VILLAGE COUNCIL
April 17, 1956
Pursuant to due call and notice thereof a regular meeting of the Village
Council of the Village of Golden Valley, Hennepin County, Minnesota, was held
in the Village Hall in said Village on April 17, 1956, at 7:30 o*clock P. M.
The following members were present: Bies, Nadasdy, Rahn, Stark, and Teresi;
and the following members were absent: None. The Mayor called the meeting
to order at 7:40 o'clock P. M.
MOVED by Rahn seconded by Teresi carried that the reading of the minutes
of the meeting held on April 3, 1956, be dispensed with and that said minutes
be approved as submitted to each member of this Council prior to this meeting,
and so corrected at this meeting, unless some member of the audinece wishes them
read. (The minutes were not read.)
Civil Defense Amendment: Mrs. Flygare:
Mrs. Flygare discussed the importance of women's role in Civil Defense,
particularly welfare, and the importance of the training program now being
conducted for female members.
Mrs._ Flygare requested that the Council "shelve" the enforecement of the recent
amendment to the Civil Defense Ordinance until the women*s Civil Defense
training is completed.
No action was taken.
Bids: Pului M;xer:,
The Village Clerk and Administrator presented an affidavit of publication of
notice of call for bids for purchase of a pulvi mixer according to specifications
approved by this Council on March 6, 1956, said affidavit was examined, approved
and ordered placed on file in the office of the Village Cleric.
The Mayor announced that this was the time and place for opening and consider—
ation of sealed bids for the purchase of said pulvi mixer in accordance with
the notice of advertisement for bids published by the Clerk and heretofore pre—
sented to this Council.
The Village Clerk presented to the.Council two sealed bids submitted in the
course of said notice. Said bids were then opened, publicly read, and
considered. Said bids were found to be as follows:

The Council turned the bids over to the Village Engineer for study, tabulation,
and recommendation, who reported the bids to be in order, and recommended the
purchase of the two—type equipment.
MOVED by Rahn seconded by Teresi carried to accept the bid of Borchert—In—
gersol for a tow—type pulvi mixer in the sum of $51810.00 with terms of pay—
ment as stipulated.
Church of the Brethern: (See minutes of April 3, 1956)
Rev. Shader,;pastor, of the Church of the Brethern was present. The Village
Administrator presented a drawing and correspondence requesting permission to
use the land adjacent to the cemetery at the corner of Medicine Lake Road and
W innetka Avenue for the construction of a church.
The Council agreed to the use of said property for church purposes provided
the plans for the church, and all related matters, meet Village requirements, and
further provided the proponents of the church fully investigate the possibility
of a modified cloverleaf traffic exchange intersection with county and village
officials, and deed all necessary right of way for such exchange to the village
free of charge.

Mr. Schaper and Mr, Donald Bailey, Attorney, requested the second reading of
said rezoning ordinance.
MOVED by Stark seconded by Teresi carried to give a second reading to an
ordinance entitled, "AN ORDINANCE A C-NDI'NG T4 -E ZONING CODES".
MOVED by Stark seconded by Teresi carried to approve the above ordinance quoted
by title on its second reading but that publication be withheld until such
time as Mr. William Sch<per deeds the street right of way traversing his
property from Olson Memorial Highway to the railroad tracks. See Ordinance
Book Page .
Re: Buildina Permit No. 3588 Lot 8 Block 3 =01 Hills;
Mr. Maxwell, representative for the owner and builder of said residence basement
presented his brief defining easements. It was Mr. Maxwell's contention that
lot lines are unaffected by road easements, and that Mr. Nylen is within his
rights under the general law of easements.
The Mayor instructed the Village Attorney to research the question of road
easements affecting property lot lines as related to construction of building,
and further to investigate past negotiations for road easements made between the
Minnesota State Highway Department and the then owners of Lots 8 and 9. Block
3, Tyrol Hills Addition.
Dawn Acres, Street Bond.
Mr. Norman Rooney, representing Grandview Land Development Construction
Company, presented a resolution dealing with certain imporvements in said
addition without levying special assessments, as required by the PHA and
VA.
Member Stark thereupon introduced the following resolution and MOVED its
adoption: "RESOL'UTI6N REGARDING IMPROVEMENTS IN DAd1N ACRES ADDITI(21."
Upon voted being taken on the above the following voted in'favor thereof:
Bies, Nadasdy, Rahj,Stark and Teresi and the following voted against the same:
None; whereupon said resolution was declared duly passed and adopted, signed

