REGULAR MEETING
OF THE
VILLAGE COUNCIL
Decemberi.8, 1955
Pursuant to due call and notice thereof a regular meeting of the
Village Council of the Village of Golden Valley, Hennepin County,
Minnesota, was held in the Village Hall in said Village on the
8th day of December, 1955, at 7:30 o'clocl P.M. The following mem-
bers were present: Bies, Foss, Nadasdy, and Stark and the following
was absent: Rahn. The Mayor called the meeting to order at 7:10
o'clock P.M.
MOVED by Foss seconded by Bies carried that the reading of the
minutes of the meetings held on November 1, 1955, November 14, 1955,
and on November 15, 1955, be dispensed with and that said minutes
be approved as submitted to each member of this Council prior to
this meeting unless some member of the audience wishes them read.
(The minutes were not read.)
Mr. Roy D. Johnson et a1 -- Protest of issuance of Liquor License
v Cornoratione
The Mayor announced that these proceedings were in the nature of
a public hearing protesting the issuance of an off -sale liquor
license to the Valley Corporation, 7928 Olson Memorial Highway.
The Village Administrator stated that several letters and petitions
had been received by his office objecting to the issuance of said
license, and objection to the issuance of any additional liquor
license in the Village. The Council ordered such material placed
in file.
Objector Objection
Roy D. Johnson Mr. Johnson stated that he had
1049 Orkla Drive appeared before the Village Council
on January 18, 1955 and had presented
a petition objecting to the issuance
of any off -sale license and specifi-
cally to the one requested by Knight's
Pharmacy. Mr. Johnson further stated
that he realized the license could
not be revoked at this time, but that
he wished the Council to give serious
consideration to limiting the number of
off -sale liquor establishments in the
Village.
Rev. Ernest Gjelten Rev. Gjelten stated that he could

Church after having denied it in January of
1955.

would continue to pass out liquor
licenses each time a request was
presented.
Thomas Boyer Mr. Boyer questioned whether the

there was a great deal : of protest:,to
the continuance of the license.
Robert Olson
401 Utah Ave. South Mr. Olson stated that he believed
a municipal liquor store was the
only solution to the liquor problem
in Golden Valley.
Upon question, the Village Attorney stated that a license for the
sale of intoxicating beverages could be revoked during the term of
the license only for cause, but that at the expiration of the license
term there was no obligation to renew the license, and that cause
did not need to be shown.
No action was taken.
Rezoning, Request for Public Hearing - A. D. Strong Company:
The Administrator stated that the Planning Commission had held an
advertised public hearing on December 7, 1955, on the rezoning of
certain tracts of land as described in the affidavit of publication
(said land lying west of Douglas Drive and about one-half mile
north of Golden Valley Road, and comprising about 105 acres), but
had taken no action.
Mr. Robert Boblett, representative of said company, and `Mr. Virgil
Hill, attorney, requested the Council conduct a public hearing on
the rezoning of said property at the earliest possible time.
MOVED by Bies seconded by Stark carried that the Village clerk be
instructed to insert advertisement of notice of public hearing on
the rezoning of a tract of land as described in the petition of
the A. D. Strong Company, said public hearing to be held at 8:00
o'clock P.M., December 27, 1955, at the Village Hall.

MOVED by Stark seconded by Dies carried to certify the above election
,returns as submitted by the Commissioner of Registration and to de-
clare,the candidates receiving the greatest number of votes elected
to` he officesindicated.

Appointment of Constable:
The Council discussed the vacancy created by the resignation of
Mr. Wm. Varner, Jr.
MOVED by Dies that LeRoy E. Schuller be appointed Constable for
the unexpired term of Mr. Wm. Varner, Jr.
The Mayor called for a second and hearing none, declared the motion
lost for want of a second.
Public Hearing, Vacation of Private Lane and portion of Zane Avenue
North, also portion of Parkview Blvd.
The Village Clerk presented an affidavit of publication of notice in
the official newspaper of public hearing to be held at this time and
place regarding the vacation of a certain street as described in said
affidavit. The Village attorney advised the Council that the publi-
cation was insufficient and that re -publication was necessary.
MOVED by Foss seconded by Dies carried that the village clerk be in-
structed to insert advertisement of notice of public hearing regarding
the vacation of a certain street as described in said affidavit, said
public hearing to be held at 7:30 o'clock P.M., January 3, 1956, at the
Village Hall.
Mr. Paulsen, protest of waiver granted to Mr. Larry Swanson: (See
Minutes of October 177-1795)

Mr. Louis Paulsen, 2330 York Avenue North, and Mr. George X Conners,
Attorney for Mr. Paulsen, objected to the elevation of the home being
built on Lot 21, Block 2, Delphian Heights by Larry Swanson. Upon
question as to the nature of his objection, Mr. Paulsen stated, "I
have no objection to anything other than the height of Mr. Swanson's
home:"

The Village Attorney advised the Council that the dispute was a
private matter.
MOVED by Bies seconded by Foss carried that no action be taken.
White Plat:
MOVED by Stark seconded by Foss carried to grant preliminary approval
to the plat of Mr. Ed. White as approved by the Planning Commission,
provided however, that Outlot A not be acquired by the Village for
park or playground purposes.
Building Permit, Thompson Lumber Company:
Mr. Buckholz, representative of the Thompson Lumber Company, pre-
sented plans and specifications for a new warehouse to be constructed
south of the Minnesota Western Railroad tracks and east of-Winnetka
Avenue North.
Members Bies and Foss stated that they objected to locating the build-
ing on the street right-of-way line. The matter was deferred until
the meeting of December 20, 1955•
Fred Jones, re: Acceptance of streets in Hampshire Oaks ist, 2nd and
3rd Additions, also preliminary approval -Westmore Heights:
Mr. Fred Jones requested the cash depost'guaranteeing the construction
of streets in Hampshire Oaks 1st, 2nd and 3rd Additions be reduced from
$1,000.00 to $400.00. The Village Engineer stated that the streets
in said additions met or exceeded Village specifications and recom-
mended their acceptance subject to the deposit of $400.00.
MOVED by Stark seconded by Bies carried to release the $1.000.00
check and to accept a $400.00 certified check in lieu thereof, as a
cash deposit guarantee for purchase of street signs, etc.
MOVED by Stark seconded by Foss carried to give preliminary approval
to the plat of Westmore Heights.
Bids -Accounting and Billing Machine:
The Village Administrator recommended the bid of the National Cash
Register Company be accepted, with the typewriter attachment.
MOVED by Stark seconded by Bies carried to accept the bid of the
National Cash Register Company for one accounting machine per speci-
fications in the total amount of $4,460.00.
MOVED by Stark seconded by Bies carried to authorize the purchase from
the Natonal Cash Register Company of a typewriter attachment for the
accounting ;and billing machine at a cost not to exceed $490.00.
Mr. Bennett, salesman representative of National Cash Register Company,
agreed on behalf of his company to furnish the machines listed at the
prices stipulated above.
