09-20-49 City Council Minutes129 September 20, 1949 Pursuant to due call and notice thereof, a regular meeting of the Village Council of Golden Valley, Minnesota, was held at its usual meeting place in the Village Hall on September 20, 1949, at 8:00 otclock p.m. The following members were present: Putnam, Pinch,.Reiss, Stark and Stasel, and the following were absent: none. Mayor Stasel presided, and Village Clerk Putnam acted as Clerk. Minutes of the September 6 meeting were read and on motion by Putnam seconded by Pinch approved. The Mayor opened the meeting to a hearing on the rezoning of the Northwestern Bell Telephone Company property located on Mendelssohn Avenue N. just north of the Westview School property. Mr. Sommers, Assistant District Manager, and Mr. Beach, engineer for the phone company, explained the need for erecting a new Orchard Exchange building for the installation of automatic equip- ment to improve the telephone service in this area. No one ap- peared in opposition to the rezoning. Motion by Putnam seconded by Stark carried to give a first reading to "AN ORDINANCE AMEEND- ING THE ZONING ORDINANCE OF THE VILLAGE OF GOLDEN VALLEY BY ESTABLISHING A CERTAIN COMMERCIAL DISTRICT.11 The ordinance was given its first reading. Motion by Putnam seconded by Reiss carried that, due to the existing emergency, a second reading be given to "AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE Ord. Bk. VILLAGE OF GOLDEN VALLEY BY ESTABLISHING A CERTAIN COMMERCIAL n.113 DISTRICT.t' The ordinance was given its second reading. Motion by Pinch seconded by Reiss carried to approve the second reading of the ordinance and to order its publication. In accordance with the Advertisement for Bids theretofore properly published, seal bids were received and opened for the furnishing of labor, skill, and materials for the proposed im- provement of various streets and public ways of the Village. Following the opening and consideration of the bids, Trustee Reiss introduced the following resolution and moved its adoption: - RESOLUTION ACCEPTING BID WHEREAS, pursuant to an Advertisement for Bidspublished in The Robbinsdale Post on September 81 1949, and in the Construc- tion Bulletin on September 81 1949, for the following described improvements: 1. The installation of hard surface pavement of bituminous or other suitable surface material and curb and gutter and such changes in surface drainage as may be found necessary on the fol- lowing named streets: Triton Drive from Noble Avenue westerly to Quail Avenue; Quail Avenue from the north boundary of Woodlawn Park southerly to Culver Road; 120 Orchard Avenue from the north boundary of Woodlawn Park to the south boundary of Woodlawn Park; Culver Road westerly from Noble Avenue to Regent Avenue; Perry Avenue from Triton Drive southerly to Culver Road; Cherokee from Normandy Place to Culver Road; Normandy Place from Perry Avenue westerly to Quail Avenue; 2. The installation of hard surface pavement of bituminous or other suitable surface material and curb and gutter and such changes in surface drainage as may be found necessary on the following named street: A service road heretofore dedicated to the Village for street and highway purposes, located in Woodlawn Park and described as follows: All the tracts or parcels of land lying and being in the County of Hennepin and State of Minnesota, described as follows, to -wit: The Easterly 15 feet of Blocks One (1) and Two (2) of Woodlawn Park according to the map or plat thereof on file and of record in the office of the Register of Deeds in and for said county recorded in Book 119 of Flats page 3, being more specifically described as the Easterly 15 feet of Lots 1, 2, 32 and 4 of Block One (1) of said subdivision and the Easterly 15 feet of Lots 1, 2, 31 41 51 6, 71 81 9, 10, 11 of Block 2 of said subdivision; 3. The installation of hard surface pavement of bituminous or other suitable surface material and curb and gutter and such changes in surface drainage as may be found necessary on the following named streets: Zephyr Place, formerly known as Park Place, from its intersection with Nineteenth Avenue North in a southwesterly direction a distance of 550 feet; York Avenue North, from its intersection with ZephyrPlace in a generally south and east direction a distance of 550 feet; bids were duly received, opened, and tabulated according to law, and the following of said bids were found to comply with the advertisements: _ F. 0. Craig Company, Minneapolis, Minnesota Bid I - Woodlawn Park (Triton Drive, etc.) 20,000 square yards bituminous surface @ 45 cents per square yard 9000.00 Bid III - Noble Avenue Service Road - 1900 square yards bituminous