04-05-55 Council Minutesi REGULAR MEETING of the VILLAGE COUNCIL April 5, 1955 Pursuant to due call and notice thereof a regular meeting of the Village Council of the Village of Golden Valley, Hennepin County, Minnesota was held in said Village on the 5th day of April, 1955, at 7:30 o'clock P.M. The following members were present: Huebsch, Bies,:?ahn, Foss, and the following was absent; Stark. The Mayor called the meeting to order at 7:35 o'Clock P.M. MOVED by Bies seconded by Foss carried that the minutes of the meeting of March 29, 1955, be dispensed with and that said minutes be approved as r submitted to each member of this Council prior to this meeting unlesssome member of the audience wishes them read. ( The minutes were not read.) The Mayor recommended that Miss Marie Ehr be appointed acting clerk for the purpose of recording Council action of the instant meeting. MOVED by Foss seconded by Rahn, carried to approve the recommendation of the Mayor. Bids: Dump Truck The Village Attorney presented an affidavit of notice of call for bids for the purchase of a dump truck according to specifi- cations. Said affidavit was examined, approved and ordered placed on file. The Mayor announced that this was the time and place for opening and consideration of sealed bids for the purchase of said truck, in accordance with the n^tice of advertisement for bids published by the attorney and heretofor presented to this Council. The Village Attorney read a letter from General Motors Corporation stating that the addendum to the dump truck specifications was not received by them and therefore they were unable to submit a bid. MOVED by Rahn seconded by Foss carried that all bids,be returned unopened and that the Village re -advertise with _revised specifications. Bids: Petroleum Products The Village Attorney presented an affidavit.of publication of notice of call for bids for the purchase of petroleum products according to specifications. Said affidavit was examined, approved and ordered placed on file. The Mayor announced that this was the time and place for opening and is consideration of sealed bids for the purchase of said petroleum, in>Prabd` accordance with the notice of advertisement f or bids published by the attorney and heretofore presented to this Council. The Attorney presented to the Council five sealed bids submitted in the course of said notice. Said bids were opened, publicly read and considered. Mr. Ogard stated that Mr. Erickson's plans for a two foot waiver on the south and a 31 foot waiver on the north had been approved by the Planning Commission. MOV,TT,D by Foss seconded by Bies carried to grant Mr. Erickson a waiver to construct a dwelling according to said survey and plans on file in the office of Building Inspector. Request for Re -zoning - Minneapolis, Northfield and Southern Railway Mr. M. L. Davenport,ndustrial Ag_ent for the Minneapolis, Ncrthfield and Southern Railroad requested that approximately 80 acres of land lying south of Medicine Lake Road and east of Winnetka Avenue North be zoned from Open Development to Industrial. The Council was advised that the Planning Commission had studied this matter and had granted approval. MOVED by Foss seconded by .Rahn carried, that notice of public hearing on the proposed re -zoning of said tract of land from Open Development to Industrial be hearing to be inserted in held on May the official Village newspaper said public 3, 1955. Change Order # One Sanitary Sewer Laterals Mr. Harry Mayeron of the G. M. Orr Engineering 11ompany advised the Council that the gas connections would be omitted, that the property owners will replace sod outside of a six foot strip specified, and an error in computing the bid equaling a total of $ 11,750.00 be deducted from the contracts with Barbarossa.and Nodland. MOVED by Foss seconded by Rahn carried to accept the change order. Re: Special Assessment Department Mr. Harry Mayeron introduced Mr. Claire Alden whose application for the spreading of special assessments on lateral sewers had been received prior to this meeting. Mr. Alden stated that he would employ his own help and furnish all materials necessary to spread all special assessments on laterals before the October 10th deadline. The Council discussed the possibility of hiring a full-time permanent employee to do the special assessment work, however, it was