of the
VILLAGE COUNCIL
December 20, 1955
Pursuant to due call and notice thereof a regular meeting of
the Village Council of the Village of Golden Valley, Hennepin
County, Minnesota, was held in the Village Hall in said Village
on December 20,,.1955, at 7:30 o'clock P.M. The following mem-
bers were present; Bies, Nadasdy, Rahn, Stark, and the follow-
ing arrived shortly after the meeting was called to order: Foss.
The Mayor called the meeting to order at 7:45 o'clock P.M.
MOVED by Rahn seconded by Stark carried that the reading of
the minutes of the meeting held on December 8, 1955, be dis-
pensed with and that said minutes be approved as submitted to
each member of this Council prior to this meeting unless sr�me
member of the audience wisher them read. (The minutes were not
read.)
Building Permit -Thompson Lumber Company:
Member Bies stated that he, :fir. Buckholz of the Thompson
Lumber Company, and Mr. Manley Davenport of the Minneapolis,
Northfield, and Southern Railroad, had discussed the setback
and location of said lumber company's proposed warehouse and
that petitioners requested a setback of five feet from the
Winnetka Avenue right of way line.
MOVED by Rahn seconded by Foss carried to refer the matter to
the Planning Commission, with a request for expeditious action.
Public Hearing Ae-zoning A.D. Strong Company-"Honey%=cell":
The Mayor stated that he had attended a meeting of:,a citizens
committee create.. to oppose said rezoning matter, said commit-
tee calling themselves the Golden Valley Area Development
Committee, and that the members of the committee requested a
postponement of the public hearing scheduled for December 27,
1955.
MOVED by Rahn seconded by Bies carried to hold a,public hearing
on the re -zoning request on January 24, 1956, at 7:30 o'clock
p.m. at the Village Hall, and to cancel the previously called.
hearing for December 27, 1955.
Resignation of Air. Norris Ogard, Village Engineer:
Mayor Nadas�'.y presented the letter of resignation of Mr. Norris
Ogard dater`. -December 15, 1955, effective January 31, 1956.

MOVED by Stark seconded by Foss carried to accept the resignation
of Mr Norris L' Ogard, effective January 31, 1956.
MOVED by Rahn seconded by Stark carried to instruct the Village
Administrator to do everything reasonable and necessary to
obtain a replacement for lir. Ogard.
Appointment of Constable:
MOVEED by Rahn seconded by Foss carried to appoint Mr. Roger
Robert Scheid to fill the unexpired term of Air. ;ism. Varner Jr.
Preliminary Approval, flat of David Trach:
Air. David Trach presented a preliminary plat of a new subdi—
vision .lying south of Glenwood Avenue and a short distance east
of Edgewood avenue South.
MOVED by Foss seconded by,ahn carried to give preliminary appro—
val to the plat as submitted and on file in the office of the
Engineer.
Re—assessment; S.S. Lateral Imp. No. 1:
The Village Administrator advised the Ccuncil• that all costs of
said improvement would be known before the end of 1955, and upon
receipt of such costs he would immediately advise the council.
I -Street—South Trunk Sewer:
Letter from the G. 11. Orr Engineering Company, dated December
,, 1955, was read and ordered placed on file, said letter in—
quiring whether or not Laurel avenue would be rough graded prior
to the construction of the South Trunk Sewer line.
Said letter further advised the council that the construction
of said sewer might cut the forem—style drain pipe of Judicial
Ditch -#6. On question the attorney stated money to increase the
size of the pipe.
Member Rahn then introduced the following resolution and MOVED.

