07-20-48 City Council Minutes219 July 20, 1948 Regular meeting of the Village Council of the Village of Golden Valley was held July 20 at 7:30 P.M. at the Village Hall. The following members were present: President Cordner, Trustees Frandsen, Pinch and Putnam. Absent: Trustee Reiss. Minutes of the meeting held July 6 were read and on motion by Pinch seconded by Frandsen approved. A communication from the Village Attorney reporting that Judge Selover heal sustained the demurrer of the Village in the action brought by Mr. Sam Tremont on Lot A in South Tyrol Hills, end outlining the legal procedures which might be followed. Following discussion no action was taken. Motion by Pinch seconded by Frandsen that the Clerk relay request to the attorney to draft a new billboard ordinance providing for maximum fees that could be coAected and defended if court action were taken. Motion carried. Motion by Frandsen seconded by Pinch to give a second reading to an ordinance entitled "AN ORDINANCE AMENDING AN ORDINANCE TO PROVIDE FOR THE NUMBERING OF HOUSES AND Ord.Bk. BUILDINGS IN THE VILLAGE OF GOLDEN VALLEY" --amended to P.71 clarify the North-South division line, was approved. The ordinance was given its second reading in the amended form. Motion by Putnam seconded by Pinch to approve the ordinance on its second reeding and order its publication was carried. Motion by Frandsen seconded by Pinch was carried to give a first reading to "AN ORDINANCE AMENDING THE 70NING ORDINANCE OF THE VILLAGE. OF GOLDEN VALLEY" (Radio District) . The ordinance was given its first readin . It was deter- mined that this action would more effectively control estab- lishment of radio transmitting stations and towers, preventing their construction in existing community store areas. Following the appearance of representatives of KEYD who stated their desire to proceed with construction as soon as possibl, motion by Putnam seconded by Frandsen was carried, that an urgency exists, and the ordinance be given its second reading. The ordinance was given its Ord.Bk. second reading. Motion by Pinch seconded by Frandsen to P.69 approve the ordinance and order its pubsiea,tion was carried. Following the appearance of George M. Wilson of North- western Schools and the report of the clerk that no further information had been received from the Planning Commission on the School's application for permission to construct a radio transmitting station, motion by Pinch was seconded by Frandsen and carried to hold the matter in abeyance pending a recommendation from the full Commission. 220 Amendment to the theater ordinance in regard to license expiration wee discussed and failed to receive a motion for a second reading. The President read a second opinion received from the Attorney General on the subject of -theater licensing and opened discussion of provisions for adeouate parking. The following resolution was offered by Pinch who moved its adoption,seconded by Frandsen and carried: BE IT RESOLVED by the Village Council of the Village of Golden Valley, Minnesota: That no license for a regular motion picture theater shall be granted unless the appli- cant shall be able to provide on the theater premises sufficient off-street parking space to rccommodate cars of a capacity atidience of the theater. The standard of sufficiency of parking facilities shell be provision of space in a ration of space for one car to every three theater seats. Memo of July 16 from Mr. Kane was read, on the subject of how the Council should consider any forfeit deposit made by license E'pplioants. Communication dated July 20 ws read from Paul EnVhauser statin," that they had applied for a building permit for a theater. Mr. Gordon Greene requested thpt -ction be delayed to the next regular meeting and n letter of July 20 from Mr. Wright was read stating that they would at th�;t time either supply evidence of intent to construct or �--ith- draw the application for renewal of their license. Motion was carried to defer action to August 7). A number of property owners who previously petitioned for the improvement of the alley between 4th and 5th, France and Archibald,came before the Council reruesting that Y,ction be taken. Motion was offered by Frandsen seconded by Pinch and carried, authorizinir the engineer to estsblish the grade and permitting the petitioners to grade the alley one-half block East of Archibald, southerly from 5th A,Ten­e North a distance of approximately one-half block, placing all dirt removed immediately to the South of the grading and only in the alley right -off -way. Following the reading of a communication dated July 2 from the State Highway Department disclaiming responsibility for Turners Crossroad adjacent to the picnic area at 6th and the Belt Line was read, and referred to the Clerk for further contact with the Highway Department. It was voted to refer communications from Lewis W. Child as attorney for Archie V-,hetstone and f--,-om Leonard T. Bjorklund and Herbert E.
