07-18-50 City Council Minutes1 1 Pursuant to due call and of the Village Council of the soca, was held at the Village 1950, at 7:30 o'clock P.M. July 18, 1950 notice thereof, a regular meeting Village of Golden Valley, Minne- Hall in said Village on July 18, The following members were present: Pinch, Putnam, Reiss., Stark, Stasel, and the following were absent: none. Minutes of the July 5 meeting were read and on motion by Pinch seconded by Putnam approved. Motion by Putnam seconded by Reiss carried to grant the following license for the Golden Valley Drive -In subject to presentation of -completed application for permit. Lee Smith Soft drink Letter of July 12 from the Golden Valley Commercial Club was read requesting that the Council petition the State Highway Department to erect traffic signals at the intersection of Olson Highway and Glenwood -Camden Parkway. Motion by Reiss seconded by Stark carried that a request be made of the State Highway Department to install traffic lights at the intersection of Olson Highway and Glenwood -Camden Parkway. Petition dated July 18, 1950, signed by Paul A. Seeman was read requesting the vacation of Phoenix Street between Quebec Avenue N. and Pennsylvania Avenue N. Motion by Putnam seconded by Reiss carried referring the petition to Ter.zich for check of adequacy and instructing him to advertise for a hearing on the vacation for the August 1 meeting if the petition contains the signatures of over 51% of the front footage. Discussion was held on the authorization of Mobile Homes within the Village. Terzich presented a report indicating that Minneapolis and all surrounding communities had approved erection of Mobile Homes. Motion by Putnam seconded by Stark carried authorizing the erection of Mobile Homes within the Village, with the requirement that building, electrical and plumbing inspections be made, and that the Mobile Home Company notify the edministrative assistant of the routes of travel and the times of movement of the homes, and that the administra- tive assistant at his discretion either approve or deny the moving of the homes based on the weather and traffic conditions at the time. The Village Clerk presented an affidavit showing publica- tion in the official newspaper of the notice of public hearing on the proposition to undertake an improvement described as follows: the establishment of the grade, opening, widening, grading, gravelling and blacktopping, and making such changes in surface drainage as may be necessary, and installation of m such curb and gutter as may be necessary in and for the follow- ing described streets and portions of streets: on Hampshire Avenue from -its intersection with Golden Valley Road in a due northerly direction to its terminus, which affidavit was exam- ined, approved and ordered placed on file in the office of the Village Clerk. The Mayor then announced that the meeting was open for public hearing on said proposed improvement, and all persons present who desired to do so were afforded opportunity to express their views thereon. No objections to the making of said improvement or to the levy of assessments to pay the cost thereof were made extent as follows: none. Member Reiss then introduced the following resolution and moved its adoption: RESOLUTION ORDERING THE UNDERTAKING AND CONSTRUCTION OF A STREET IMPROVE-MENT BE IT RESOLVED by the Village Council of the Village of Golden Valley, Minnesota, as follows: 1. At a hearing held this day at 7:30 o'clock P.M. at the Village Hall in the Village of Golden Valley, Minnesota, after notice of said hearing duly published as required by law, this Council has considered the views of all persons interested, and being fully advised of the pertinent facts does hereby determine to proceed with the undertaking and construction of a street improvement in said Village, in accordance with the description of said improvement contained in said notice. 2. The area to be assessed to pay the cost of said im- provement shall include all property within the Village which is benefited by the improvement, as follows: All property abutting on Hampshire Avenue from its intersection with Golden Valley Road in a due northerly direction to its terminus. Attest: Clerk Mayor The motion for the adoption of the foregoing resolution was duly seconded by Member Pinch, and upon vote being taken thereon, the following members voted in favor thereof: pinch, Putnam, Stark, Stasel, Reiss, and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted, signed by the Mayor, and his signature at- tested by the Clerk. George Minder of Golden Valley, Minne- sote is hereby appointed as the engineer for the construction of the street improvement described in the foregoing resolution and he is hereby authorized and directed to prepare plans aijd specifications for the construction of said improvement. Attest: Mayor Clerk The motion for the adoption of the foregoing resolution was duly seconded by Member Pinch, and upon vote being taken thereon, the following members voted in favor thereof: Pinch, Putnam, Stark, Stasel, Reiss, and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted, signed by the Mayor, and his signature at- tested by the Clerk. The Clerk submitted to the Council plans and sDecifications for the street improvement described immediately above, which were approved and ordered filed with the Clerk. Member Reiss then introduced the following resolution and moved its adoption: RESOLUTION APPROVING PLANS AND SPECIFICATIONS FOR STREET IMPROVTMUT BE IT RESOLVED by the Village Council of the Village of Golden Valley, Minnesota, that the pland and specifioation for the street improvement described immediately above, heretofore prepared by the engineer for the Village and now on file in the office of the Village Clerk are hereby approved as the plans and specifications in accordance with which said