Jersey Avenue, Right—of—way:
Mr. McNamara, representative for the Church of the Good Sheperd requested
definite action regarding the location of Jersey Avenue extended.
Condemnation proceedings were then discussed. Upon question by member Stark
as to who pays the cost of condemnation, the Village Attorney stated that all
benefited property owners would be assessed such costs. (See planning commission
committee report dated October 12, 1955).
The Village Engineer recommended that Jersey Avente south of its present terminus
be located as follows: A strip of land 60 feet in width; the centerline of
said 60 foot strip being a line drawn from a point in the north line of the
N, E, 1 of Section 5, Township 117, Range 21, said point being 42,72 feet west
of thy. N.E. corner of the west 21.35 acres of the N.W.4 of the N..4 Section 5,
Township 117, Range 219 and coincidental with the existing centerline of
Jersey Avenue on the north, and a point on the south line of the N.W.4 of the
N,E.4, said point being'42,72 feet east of the S.E. corner of the West 21.35
Acres of the N.W.4 of the N.E.4 of Section 5, Township 117, Range 21.
The Mayor instructed Mr. McNamara to notify Mr. Rang of the Ring Construction
Company that his presence is requested at the next regular meeting for presen-
tation of his views on the Laurel Avenue extended matter.
Annointment. Planning Commission:
MOVED by Rahn seconded by Teresi carried that Mr. Ed Jordon be appointed to
the unexpired term of Mr. Donald Palmer.
Institutional Zoning, Second Reading: (See minutes of April 3, 1956). V
MOVED by Rahn seconded by Teresi carried to give a second reading to an
ordinance entitled, "AN ORDINANCE AMENDING THE ZONING CODE".

herein quoted by title on its second reading and to order publication. See
Ordinance Book Page.
Mr. Patterson, Chairman , Zoning Committee of the Planning Commission, and the
Village Attorney agreed another amendment to the above entitled ordinance should
be drafted transferring sections 3.15, 3.16, 3.17, and 3.20 of the zoning
code into above ordinance,

Heating -Ordinance, First Reading: (See minutes of April 3, 1956).
MOVED by Teresi seconded by Rahn carried to give a first reading to an
ordinance entitled, "AN ORDINANCE Atv1ENDING .THE HEATING ORDINANCE BY
ESTABLISHING LICENSE AND PE -11111T FEES."
MOVED by Teresi seconded by Bies carried to approve the above ordinance herein
quoted by title on its first reading.
MOVED by Texesi seconded by Bies carried to appoint Donald Spaulding Heating
Inspector,;his term .of office to continue to December 31, 1956.
Amendment to Building Code Fees, First Reading;
MOVED by Teresi seconded by Bies carried to give a first reading to an
ordinance entitled, "AN ORDINANCE AbIENDING THE VILLAGE CODE."
AIMED by Bies seconded by Teresi carried to approve the above ordinance quoted
by title on its first reading.
Ordinance Limiting Residential Construction in Heavy Use District:
ROVED by Teresi seconded by Stark carried to instruct the Clerk to insert
a notice of public hearing_ in the official newspaper on the above proposed
ordinance said public hearing to be held on June 19, 1956.
Ordinance defining front lot lines:
MOVED by Stark seconded by Bies carried to give a first reading to an ordinance
entitled, "AN ORDINANCE AMENDING THE VILLAGE CODE,"
MOVED by Bies seconded by Stark carried to approve the above ordinance quoted
by title on its first reading.
Well Ordinance, Discussion;
Mr. Owens distributed copies of a latter dated April 13, 1956, fron J. W. Baker,
4601 Sunset Ridge, N rth Tyrol Hills, outlining hisexpensive experiences with
well water in his neighborhood.
Air. Owens informed the members that a similar situation is now existant in
Spring Green Addition and presented a sufficient petition from Cloverleaf
Terrace Addition for municipal water service.
The Village Engineer recommended an overall survey be made of present and future
water needs of the Village. The Village Administrator stated that the G. M.
Orr Engineering Company had made a survey of such needs, and had presented the
village a map showing proposed mains and header mains and header mains at the
time the General Motors Training Center watermai.n was constructed.
The Council instructed that Air. Baker be furnished a petition for signatures
of interested home owners,