The motion for the adoption of the foregoing resolution was duly .
seconded by Member Foss and upon vote,being_taken thereon the fol—
lowing voted in favor thereof: Bies, Foss, Nadasdy, Rahn and Stark,
and the following voted against the same: None, whereupon said
resolution was declared duly passed and adopted, signed by the
Mayor and his signature attested by the Clerk. See Resolution

Letter of December 3, 1955, from Mr. Douglas Rees was read and
placed on file.
MUV ) by Cahn seconded by Bies carried to accept rightof—way and
promises to deed, which ever is applicable: As soon as deeds are on
file in the office of the Village Clerk and have been approved by
the Engineer and the Village Attorney, the Council grant permission
for fir. itees and 1.1r. Enghauser to enter on the premises and to
construct a street. All work is to be done under the supervision
of the Village Engineer who must approve all plans, in order that
he may finally recommend that the Council accept this street for
public purposes. It is understood by all parties to this agree—
ment that the Village Engineer has reasonable powers to alter or
modify any item set forth in 11r. Hees letter of Dec. 3rd in the
reasonable exercise of discretion in the best interests of the
Village of Golden Valley.

Engineer Re: request of Mr. Hlady:
MOVED by Rahn seconded by Bies carried to table the matter until
Mr. Elady request further action.
Sanitary,Sewer Lateral Assessment— 4715 Golden Valley Road:
The Village Administrator stated that Mr. Alois J. Pankonie, 4715
Golden Valley it,oad, had been charged the full assessment of X5.32
per front foot for S.S.Sat Imp. #I, but that said property should
have been assessed $1.83 per front foot the outlet charge.)

Administrator to correct the assessment roll of said improvement.
Salaries of Partime'inspectors: computing:
The Village Administrator recommended the following method of
computing the reimbursement of part—time electrical, building, and
plumbing inspectors for 1956:
1. Each inspector to receive $150.00 per month, plus certain
additional compensation as set forth in (2.a.) and (2,b.) below.
2. The percentage upon which 1955 compensation was based, is to be
paid in 1956 except as follows:
a. If said percentage exceeds x1,000.00, each such inspector
is to be paid, during the twelth month, the difference between
said percentage and $1,800.00 but not more than $2,500.00
b. If said percentage e.>ceeds•62,500.00 each such inspector
is to be paid the difference between $2,500.00 and,$1,800.00
c. In no case shall any such inspector receive more than
X2,500.00 compensation'in 1956 except as set forth in (d)
below.
d. Provided, however, the Council Reserves the right to modifty
this agreement at any time and to determine amounts of money
due, if a y, to any inspector should any condition arise which
is not within the scope of parts (a) (b) and (c), above.

Plymouth Avenue Assessments--FInd 116:
The Village Administrator requested the Council defer this matter
to the next meeting.
Sanitary Sewer Contract with St. Louis Park:
The Attorney requested the Council defer this matter to the meeting
of January 3, 1956.
Re—zoning, in re: Holzapfel Clinic:
The Attorney, stated that Attorney General miles Lord had ruled
the re—zoning to commercial "restricted to dental. and medical
clinic" an illegal act, but that an "Office and -Professional Dis—
trict" was a valid zoning of property in any case. The attorney
requested the council defer this matter to the January 3, 1956,
meeting.
Re Property of -Minneapolis Park Hoard:
The Village Administrator advised the Council that the Minneapolis
Northfield and Southern Railroad had sold a portion of their zoned
property -,north of Indiana 1ivenue and the Minneapolis, Northfield
and Southern Railroad tracks to the Minneapolis Park Board, and that
the Planning Commission recommended that the Council re—zone the
property to Ogen Development.

Session re: McGinnis
Case:
The attorney discussed the Al
McGinnis case with the Council.
The Administrator presented and read the following letter
dated Nceriber 16, 1955, from Mr. John Erighatiser, Acting
Secretary, Civil Service 'Coimission: `"Gertleiuieii: -At a meet-
ing of the Civil Service Commission held at the Village Hall
December 12, 1955, it ;vas unanimously voted to recommend
that the Villane Council appeal the recent District Court
decision in the Al McGinnis matter".
MOV by Rahn seconded by Bies carried to acceptthe
recommendations contained in the above letter from the
Civil Service Commission, and to`instruct the attorney to
employ additional legal counsel should it be necessary, and
to authorize the attorney to do every reasonable act as
agent of the villa -_e, including an appeal to'a higher court,
in order to successfully conclude the case.
