10-10-55 Special MeetingSPECIAL MEETING OF THE VILLAGE COUNCIL October 10, 1955. Pursuant to due call and notice thereof a:Special Meeting of the Village Council of the Village of Golden Valley, Hennepin County, Minnesota, was held at the Village Hall, 7830 -6th Avenue North in said Village on Monday the 10th day of October, 1955, at 12:00 o'clock noon. The following members were present: Dies, Foss, Rah,; and Stark; and the following was absent: Nadasdy. Acting Mayor Dies called the meeting to order at 12:10 o'clock P.M. Glenwood Hills Hospital Re: Dr's. Clinic: The Administrator stated that he had received complaints to the effect that Glenwood Hills Hospital had converted the former residence of Mr. R. C. Rascop to a doctor's clinic without taking out a building permit therefore, and further, that such use was contrary to the zoning ordinances of the Village of Golden Valley. The Administrator then stated that as Chief Building Inspector he had just visited the premises and that there were no evidences of any remodeling whatsoever, in .that any remodeling which may have been undertaken had not in any way changed the load bearing structure of the building. The Administrator further stated that unless the Council wished to include the clinic under the category of "needed public institutions" there was a possibility that the doctors clinic on Glenwood Hills Hospital property could come under a "business and professional office building zone" if and when such zoning category is created by the Council. The Council accepted the above report of the administrator without com- ment and without action. Rezoning Public Hearing -Clinic: "See Minutes of October 4, 1955:1. This public hearing is an adjourned public hearing called on due notice in the official newspaper to be held on September 20, 1955, from which date it was adjourned to October 4, 1955. This proceeding has been called upon the petition of Member Dies and Rahn in writing according to Rule I of the Rules of Proceedure of the Village of Golden Valley, the Administrator stated that the commercial building inspector had inspected the plat and plans and specifications for the construction of the proposed clinic and had the approved said plans for the clinic. Objector: Objection: Mr. Fred Albert Mr. Albert stated that the people of Clover - 516 Clover Lane leaf Terrace Addition are against any rezoning that would permit any commercial development in the area on the grounds that such rezoning is opening the door to commercial construction which would depreciate the values of their homes. Mr. Albert further stated that he personally ,&T not object to a one story office building to be located according to the plans of Dr. Holzapfel et al. 1 1 Several persons present Their objection's may be summarized as did not give their names follows: 1. Depreciation of the value or addresses when stating of their homes. 2. Its spot zoning. their objections. 3. The clinic should be located on the eastern edge of the tract of land. 4. the Clinic should be located closer to the tracks than to Olson Memorial Highway. Member Rahn inquired as to the type of exterior finish which would be applied to the building. Dr. Holzapfel stated that the front of the building a new type of building material made from volcanic rock would be used. Member Foss inquired as to the areas which would be used for parking purposes. Dr. Holzapfel stated that cars would enter from the east, circle the front of the building and park on the west and to the rear of the:build- ing. Acting Mayor Bies then stated that Mayor Nadasdy wished it understood that he sought release from his promise to the people of Cloverleaf Terrace Addition that no action would be taken on this matter with his consent until the Planning Commission had studied the matter on October 13, 1955, but that the members of the Council present believed that inasmuch as several members _ of the Commission had met with the people of Cloverleaf Drive during the latter part of last week, the intent of the Mayor had been met. Those present indicated by their attitudes that they did not agree to the above statement in its entirety, but no objection was made. A copy of a letter dated October 5, 1955, addressed to Mayor Nadasdy and signed by E. R. Conry was read and ordered placed on file. Acting Mayor Bies thereupon declared the Public Hearing closed and inquires as to what disposition of the matter the members of the Council wished to make. MOVED by Rahn, seconded by Foss, carried to give a first reading to an ordinance entitled, "AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE VILLAGE OF GOLDEN VALLEY", and upon vote being taken thereon, all voted in favor thereof. -IJ7 MOVED by Rahn, seconded by Foss carried that the Chief Building Inspector be instructed to issue a building permit for the construction of a Medical Clinic on the premises described in the affidavit -of publication according to survey and plans and specifications viewed by this Council at this meeting and on file in the office of the Chief Building Inspector.
