05-15-56 City Council Minutes114 REGLn.^�' n,�?:TING or the VILLAGE COUNCIL May 15, 1956 Pursuant to due call and notice thereof a regular meeting of the Village Council of the Village of Golden Valley, Hennepin County, Minnesota, was held at the Village Hall in said Village on May 15, 1956, at 7:30 0*clock P.M. The following members were present: Bics, Rahn, Stark, Teresi, the following was absent: Me%ber Nadasdy. Acting Mayor Bies called the meet- ing to order at 7:30 o*clock P.M. MOVED by Rahn seconded by Stark carried that the reading of the minutes of the meeting held on May 1, 1956, be dispensed with and that said minutes be approved as submitted to each member of this council prior to this meet- ing, unless some member of the audience wishes to have them read. (The min- utes were not read). Residential Building; Permit-G.V. Thomson: MOVED by Rahn seconded by Stark carried to instruct the building inspect- or to issue a permit to Nir. G.V. Thomson at 4400 Golden Valley Road for a residence to be constructed in an open development district per plat and glans on file in the office of the building inspector and inspected by this Council at this meeting. MOVED by Zahn seconded by Stark carried that the administrator be instructed to tabulate all permits issued, as well as plats approved, and that public hearings on the zoning to residential use of the areas occupied by residen- ces, and/or plats be held at the expiration of every six month period. Request for Building Permit -St. Margaret %iary•s Convent: MOVED by Rahn seconded by Teresi carried to instruct the building inspect- or to issue a permit for the construction of a convent at 2301 Zenith Ave. North per plat and plan on file in the office of the building inspector and inspected by this Council at this meeting. Commercial Building -Permit Northern Homes: MOVED by Rahn seconded by Stark carried to instruct the building inspect- or, upon statement by the Village Engineer that said plans meet or =ceed- ed Village requirements to issue a commercial building permit to the Red Crown Bowling Alley for a building to be located at approximately 7600 Wayzata Boulevard, provided however, that the proponents of the bowling alley named Robert J. Spinarski, Albert Donahue, and 011ie W ienmann sign an agree- ment to the effect that they will not apply for or esrpect to be granted any licenses for either the on or off -sale of non -intoxicating malt beverages or intoxicating liquors in connection with said premises, and further pro- vided that the above proponents will deed the Village of Golden Valley a 30 foot right-of-way for the eastern half of Rhode Island Avenue South. 11 1 Said persons were present accompanied by their attorney, and in the presence of the Council all of the above mentioned persons signed the agreement above referred to and stated that they would provide said deed to the Village of Golden Valley at no cost in the next 10 days. LRee uest for BuildinZ Permit -Golden Val -ley Lutheran Church Pars Mr. Noland Koch, Pastor of said church, presented the plans for a residence to be located at approximately 100 Turner's Cross Road South, in an Open Development Area. MOVED by Tcresi seconded by Rahn carried to instruct the building inspec- tor to issue a building permit for the above referenced building per plat, plans, and survey, as inspected by this Council at this meeting atd`:on file:in`the office of the Building Inspector, provided however, that the existing building shown on the survey be razed upon the occupancy of the building for which said permit is being issued. Fund #20. 1956 Public Improvements: (See 14inutes of T�4ay 9, 1956) The Village Clerk presented preliminary plans and cost estimates for the construction of Sanitary Sewer Laterals in Dawn Acres Second Addition and Mary Hills Addition plus that portion of the parcel of land =7420 which abutts on Mary Hills Drive, as prepared by the Engineer for the Village, and said Engineer's estimate of the cost of the improvements as follows: Sanitary Sewer Laterals $45,500.00 The Village Clerk presented preliminary plans for street, grading and graveling, storm sewer and drainage, and other improvements as listed below, prepared by the Engineer for the Village, and said engineer's estimate of the cost of the improvements as follows: Western Avenue Extended: (to service General Mills property) $12,000.00 Dawn Acres First and Second Additions -Storm sewer J rse Avenue -Grading and graveling/ Cloverleaf Terrace -Storm sewer, curb and gutter, bituminous stabilized base Graceful Addition -Curb and gutter, bituminous stabilized base. Member Rahn thereupon introduced the following resolution and MOVED its adoption: "RESOLUTIDN PROVIDING FOR PUBLIC HEARING ON CERTAIN PUBLIC IM- PROVEAiENTS", The foregoing motion was duly seconded by Member.Teresi and upon vote being taken thereon the following voted in favor thereof: Bies, Rahn, Stark, and Teresi and the following voted against the same: None, where upon said Resolution was declared duly passed and adopted, signed by the Mayor and his signature attestedby the Clerk. MOVED by Stark seconded by Teresi carried that the location of the drive- way for 4601 Golden Valley Road be approved as it presently e>ists, but that the driveway be brought to a uniform grade consistent with that of the manholes lyi.r_g within the driveway, and that the village replace the black- top on the driveway with a blacktop mix no raider than 15 feet at a cost not to exceed $500.00 The Council instructed the Village Administrator, the Village Engineer, and Mr. Harry Mayerson of G.M. Orr Engineering Company to meet with Mr. Henry Nodland for the