of the
Village Council
April 3, 1956
Pursuant to due call and notice thereof a regular meeting of the Village
Council of the Village of Golden Valley, Hennepin County Minnesota was held
in the Village Hall in said Village on April 3, 1956, at 7:30 o*clock P.M.
The following members were present: Bies, Nadasdy, Rahn, Stark and Teresi,
and the following were absent: None. The Mayor called the meeting to
order at 7:40 o'clock P.M.
MOVED by Rahn seconded by Bies carried that the reading of the minutes of the
meeting held on March 19, 1956, be dispensed with and that said minutes be
approved as submitted to each member of this Council prior to this meeting
unless some member of the audience wishes them read. (The minutes were not
read.)
Adjourned public hearing re: West one—half Yale Garden Homes: (See minutes
of March 19, 1956.)
The Mayor announced that this was the time and place for the adjourned
public hearing above referred to. All persons present who desired to do
so were afforded an opportunity to express their views thereon.
Mr. Nason of Morell and Nichols displayed the revised plat of the West one—
half of Yale Garden Homes as directed on March 190 1956, and stated that there
was adequate space for a 60 foot road on the south side of Mr. Wormsbeckerts
property, with the Valley Community Presbyterian Church providing half of
the right—of—way.
Mr. M.K. Patterson, Planning Commission representative, stated that the
Planning Commission recommended the extension of Lowry Terrace westerly to
T.H. 100.
There were no objectors to the street plan.
Mr. Wormsbecker stated that the streets as now platted met with his approval.
The Mayor then closed the public hearing.
Member Stark thereupon introduced the following resolution and MOVED its
adoption: "RESOLUTION APPROVING STREET PATTERN OF WEST z YALE GARDEN HOMES".
The motion for the adoption of the foregoing resolution was duly seconded
by Member Bies and upon vote being taken thereon the following voted in
favor thereof: Bies, Nadasdy, Rahn, Stark and Teresi, and the following
voted against the same: None, whereupon said resolution was declared duly
passed and adopted, signed by the Mayor and his signature attested by the
Clerk. See Resolution Book Page Z .

The Village Clerk presented an affidavit of publication of notice in the
official village newspaper of public hearing to be held at this time and
place-pecar�ng the„re-"pnir-. of a parcel of land described in said affidavit

ordered placed on file.
The Mayor announced that this was the time and place for the public hearing
above referred to. All person present who desired to do so were afforded
an opportunity to express their views thereon.
There were no objectors.
Proponent:
Mr. Wagner of Mr. Wagner, counsel for Mr.
Wagner and Bailey, Schaper, stated that plans and
Attorney's at Law specifica tions were not ready
at this time.
Discussion followed regarding the Council*s policy, that land should not
be re -zoned without definite plans and specifications.
The Mayor then closed the hearing.
MOVED by Stark seconded by Bies carried to give a first reading to an
ordinance entitled, "AN ORDINANCE AMENDING THE ZONING CODE". Member Rahn
voted "NO" on the above motion.
MOVED by Stark seconded by Bies carried to approve the above ordinance
herein quoted by title on its first reading. The Council advised the
proponents that the second reading of the above ordinance would not be held
until plans and specifications are presented. Member Rahn voted "NO" on the
above motion.
Public Hearing - Institutional Zoning:
The Village Clerk presented an affidavit of publication of notice in the
official Village newspaper of public hearing to be held at this time and
place regarding the re -zoning of certain lands described in said affidavit
from Open Development or Residential to Institutional. Said affidavit was
examined, approved and ordered placed on file.
The Mayor announced that this was the time and place for the public hearing
above referred to. All persons present who desired to do so were afforded
an opportunity to express their views thereon. No one appeared either on
behalf of or against said proposal.
r Mr. M.K. Patterson, Chairman of the Zoning Committee of the Planning Com-
mission, read a prepared statement from the Commission regarding said
zoning. Said report was ordered placed on file in the office of the Village
Clerk.
J' MOVED by Rahn seconded by Stark carried to give a first reading to an
ordinance entitled, "AN ORDINANCE AMENDING THE ZONING CODE".
MOVED by Rahn seconded by Teresi carried to approve the above ordinance
herein quoted by title on its first reading.
The Council advised Mr. Patterson that the second reading would not be
held until certain districts were deleted from the published advertisement.
Property Acquisition — Mr. Holzapfel:
The Council discussed with Mr. Holzapfel and Dr. Holzapfel the acquisition
of Lot 31, Auditor's Sub—division 360. No action was taken.
First Church of the Brethren_,Buildi Permit:
Rev. Earl Snader appeared on behalf of the Church of the Brethren and
stated that he had no plans or specifications at the present time but had
made a down payment on the property located at the intersection of Medicine
Lake Road and Winnetka Avenue North and would like to know whether the
Council would issue a building permit.
The Mayor instructed that the matter be tabled until the meeting of April
17, 1956 and requested the Church present schematic studies regarding land
occupancy.
Northern Home and -Lumber Co. Rest for commercial building Permits
The Village Administrator presented the plot, and plans and specifications
for the construction of a structure to be erected at approximately Wayzata
Boulevard and Colorado Avenue.
MOVED by Rahn seconded by Stark carried to accept the plans and specifications
as submitted and approved by the Engineer and to instruct the Building
Inspector to issue a permit submect to the payment of the proper fees.

