05-01-56 City Council Minutes1 C REGULAR MEFTTNG of the VILLAGE COUNCIL May 1, 1956 Pursuant to due call and notice thereof a regular meeting of the Village Council of the Village of Golden Valley , Hennepin County, Minnesota, was held at the Village Hall in said Village on May 1, 1956, at 7:30 o'clock P.M. The following members were present: Bies, Rahn, Teresi, and the following arrived after the meeting had begun: Nadasdy, and the following was absent: Member Stark. The Mayor called the meeting to order at 7:35 o'clock P.M. Re: Number of Men on Volunteer Fire Department: The Village Attorney advised the council that the ordinance creating the volunteer Fire Department did not restrict the number of men on the department and therefore the total number of volunteer firemen could be fixed by the Board of Fire Officers unless there exists a prohibition in the by-laws of the association. Re: Purchase of Municipal Equipment via Bond Sales: Y The Village Attorney -stated that he knew of no authorization for villages to .. ...--.�. __-..1. issue bonds for the raising of money for use in the purchase of municipal equipment other than by municipal election. Northwest Trunk Sewer: MOVED by Rahn seconded by Teresi carried that the G.M. Orr Engineering Company be requested to present to this council on June 5, 1956, preliminary report and cost estimates for the construction of the "North Trunk Sewer" both with and with - cut participation by the Village of New Hope, at no cost to the Village of Golden Valley. Mr. Harry Mayeron, representative of the G.M. Orr Engineering Company, stated that his company would provide the above referenced data to the Village of Golden Valley and would in addition furnish all other information necessary for a. public hearing, at no cost to the Village of Golden Valley. Member Rahn introduced the following written resolution and moved its adoption "RESOLUTION RELATTNG TO GAS SERVICE CONNECTIONS: SOUTH TRUNK SES,rJER" The motion for the adoption of the foregoing resolution was duly seconded by Member Teresi and upon vote being taken thereon the following members voted in favor thereof: Bies, Nadasdy, Rahn and Teresi: and the following voted against the same: alone: whereupon said resolution eras declared duly passed and adopted, signed by the•Mayor, snd his signature attested by the clerk. Sanitary Sewer Lateral Improvam- ea.t ;'l: Release of money withheld from con- rac or: MOVED by Rahn seconded by Teresi carried that the Village Council release and order payment of the stun of $20,000.00 to the sanitary sewer lateral improve- ment #1 contractors (Barbarossa & Nodland) upon the recommendation of the G.M. Orr Engineering Company and the Village Attorney, per letters on file. M,07'D by Teresi_ seconded by Rahn carried to accept the guarn _shee bond of Barbarossa & Sons Inc. & Nodland Construction Company Inc. in the sum of X18,398.00, said bond running to the Twin City Fxcavating Company Inc. T-TOVED by Teresi seconded by Rahn carried to accept the "House Service" bond of Barbarossa and Sons Inc. & Nodland Construction Company Inc. in the amount of $10,000.00. MOVED b, Teresi seconded by Rahn carried to accept the bond of Barbarossa and Sons Inc. & Nodland Construction Company Inc. for the construction of the South Trunk Sewer Improvement Project. rmendment to Heating Ordinance -fit Reading: MOVED by Teresi seconded by Rahn carried to give a second reading to an ordinance entitled "AN ORDINANCE AMENDTNG TFHEATING ORDINANCE BY ESTABLISHING LIC7,VSE AND PERMIT FEES." MOVED by Rahn seconded by Teresi carried to approve the above ordinance herein quoted by title on its second reading and to order publication thereof. See ordinance book page Amendment to Building Code, Second Reading: MOV.FD by Teresi seconded by Rahn carried to give a second reading to an ordinance entitled,"ATL ORDII\IATICr A�F1�?DING THE VILLAGI' WDF." Ordinance Defining Front Lot Lines: Action on this matter was deferred to the meeting og May 15, 1956. First Reading Ordinance Amending Administrative Section Of Village Code: A6tion deferred to the meeting of May 15, 1956 Physical Examinations for Volunteer Firemen: The Attorney reported that he has not ,yet received the opinion of the Attorney General. Agreement with International Paper Company: Action deferred to the meeting of May 15, 1956. Re: Moving of "Albrecth Farm House into Belmont Addition: Member Bies requested the council consider said matter at this meeting. The Mayor requested unaminous consent from all members of the council for the addi.t.ion of said matter to this council meeting agenda. Said concent was granted. The Administrator f or the Village advised the Council and the public that Mr. Rr Mrs. Albrecht had sold their farm home to an unnamed party and no longer had intcntion whatsoever of moving their farm home into Belmont Addition. 