surface @, 45 cents 855.00 Bid IV - Zephyr Place and York Avenue North - 4000 square yards bituminous surface @ 45 cents 1800.00 Total $11655.00 and, WHEREAS, it appears that Gust Holm of Minneapolis is the lowest responsible bidder for those items of said improvement on which his bid is set forth above, and WHEREAS, it further appears that F. 0. Tessem of Minneapolis is the lowest responsible bidder for those items of the said improvement described in his bid set forth above, now, therefore, BE IT RESOLVED by the Village Council of the Village of Golden Valley that the Mayor and Clerk be, and the same hereby are, authorized and directed to enter into a contract with Gust Holm of Minneapolis and to enter into a contract with F. 0. Tessem of Minneapolis, in each case in the name of the Village of Golden Valley, for the improvement of the streets described above in the manner above set forth, and in each case, for the items on which the said Gust Holm and F. 0. Tessem have been found to be the lowest responsible bidders according to the plans and specifications approved by resolution adopted by the Village Council September 6, 1949, and BE IT FURTHER RESOLVED that the Village Clerk is hereby authorized and directed to return forthwith to all bidders the deposits made with their bids, except that the deposits of the successful bidder and the next lowest bidder in each of the above cases shall be retained until contracts have been executed with said Gust Holm and said F. 0. Tessem. Passed September 20, 1949. Attest: Village Clerk Mayor 131 Trustee Stark seconded the motion for the adoption of said resolution, and upon vote being taken thereon, the following voted in favor thereof: Pinch, Putnam, Reiss, Stark, and Stasel, and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted and was signed and attested by the Mayor and the Clerk. Petition dated September 9 and signed by B. J. Marschalek and others was read requesting vacation of the alley in Block 2, Delphian Heights. Motion by Pinch, seconded by Putnam carried to refer the petition to Ter- zich for verification and check of adequacy. Plans for the Woodfill Store were reviewed. Motion by Reiss to direct the issuance of a building permit to Woodfillts in accordance with the plan submitted was seconded by Stark and carried. Motion by Reiss seconded by Pinch carried to give a first reading to "AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE VILLAGE OF GOLDEN VALLEY BY ADDING TO THE USES PER- MITTED IN THE COMMERCIAL DISTRICT.}f The ordinance was given its first reading. Motion by Reiss seconded by Pinch carried to accept the quit claim deed for the norther -most 1041 of Highview Ter- race by Marcus McNabb. A letter from the Minneapolis Institute of Sanitation Services, signed by Fred Bowman, secretary, was read in which the MISS proposed the operation of sanitary fill dumps within Golden Valley with certain stipulations. Mr. Stark suggested that the proposal be referred to Terzich for in- vestigation of the organization and report at the next meeting, at which time further consideration would be given to the proposal. The fire in the dump at the Belt Line and Medicine Lake Road was discussed. Lotion by Stark seconded by Reiss carried that if the fire is not extinguished by midnight September 26, the provisions of the ordinances pertaining to dumps and nuisances shall be enforced and a letter sent to Mr. Stein notifying him of the Councilts action. Mr. Harry Schwartz appeared and stated that he had completed the construction of roads and had erected signs and installed culverts in the Cloverleaf Addition, and was requesting release from his bond. Terzich was instructed to check the roads, culverts and signs in the Cloverleaf Addition and to report at the next Council meeting. 133 Letter dated September 14 from the Planning Commission was read recommending the re -Zoning of the telephone company property on Mendelssohn Avenue, and also recommending that the Council take such action as may be necessary to insure only one dump operation at one time and that the operators of such a dump post a minimum bond of 12000. Mr. Johnson, 1810 Zephyr Place, requested the extension of Zephyr Place at its southern end for a few feet back and the erection of a better road block at the end of this street. The matter was referred to Pinch and Terzicli. Mr. A. L. Strege, 2021 Regent Avenue, and Mr. George Elquist, 639 Archibald, requested electrical permits for their basement homes. It was indicated that electrical per- mits would be granted subject to their submitting letters stating their intention to complete the shell and permanent roof -on their homes within a twelve month period.