The Village Administrator presented plans and specifications for the con—
struction of a colonial type office building to be erected at 5000 Wayzata
Boulevard.
MOVED by Rahn seconded by Bies carried to accept the plans and specifications
as submitted and approved by the Engineer and to instruct the Building
Inspector to issue a permit subject to the payment of the proper fees.

Mr. Stein petitioned the Council for a building permit to construct
doublebungalows at approximately 1500 Xerxes Avenue North.

MOVED by Bies seconded by Stark carried that the Building Inspector be
instructed to issue a building permit for the construction of double
bungalows to be located at approximately 1500 Xerxes Avenue North per
plans and specifications inspected by this Council and on file in the
office of the Building Inspector.
Building Permits Lots 8 and 9 Block 3 arol Hills:
Mr, Earl Maxwell, representing Mr. Lee Williams, owner of the partially
constructed homes on the above lots, stated that building permits numbered
3568 and 3588 had been issued, but that a "stop order" had been placed on
the homes due to a difference of opinions as to the location of the front lot
line. The Council agreed to lift stop order on building permit No. 3568
but took no action on the stop order placed against building permit number
3588.
Deitrich Plat Preliminary Approval;
Mr. E.E. Deitrich presented the preliminary plat of his addition located
east of T. H. 100, north of Thotlandts Twin View Terrace Addition. The
Administrator stated that preliminary approval had been granted by the
Planning Commission.
MOVED by Teresi seconded by Stark carried that said plat be given preliminary
approval.
H.B. Garnes.—Re: Traffic and Planning:
Mr. Garnes, 6168 Knoll Street urged that Village roads be intregrated into
State and Federal Highway programs.
The Village Administrator invited Mr. Garnes to speak to the Village Planning
Commission.
Re ort of Attorney re; collective bar ainin for municia a1 em to ees:
The Council discussed the above matter at length. The Attorney stated that
a municipality does not have to bargain with employees but the Council must
appoint a member to an arbitration board, upon proper request. Reference was'
made to the Attorneyts letter of March 29, 1956.
Mr. Larkin McLellan, union representative, stated that he prefered to deal
with the Village Council instead of an arbitration board, and further stated
that municiapal employees have a right to organization and therefore a right
to bargain.
The Attorney was instructed to report on April 9, 1956 as to whether the
Council must pay the costs of the arbitration panel.

Report of Attorney: Jersey Avenue South:
The Attorney presented the engineer*s report and plans showing two proposed
routes for Jersey Avenue South. Said plans were ordered placed on file in
the office of the Village Clerk. The Village Engineer stated that he believed
both proposals would be acceptable to the contractor, but that the first
proposal was most feasible for the Village.
Discussion on the matter was deferred to the meeting of April 17, 1956.
Church of the Good She herd Buildin Permit:
The Village Engineer presented plat and plans and specifications for said
church and school to be erected on Jersey Avenue south of Glenwood Avenue.
MOVED by Bies seconded by Stark carried to grant the Church of the Good
Shepherd a permit for a school and church per plans and specifications
inspected by this Council at this meeting and on file in the office of the
Building Inspector, subject to the payment of the proper fees.
Stanley Lodahl re: basement beautl shop at 2900 North Lilac Drive:
The Village Administrator read a letter of application for a basement
beuaty shop submitted by Mr. Stanely Lodahl.
MOVED by Rahn seconded by Bies carried that the application be denied on
the grounds that such use required Commercial zoning.
Member Stark voted "NO" on the above motion.