1 M74 Progress Report of Attorney Re: Easements: Jersey Avenue South: The Council instructed the attorney, after the attorney's report that the attorney arrange for a conference between Mr. Douglas Rees and Mr. S.M. McNamara. East Half Yale Garden Homes: The attorney reported said rights-of-way were under study for the condemnation proceedings. West Half Yale Garden Homes: The administrator for the Village stated that efforts should be made to expedite the aquisition of 33rd Avenue extended in a westerly direction from Regent Avenue for inclusion in 1956 improvements. The Village Engineer stated that he had discussed this matter with the owners of the property and that they were all willing to transfer the necessary street right- of-ways to the village at the earliest possible time. The council instructed the attorney to secure such right-of-way easements at once. South Trunk Sewer Easements: The attorney reported very substantial progress in the acquisition of south trunk sewer easements. Re: Buildinp, Permit #3588, Lots 8 &, 9- Block 7, . (See minutes of Mr. Donald W. Barr, 1421 Brenner Pass, representing the South Tyrol Hills Association, presented a petition signed by 36 property owners, said petition requesting council 't..... emply the full extent of its pmTer in aiding us to maintain the standards of the neighborhood .....'t Mr. Barr presented a letter from Mr. Marshall G. Jacobson, owner of lots 5 6, Block 3, Tyrol Hills, said letter requesting the Tyrol Bills Association take action regarding the set- back of the home under construction on Lots 8:& 9, Block 3, Tyrol Hills Addition. Mr. Milton Nickey, owner of lot 11, advised the Council that he wished this matter resolved at the earliest possible timein order so that he can proceed with building plans for the lot which he owns. Mr. Earl Maxwell, attorney for the owner and builder, advised the council that he recognized the error of his client and offered on behalf of his client to cause the basement structure to be moved 5 to 8 feet farther south. MOVED by Bies seconded by Rahn carried to adjourn consideration of this matter to 4117 Wayzata Boulevard at 8:00 o'clock A.M. May 21 19562 it being agreed that all interested parties, including the entire council, will meet at said time and place for the purpose of settling said matter; it being further provided that all action taken by the Council at said meeting shall be entered and recorded in these minutes as though actually occuring in the council chambers. (Council met with owners of property at the time and ;dace above set forth and agreed as follows:) MOVED by Rahn seconded by Bies carried to move the existing front wall of the basement structure located on lot P & 9, Block 3, Tyrol Hills Addition, Street address 4117 Wayzata Boulevard southerly a distance of approximately 9 feet. Mr. Nylon, Mr. Maxwell, and Mr. Williams were present and agreed to the above. Collective Bargaining for Municipal Employees: The Village Administrator advised the council that he had been served with a court writ ordering the council to show cause why writ of Mandamus should not be issued to cause the council to excerise its discretion in the appointment of the municipal representative to the adjustment panel provided for by state law. Council referred the matter to the Village Attorney for study and recommendation at the earliest possible time. Request for Commercial Building Permit: Northern Homes Inc., 6200 Wayzata Boulevard: MOVED by Bies seconded by Rahn carried to instruct the building inspector to issue a building permit for the construction of the business use building per plans and specificiations inspected by this council and on file in the office of the building inspector, provided, however, the sheet metal sides of the structure are painted a non -contrasting color within one year. Request for Commercial Building Permit Leaf Construction Company: Mr. Ray Bergeson, representative of the Leaf Construction Company, stated that his clients would deed 30 feet from the northern part of their property for Laurel Avenue extended and requested the issuance of a building permit for a commercial building per plans on file in office of building inspector. MOV,D by Rahn seconded by Teresi carried that the matter be tabled for study. Area to be Assess -d; Lowry Avenue'Storm Sewer: Mr. & Mrs. Bert Putnam were present. The engineer for the Village presented a plat map depicting thereon the entire water shed area and the area proposed to be assessed at a higher rate, said rate arbitrarily set, for purposes of discussion, at $1.00 and $.50 with a uniform rate of $.67 per foot over the entire drainage area. MOVED by Bies seconded by Rahn carried that the matter of the assessments be referred to the Committee of the Whole for study and recommendation at a meeting, the time and place for which is yet to be decided. Report of