02-21-56 City Council MinutesREGULAR MEETING of the VILLAGE COUNCIL February 21, 1956 Pursuant to due call and notice thereof a regular meeting of the Village Council of the Village of Golden Valley, Hennepin County, Minnesota, was held at the Village Hall in said Village on February 21, 1956, at 7:30 o'clock P.M. The following members were present: Bies, Nadasdy, Rahn, Stark, Teresi; and the following were absent: None. The Mayor called the meeting, to order .at 7:40 o'clock P.M. MOVED by Rahn seconded by Stark carried that the reading of the minutes of the meeting held on January 17, January :24., January 28, February 4, and February 71 1956, be dispensed with and that said minutes be aproved as submitted to each member of this Council prior to this meeting unless some member of the audience wishes them read. (The minutes were not read.) Second reading -- Ordinance zoning Westbrook and Brunswick Court Additions to Residential: See minutes of February 7, 19 MOVED by Stark seconded by Bies carried that a second reading be given to and ordinance entitled, "AN ORDINANCE AMENDING THE ZONING CODE." MOVED by Stark seconded by Bies carried to approve the above ordinance quoted herein by title on its second reading and to order publication. See Ordinance Book Page 263 . Second reading -- Ordinance zoning a certain area to Professional and Business Office istrict: See minutes of February 7, 1956 MOVED by Rahn seconded by Stark carried to give a first reading to an amendment amending an amendment to the zon21g code entitled, "AN ORDINANCE A7ENDING THE ZONING CODE", which was given its first reading February 7, 1956. MOVED by Teresi seconded by Stark carried to approve the amendment on its first reading and to incorporate said amendment into the second reading of the ordinance zoning certain areas to Business and Professional Office District. MOVED by Stark seconded by Rahn carried to give a second reading to an ordinance entitled, "AN ORDINANCE AMENDING THE ZONING CODE". Second Reading -- Ordinance re: InsanitA.ry conditions: (See minutes of February 4., 1956.) MOVED by Bies seconded by Stark carried to give a second reading to an ordinance entitled, "AN ORDINANCE REQUIRING THE CLEANING OF PREMISES, PROVIDING FOR SANTTARY INSPECTION, AND ESTABLISHING A PENALTY FOR VIOLATION THEREOF". MOVED by Stark seconded by Bies carried to approve the above ordinance herein quoted by title on its second reading and to order publication. See Ordinance Boob Page 275 . Petition re: "HONEYWELL" re -zoning matter: The Village Administrator read a petition signed by 14 residents of Golden Valley living on Douglas Drive Nortr, Medicine Lake Road and St. Croix Avenue, said letter commending the Council for re -zoning the property adjacent to their property for the use of the Minneapolis -Honeywell Reg- ulator Co. The Village Administrator then presented 138 petitions signed by 1252 persons opposing the re -zoning for Honeywell, and stated that each councilmen -had received copies of the form of petition. The Village Attorney stated that in his opinion, and in that of several other municipal attorneys, said petition carried no legal signifigance, and that it did not suspend the ordinance re -zoning "Honeywell" property, and that no election could be held. 1 MOVED by Rahn seconded by Stark carried to place the petition on file in the office of the Village Clerk. Hardship Waiver -- Dr. Manuel Binder, Lotl, Block 2, Thotlandts Twin View Terrace: MOVED by Teresi seconded by Stark carried to approve a 25 foot setback on Angelo Drive according to plans inspected by this Council at this meeting and on fil in the office of the Building Inspector. Request for Commercial Building permit, Lot 18, Spring Green South Addition: Mr. Don Erickson, of Patch and Erickson, Architects, presented plans for a proposed colonial home type office building to be used by the firm of Rees-Thomson-Scroggins as a real estate office. MOVED by Rahn seconded by Stark carried to grant preliminary approval to the plans. Report of Park Board, re: Lot 1, Block 2, Spring Green Addition: The Village Administrator presented a letter from the Golden Valley Park Board recommending the Council decline the offer of Lot 1, Block 2, Spring Green Addition, for park purposes. MOVED by Teresi seconded by Rahn carried to accept the recommendation of the Park Board. Improvement of Noble Avenue in 1956: The Village Administrator stated that inasmuch as Noble Avenue was an arterial street and that as an arterial street it would be necessary to lay a blacktop mat on Noble Avenue. The Village Engineer stated that during 1956 it may be possible to lay a good base on Noble Avenue, and during 1957 pave the street with bituminous pavement. The Council requested cost estimates and a time schedule on the improvement. Grade and center line of Jersey Avenue South: report of Engineer: The Village Engineer stated that a problem had arisen as to the location of the center line of Jersey Avenue South. If the line follows the present center line of Jersey Avenue, -north of Glenwood Avenue, the entire 60 foot right of way would have to come from Ring Corporation property and the Church of the Good Shepherd would have no access to this street unless 15 feet could be purchased by the Church from the Ring Corporation, owners of the adjoining property to the west abutting on the proposed line of Jersey Avenue South. 