decided that time was of the essence in this case and that Mr. Alden could train an enployee of the Village to take over the department after the 1955 laterals .. are spread. MOVED by Rahn seconded by Bies carried that a.formal agreement between the Village and Mr. Alden be drawn up by the Attorney and that Mr. Alden be employed as set forth in his letter of March 1955. Re: Sanitary Sewer Inspector The Village Engineer presented facts and figures on the employment of a full time sewer inspector for the Village. Mr. Harry Hamman, Plumbing Inspector, stated he did not believe a full time inspector would be necessary. MOVED by Rahn seconded by Huebsch carried that the matter be tabled indefinetly due to the fact that time is not of the essence, and that the Council wished to discuss the matter with Mr. Owens upon his return. G. M. Orr Bill Mr. Mayeron of the G. M. Orr Engineering Company presented a bill in the amount of $ 39,128.01 as a 3i% fee for engineering on the Sanitary Sewer Laterals. The Attorney stated that the bill was in the proper form. MOVED by Rahn, seconded by Bies, carried that the bill of the G. M. Orr Engineeri- ng Company be paid out of monies received from the bond issue of April 125 1955. E. F. Crowl Assessment Mr. Crowl appeared to protest the assessment levied on his property for the sewer trunk line. MOVED by Rahn seconded by Foss carried to place this item on the agenda for the regular meeting of the Council of April 19, 1955. Re: New Hope Progress Report Mr. Mayeron of the G. M. Orr Engineering Company stated that the Minneapolis City Council would not take any action on the proposed New Hope Sewer until April 8, 1955. MOVED by Rahn seconded by Bies carried that this item be placed on the Council's agenda for April 19, 1955. Service Drive - T. H. 55 from Jersey to Sixth Avenue North. The Engineer presented letters from residents along T._H, who wish access to the new highway. The Mayor requested the Engineer to prepare proper petitions for the interested property owners, and that the property item be placed on the Council agenda for May 3, 1955 for a. progress report. Re: Bond Sale: The Attorney stated that the Bond sale will be held on Aril. 1 , -1975 and also that the Village has received a BAA rating from Moody's Investors Service.. Acceptance - Tract F - Westurban MOVED by Rahn seconded by Huebsch carried to accept said Tract F as per survey on file in the office of the Village Clerk. Suburban Hennepin County Relief Contract MOVED by Foss seconded by Rahn carried to accept the contract and authorize the Mayor and Clerk to affix their signatures thereto. Lindstrom Building Permit The Engineer reported that the building permit had been issued subject to restrictions as set forth in the minutes of the March 29, 1955 meeting and that the Building Inspector had been alerted to check the construction. Tax Forfeited Lands MOVED by Rahn seconded by Foss carried to adopt a resolution authorizing the sale of tax forfeited lands designed as list 381-C said resolution referred to hereinafter as Resolution No.//.2 , and to authorize the proper VillageOfficials to execute and forward said resolution to the Hennepin County Land Commissioner. Appointment to Park Board MOVED by Noss seconded by Bies carried that Mr. Wallace Gustafson, 6336 Phoenix Street be appointed to fill the unexpired term of Mr. Hasley Johnson. Specifitations-Fire Truck MOVED by Rahn seconded by Bies carried to approve the plans and specifications presented by the -fire department for the purchase of a fire truck and that call for bids be inserted in the official Village newspaper, all bids to be opened and considered May 3, 1955. Minnesota Highway Department Request for Permit. The Mayor read a letter from M. J. Hoffman - Highway Commissioner of the Uta.te of Minnesota setting forth the Highway's plans for the use of their property on T.H. 100. MOVED by Rahn seconded by Foss carried to place this item on the Council's agenda for April 19, 1955. Cigarette License. MOVED by Rahn seconded by Foss carried to approve issue of a cigarette license per application on file to Woodfill's Shell Service (License No. 983) Electrical Ordinance MOVED by Rahn seconded by Foss carried to instruct the Village Attorney to prepare an ammendment to the Village Electrical Ordinance changing the yearly license fee from $ 5.00 to $ 15.00.