Member Bies & Engineer Re: Purchase of Dump Truck: MOVED by Teresi seconded by Rahn carried that the Village Clerk be instructed to insert notice of advertisement for call for bids in the official village newspaper for the furnishing of three dump trucks per specifications hereto- fore approved by this council, said bids to be taken on June 5, 1956. Purchase of Bituminous Materials for 1956 Street Improvements: MOVED by Teresi seconded by Rahn carried that the Village Clerk be. instructed to insert notice of advertisement of call for bids in the official village newspaper for the purchase of Bituminous Material for 1956 Street Improvements per specification heretofore approved by this council, said bids to be taken on June 19, 1956. Building Permits for Residences in Open Development Areas: Messrs Varner, and Elson were present. The Administrator advised the council that Council policy required the council to issue or approve all permits for the construction of residences in open Development areas. The matter was deferred to the meeting of May 15, 1956, with the request that council give additional consideration to the policy set forth above. Dog Control Contract with Merry Hills Kennel: 140VFD by Teresi seconded by Bies carried to extend the existing contract with Merry Hills Kennels for an additional six weeks period from I"'ay 7th through June 18th, 1956. Plat of Dawn Acres Second Addition Final Approval: MOVED by Rahn seconded by Bies carried to accept the plat of Dawn Acres Second Addition subject to submission of completion and maintainence bond and to order advertisement of public hearing to rezone said plat to Residential Use on June 4, 1956, and to authorize the proper village officials to affix their signatures thereto. Platting Policy re: Installation of Sanitary Sewer Services: MOVED by Rahn seconded by Teresi carried to require all platters to submit necessary money for the installation of sanitary sewer service to the property platted-. The council after further discussion agreed that where platter could not put up the necessary money the council required the platter to submit a sufficient petition for the installation of sanitary sewer lateral services where such services are available by reason of the construction of trunk sewers, the cost of said municipal services to be paid for via special assessments levied against the benefited property. Sanitary Sewers Mary Hills and Dawn Acres II Additions: MOVHD by Rahn seconded by Teresi carried that the G.M. Orr Engineering Company make a preliminary report and cost estimate for the installation of Sanitary Sewer Laterals in Mary Hills and Dawn Acres Second Additions. Mr. Harry Mayeron, representative of said engineering company, was present and stated that the company would perform said work. The administrator pointed out that the installation of sanitary sewers in said additions would be a part of Fund #20 1956 Public Improvement. MOVED by Bies seconded by Rahn carried to authorize the Plumbing Inspector to permit temporary sanitary sewer systems in Dawn Acres Second Addition and Mary Hills Addition. The motion for the adoption of the foregoing resolution was duly seconded by Member Teresi and upon vote being taken thereon the following voted in favor thereof: Bies, Nadasdy, Rahn & Teresi: and the following voted aga inst the same: None, whereupon said resolution was declared duly passed and adoptedJa� approved s �ved and 'd by the Mayor and attested by the Clerk. � mac'3 Sewer Lateral Construction in 1956 in South Trunk Sewer District: The Council decided that sewer laterals would not be constructed in the south trunk sewer district for the following reasons: 1. Even if the Council were to decide to go ahead with such sewer lateral construction at this time it is doubtful that all hearings and lettings could be completed before the winter freeze-up and that even if such could be completed before the freeze-up there could not be any house service until the spring thaw in March or April of 1957. 2. It is very doubtful that contractor:; will bid on any more work this year at a fair price inasmuch as all contractors in the Twin Cities area have $1,000,000.00 or more dollars of work for the remainder of 1956. 3. It is very ioubtf ul that the necessary bonds can be sold in 1956 at a reaGr_nable rate of interest inasmuch as the bond market is presently glutted with municipal bonds from this section of the United States. Proposed Date for Public Hearing .Fund #2D, 1956, Public Improvements: Council tentatively set the date for the public hearing for the construction of said i provements as June 4, 1956. Hardship Waiver Lot 3, 4, Block 13, Winnetka Addition, Golden Valley: MOVED by Rahn seconded by Bies carried to reduce the side -lot clearance on the south side of said lots :from 15 to 9 feet per recommendation of the planning Commission.