1 M MOVED by Rahn seconded by Teresi carried to accept the recommendation of The Engineer and to instruct the Village Attorney to negotiate for the acquisition of all necessary right of way. Grader rental: The Village Engineer stated that because of the work to be done in both the northeast area and the south trunk area during 1956 the Village would either have to buy or rent an additional grader in 1956. MOVED by Ries seconded by Teresi carried to approve plans for the rental of a grader with option to purchase; and to order advertisement for bids, said bids to be received March 19, 1956. Member Stark voted "NO" on the above motion. Traffic Counting Device- The Village Engineer requested that a traffic counting devices be purchased by the Village at a cost of approximately $,135.00 to $365.00. Amount to be assessed supplemental lateral sewer assessment: (See minutes oT January 28., 19 MOVED by Rahn seconded by Bies to set the amount of said supplemental sanitary sewer assessment at $178,000.00 Upon roll call being taken thereon the following voted as follows: Bies: YES Nadasdy: NO Rahn: YES Stark: NO Teresi: YES MOVED by Rahn seconded by Bies carried to instruct the assessment rolls for Sanitary Sewer #1 and Sanitary Sewer Lateral Improvement #1 be corrected as follows: The assessment levied against Plat 35719 Section 19 Township 29 Range 24 Parcel 2400 in the amount of $20033.12 for Sanitary Trunk Improvement #1 be stricken from assessment rolT n as much as said property is owned by the Minneapolis Park Board and further that the assessment levied against above described property fro Sanitary Lateral Sewer #1 in the amount of $17,114.16 be stricken from assessment roll in as much as said property is owned by Minneapolis Park Board. Assessment of General Mills Office Building Site: The Village Attorney stated that it was not necessary to assess said site as a part of Trunk Sewer No. 2 even though said site was included in the notice of public hearing. MOVED by Bies seconded by Stark carried to exclude said site from the South Trunk assessment area, and to instruct the Village Attorney to draw up a contract with General Mills regarding the cost of connecting to the South Trunk by force main, should said company desire such a connection. Contract with St. Louis Park: The Village Attorney stated that St. Louis Park was ready to sign the agreement with Golden Valley and would do so within a .few days. Rezoning re: Property owned by Schaper T"lanufacturing Company: MOVED by Rahn seconded by Bies carried to instruct the Village Clerk to insert notice of public hearing in the official Village newspaper to re -zone approximately 6 (six) acres of the 9 (nine) acres presently m ned Industrial to Commercial District, per legal description prepared by the Village Engineer, said public hearing to be held on March 19, 1956. The Council instructed the Village Administrator to obtain a letter from Mr. Schaper stating his intentions as to the three acres zoned industrial. Correction of assessment, S. S. Lateral Improvement No, 1 Mary K. Beisang, 00 Gol en ValleyRoad­: The Village Administrator stated that an error had been made in the latera]. assessment of the property owned by Hary K. Beisang and that the assessment should be reduced from w$4,271.72 to $806.76. MOVED by Stark seconded by Bies carried to correct the assessment rolls. Village Hall electrical work: The Electrical inspector presented preliminary plans and specifications for the re -wiring of the village hall and garage. MOVED by Bies seconded by Stark carried to authorize the Village Clerk to insert advertisement for bids for said electrical work in the official village newspaper and the Construction Bulletin, bids to be accepted at the March 19, 1956, meeting. Physical Examination -- Fire Department: The Village Council requested the Village Attorney check the law governing compensation for heart attacks, penumonia etc., with regard to village employees, and to report his findings at the March 6, 1956, meeting. The Council instructed the Fire Department to advisetheCouncil by letter not later than March 6, 1956, of the wishes of the Fire Department re- garding the intra -departmental processing of requisitions. Gravel Needs for 1956. The Village Engineer stated that the Village -will need a.great deal of gravel during 1956 and that he had investigated the gravel pit -located on Douglas Drive and that said gravel met specifications for village use. The Council requested that the Engineer report his -recommendations in writing to the Village Council. Second Meeting in March: MOVED by Teresi seconded by Stark carried to hold the second meeting in March on March 19, 1956, the 20th of March being the Presidential Primary election date.