Loss of Certified Check:
The Administrator stated that the platters of Skelly*s Addition had deposited
a certified check in the sum of $1,000.00 in lieu of a bond guaranteeing the
construction of roads and compliance with other platting requirements, and that
said check had been lost or mislaid.
MOVED by Rahn seconded by Teresi carried to authorize and instruct the proper
Village officials to execute a document dealing with the loss of said check, and
to forward said document to the First National Bank of Minneapolis.
Report of Street Commissioner Bies regardina additional dump trucks:
MOVED by Stark seconded by Teresi carried that the Village Engineer and Member
Bies present a report on May 1, 1956, regarding the need for additional street
maintenance equipment.
Hearing. Street Reconstruction and Resurfacing, Sanitary Sewer L
District No. 1:
The Clerk presented preliminary plans for a street improvement project prepared
by the Engineer for the Village, sand said engineers estimate of the cost of
said improvement as follows: $52,350.00 which plans and estimates were examined
by the Council, approved and ordered placed on file.
Member Rahn introduced and read the following written resolution and MOVED
its adoption: "RESOLUTION PROVIDING FOR PUBLIC TEARING ON PROPOSED STREET
IMPROVEMENT", SAID PUBLIC HEARING TO BE HELD ON June 5, 1956.
The motion of the adoption.of the foregoing resolution was duly seconded
by Member Teresi and upon vote being taken thereon, the following voted in
favor thereof: Bies, Nadasdy, Rahn, Stark, and Teresi; and the following
voted against the same: None, whereupon said resolution was declared duly
passed and adopted, signed by the Mayo and his signature attested by the
Clerk. See Resolution book page „2.6 .
Call of Special Meeting. April 23,,1956:
The Council agreed to call a special meeting April 23, 1956, for the purpose
of studying proposed Fund #20 Improvements.
Agreement, International Paper Company:
MOVED by Rahn seconded by Bies carried that the Village Attorney meet with
and consolidate all misunderstanding between this Village and the International
Paper Company and report back to the Council at the meeting of May 1, 1956.
Northwestern Schools, Tax Status:

Mr. Owens read a letter dated April 12, 1956, from the County Auditor to the
Northwestern Schools notifying said school that the County Board and denied
their application for tax exempt status.

MOVED by Rahn seconded by Teresi carried that the following licenses be

Messrs. Robert Spinarski, 9424 Chicago Avenue South; Mr. 011ie Weinman
524 5th Avenue South, Hopkins, presented preliminary plat and plans for
a bowling alley to be constructed on the N.W. corner of Wayzata Boulevard
and Rhode Island Avenue South,
Mr. Spinarski, Mr. Weinmann and their partner Mr. Albert Donahue, 2329 Georgia
Avenue, St. Louis Park, (not present) stated they would not request an on—sale
liquor or beer license from this or future Councils for a period of ten years.
MOVED by Icahn seconded by Teresi carried that the Red Crown Bowling Alley
present detailed plat, plans and specifications to the Village Administrator
and Engineer for study and recommendations at a future meeting.
Collective -Bargaining for Munici al Em 10 ees:
Mr. McLellan, representative of Local 29, requested a definite decision from
the Council regarding recognition -of the union.
MOVED by Stark seconded by Rahn carried that'the Village Administrator and
Engineer draw up a personnel ordinance for consideration by the Council and
that this Council take no action until such personnel ordinace has been
so presented.
P°Ir. McLellan was invited to confer with Messrs, Owens and Fredrickson- and
slake suggestions for such personnel ordinance,'

The Mayor advised that New Hope Councilmen are anxious to meet with re—
presentative of the Golden Valley Council regarding their village tying in
with Golden: Valley*s proposed Trunk Line No. 3.
Member Bies and Rahn were appointed by the Mayor to meet with representatives of
New Mope.
Police Protection,, Letter from American Motors:
A letter was read dated April 11, 1956, from Mr. D. J. Gillis, Zone Manager,
Nash Motors suggesting the number of patrolmen on the police force be increased.

Mr, Owens, in his reply by letter, pointed out that a five -man police force was
all the Village could afford at present.
Civil Defense Amendment, request for hearing:
A letter dated April 10, 1956, from Mr, E, M. McAllister requesting that
he be heard and express his views as to why the proposed amendment be re-
pealed.
The Mayor appointed Teresi and Bies to meet Mr, McAllister,
Civil Defenses Appointments
Letter Gated Apri1'1O, 1956, from Mr. McAllister notified'the Council that
Mr. Burton S. Waldron was appointed Communications Officer for Civil Defense,
with a rank of Major.
