reported that the City of Minneapolis will not supply water to isolated residences within the Village not now beingserved. Motion by Pinch seconded by Reiss to approve and place on file the settlement effected with Mr. John H. .Johnson by Mr. Kane, acknowledging the receipt of the amount of $200.00 for dirt fill from Ottawa Avenue, was approved. Following discussion of enforcement of existing dog licensing ordinance, Trustee Reiss moved that the Clerk deputize the Village police officers to sell and issue dog licenses. The motion was seconded by Frandsen and approved. Following motion by Reiss seconded by Pinch and approved a first reading was given to AN ORDINANCE REPEALING AN ORDINANCE TO REGULATE THE OPErING OF GRAVEL PITS, REQUIRING A BOND AND PROVIDING A PENALTY FOR VIOLATION THEREOF, PASSED AUGUST 6, 1946. The Clerk reported on an analysis of thepolice Department's survey of existing billboards in the Village, the prohibitive fees assessed, and detail involved in enforcement of the existing billboard ordin- ance, and the information was relayed to Mr. Kane for study.