improvement shall be constructed, except as the same may be.modified by further action of this Council, in accordance with law. The Mayor then announced that the meeting. was open for public hearing on said proposed improvement, and all persons present who desired to do so were afforded opportu- nity to express their views thereon. No objections to the mek Ing of said improvement or to the levy of assessments to pay the cost thereof were made exceDt as follows: none. The Mayor then an- nounced that the meeting was oven for public hearing on said proposed improvement, and all persons present who desired to do so were afforded opportunity to express their views thereon. At a hearing held this day at 7:30 o'clock P.M. at the Village Hall in the Village of Golden Valley, Minnesota,.after notice of said hearing duly published as required by law, this Council has considered the views of all persons interested, and being fully advised of the pertinent facts does hereby determine to proceed with the undertaking and construction of a street -im- provement in said Village, in accordance with the description of said improvement contained in said notice. 2. The area to be assessed to pay the cost of said improve- ment shall include all property within the Village which is benefited by the improvement, as follows: All property abutting on Thirty-fourth Avenue North from its intersection with Noble Avenue, westerly to its intersection with Regent Avenue, insofar as said Thirty-fourth Avenue North lies within the Village of Golden Valley. Member Reiss then introduced the following resolution and moved its adoption: RESOLUTION FOR PLANS AND SPECIFICATIONS FOR A.STREET IMPROVEMENT BE IT RESOLVED by the Village Council of the Village of Golden Valley, that T.'George binder, of Golden Valley, Minnesota, is hereby appointed as the engineer for the construction of the street improvement described in the foregoing resolution and he is hereby authorized and directed to prepare plans and.specifica- tions for the construction of said improvement. Member Reiss introduced and read the following written resolution, and moved its adoption: RESOLUTION CONSOLIDATING PROCEEDINGS FOR THE CONSTRUCTION OF STREET IMPROVEMENTS BE IT RESOLVED by the Village Council of the Village of Golden Valley;as follows: 1. This Council has made the necessary investigation, and hereby finds, determines and declares that proceedings for- the construction of the following described Street Improvemments were all instituted by this Council at substantially the same dates, the exact dates being set forth in parentheses immediately after the description of each improvement described below: The establishment of the grade, opening, widening, grading, gravel- ling, and blacktopping, and such changes in surface drainage as may be necessary, and the installation of such curb and gut= ter as may be necessary in and for the following described streets and portions of streets: a. Olsen Property - the acquisition of a strip of land thirty-three (33) feet in width, described as follows: The east thirty-three (33) feet of the Southeast Quarter of the Northeast Quarter of Section Thirty -One 31) Township One Hundred Eighteen (118) north, Range Twenty-one (21) west, for purposes of a street improve- ment to be undertaken later. 2. This Council further finds, determines and declares that said Improvements can be more economically completed if consoli- dated and joined as one project. 3. Therefore, said Improvements are hereby consolidated and all subsequent proceedings for the construction of said Im- provements shall be conducted in all respects as if the various separate proceedings had originally been instituted as one -pro- ceeding. The Clerk shall cause to be published once in the Rob- binsdale Post, the official newspaper of the Village, (and once in the Construction Bulletin, published at Minneapolis, Minne- sota) a notice for bids for the construction of said improvement, which notice shall be in substantially the following form: ADVERTISEMENT FOR BIDS FOR CONSTRUCTION OF CERTAIN STREET IMPROVEMENTS VILLAGE OF GOLDEN VALLEY, MINNESOTA NOTICE IS HEREBY GIVEN that the Village -Council of Golden Valley, Minnesota, will meet at the Village Hall in said. Village DIM on August 1, 1950, at 8:00 o'clock P.M., to open and consider improvements to be made in said Village, consisting of: Dere shall be described the improvements described in Para- graph.l above, in accordance with and as more fully described in the plans and specifications for said improvement on file in the office of the Village Clerk. Copies of said plans and specifications may be obtained from the office of the Village Clerk or from E. George Minder, consulting engineer, Golden Valley, Minnesota, by depositing $5.00 for each set obtained, such deposit to be refunded to all bona fide bidders who re- trun the documents in good condition within 10 days after the date specified for the receipt of bids. All bids must be submitted on the basis of cash payment for the work. No bids will be considered unless sealed, and filed with the undersigned Clerk before the time of said meeting, and accompanied by a cash deposit, bid bond, or cer- tified check payable to the Village Clerk in the amount of 104. of the amount of the bid, to be forfeited as liquidated damages in the event that the bid be accepted and the bidder shall fail to enter promptly into a written contract and to furnish the required bond. The Village reserves the right to reject any and all bids. Bidders may bid on all or any part of the above work. Separate bids shall be entered for each separate Item set forth above. The Village Council reserves the right to accept the bid or bids of the lowest respective bidder on one or some of the separate items set forth above, and reject such bid on.one or more'than one of the remaining items.