Insurance Report of Mr. Owens: (See minutes of March 6, 1956.)
The Administrator stated that he had studied the policies and had consulted
several insurance agents, and that no company would give the same coverage
at a lesser premium.
MOVED by Stark seconded by Bies carried that existing policies be re-newed.
Tax Forfeited lands, Report of Park Board:
The Village Administrator stated that the Park Board did not recommend the
adquisition of any of the lands under consideration for park purposes.
The Village Engineer recommended that Lot 13, Block 1, Winnetka Addition,
be acquired by the Village for drainage purposes.
Member Bies thereupon introduced the following resolution and MOVED its
adoption "RESOLUTION TO MAKE APPLICATION FOR CONVEYANCE OF CERTAIN TAX FOR-
FEITED LANDS", authorized Village Officials were derected to sign applications
for lands known as Lot 13, Block 1, Winnetka Addition on list designated as
Classification List 403-0, February 14, 1956.
The motion for the adoption of the foregoing resolution was duly seconded
by Member Stark and upon being taken thereon, the following voted in favor
thereof: Bies, Nadasdy, Rahn, Stark, and Teresi, and the following voted
against the same: None, whereupon said resolution was declared duly passed
and adopted, signed by the Mayor and his signature attested by the Clerk.

Appointments: Water Commission Planning Commission:
The Mayor recommended the appointment of Mr. Gordon Acker to the Golden
Valley Water Commission for a term of three years, to hold office during
good behavior. MOVED by Bies seconded by Stark, carried that the above
appointment be confirmed.
The Mayor recommended the appointment of Mr. Clarence Tolg to the Planning
Commission for the unexpired term of Mr. Dale Morton , to hold office
during good behavior. MOVED by Rahn seconded by Teresi carried that the
above appointment be confirmed.
MOVED by Bies seconded by Stark that Mr. Walter Kost be re -appointed to
the Planning Commission for the unexpired term of Mr. Don Palmer. Upon
roll call vote being taken thereon the following voted as follows:

Heating Ordinance re: licensing and Inspection:
The Council instructed the Attorney to draft an ordinance for presentation to
the Council on April 17, per the recommendations contained in Mr. Owen*s
letter of March 29, 1956.
Civil Defense Ordinance Second Reading:
MOVED by Bies seconded by Teresi carried to give a second reading to and
ordinance entitled, "AN ORDINANCE AMENDING THE VILLAGE CODE".
MOVED by Bies seconded by Teresi carried to approve the above ordinance
herein quoted by title on its second reading and order publication. See

Amendment to Building _Code fee:
The Village Administrator advised the Council that fees should be amended
to include structures other than buildings such as foundations, water
towers, and grandstands.
The Council instructed the Village Attorney to draft an amendment to the
Building Code embodying the suggestions of the Administrator relating.
to fees for approval and publication.
Residental construction in heavy use district:
Mr. M.h.. Patterson presented the Commissions report on residental con—
struction in heavy use districts:
The Council instructed the Attorney to draft an ordinance restricting the
use of lands zoned to a heavy use to the uses included & listed in the
Village Code, and those uses only.
Fire De artment re: Tank Truck:
Fire Chief Thotland stated that the fire department needs a new tank truck
with a 1,000 to 1,500 gallon capacity. The Village Engineer stated that
the street department would make a great deal of use of the old water
tank truck in 1956, if the truck was available.
The Council instructed Mr. Thotland to proceed in exploratory work and to
present definite prices and specifications to the Council.
Street Department needs for additional trucks:

Village Engineer advised the Council that renting of trucks is costly and
unsatisfactory when unexpected emergencies arise, that the department*s
two four-wheel drive trucks are used primarily for snow plowing and are
unsatisfactory for general street maintenance.
The Council instructed the Engineer to proceed in exploratory work and
present the Council at the next meeting with all anticipated trade-in values
and purchase prices.
Additional road men - full time:
The Engineer requested that the Council consider the employment of
additional full-time road department employees.