purpose of discussing and reaching an agreement with Mr. George Hanson regarding any further work which may need to be done upon the property. Bids Fire Department Tank Truck: The Village Clerk presented an affidavit of publication of notice of call for bids for the truck chasis and tank according to specifications approv- ed by this Council on April 21;, 1956. Said affidavit was approved and ord- ered placed on file in the office of the Village Clerk, The Mayor announced that this was the time and place for opening and consideration of sealed bids for said purchase in accordance with notice of advertisement he hereto- fore presented to this council. The Clerk 'resented two sealed bids submitted in the course of said notice. Motorized Fire 1 Tank $1,250.00 Truck Company MOVED by Stark seconded by Rahn carried to accept the bid of the North Star Garage for the furnishing of the truck Chasis at a cost not to exceed $1,155.00 MOVED by Stark seconded by Rahn carried to accept the bid of the Minne- sota Motorized Fire Truck Company for the sum of $1,250.00 for the fur- nishing of one tank for mounting on the above mentioned truck Chasis. Member Rahn agreed to negotiate terms of sale of the above items to the best possible advantage of the Village. Residential Building Permit -Open Development District: MOVED by Rahn seconded by Teresi carried to instruct the building inspect- or to issue a building permit to Mr. Russell 0. Hagen, Approximately 1900 Indiana Avenue North per plat and plans inspected by this Council at this meeting and on file in the office of the building inspector. Residential Building- Permits: MOVED by Bies seconded by Stark carried to ratify the action of the build- ing inspector in granting permits to Mr. William Varnor Junior at 4849 Jersey Avenue, and in granting building permit number 3713 to Mr. Elson at 7000 Olson Memorial Highway, for the construction of residences in the open development district, per plat and plans on file in the office of the building inspection and inspected by this council. R nest of re -zoning -Lutheran Bible Institute: MOV''D by Stark seconded by Teresi carried to instruct the Village Clerk to insert notice of public hearing in the official newspaper on the rezoning of certain properties for Open Development to Institutional District, said public hearing to be held on June 5, 1956, the property under consideration being known as the "Jensen Farm". Re-routing of Plymouth Avenue: MOVED by Teresi seconded by Stark carried to accept the deed from the Gen- eral Mills Corporation of the presently traveled route of Plymouth Avenue and to deed to the General Mills Corporation these portions of dedicated right-of-way of Plymouth Avenue which are not used at this time, subject to the approval of the Village Attorney, subject to stipulations that no costs be incurred by the Village of Golden Valley. MOVED by Teresi seconded by Stark carried that in consideration of the above transfer, the General Mills Corporation be requested to grant the Village of Golden Valley a slope easement along the northern edge of the new route of Plymouth Avenue, the depth of the easement to be determined 118 by the'Village Engineer. Water Commission: Re: Federal Financing of Engineering Studies: Mr. Ray Sheehan Jr. urged the Council to take advantage of Federal loand which would permit engineering studies of future municipal water service for the Village of Golden Valley. Council instructed the Administrator to get all informs.ti.on possible from headquarters of the Housing and Home Finance Agency and to instruct the Administrator and the Engineer to investigate every phase of said Federal Program available through every metropolitan contact available and to report to the Council at the earliest possible time. Hardshi Waiver -Mrs. Silvia Mielke Lot 1 lo Bk 4_C. Winnetka Addition: MOVED by Rahn seconded by Teresi carried to approve a hardship waiver for said lot per plans and specifications on file in the office of the build- ing inspector subject to the written consent of the neighbor owning Lot 2, Block 4, Winnetka Addition to 5 feet. Hardship Waiver P.ecsuested of Robert Hartman: The administrator advised the Council that the planning commission has app- roved the request of Mr. Hartman. MOVED by Stark seconded by Bies carried to instruct the building inspector to issue a permit to Mr. Hartman for the construction of a home at approximately Sixth Avenue North, said lot being approximately seventy feet in width. Re:P` l Del hian Heights: MOVED by Rahn seconded by Stark carried to accept the replat of Delphian Fleights Addition upon the recommendation of the Village Engineer and the planning Commission, and to authorize the proper village officials to sign the plat, provided bonds are posted as required by the subdivision require- ments of the Village of Golden Valley. Acce tance of Plat: Detrich's Third Addition: MOVED by Teresi seconded by Stark carried to accept the plat of Detrich's Third Addition upon the recommendation of the Village Engineer and the planning Commission subject to the posting of a bond guaranting that all requirements of the subdivision requirements of the Village of Golden Valley will be met by the platter. Deed to Street: Mary Hills Addition: MOt'ED by Rahn seconded by Stark carried to accept the deed of a portion of street in Mary Hills Addition as agreed at the time said addition was fin- ally approved by this council, and to instruct the attorney to file the deed. Plat: Westmore Heights Addition: MOVED by Rahn seconded by Teresi carried to grant final approval to said plat subject to submission thereof a bond subject to the completion of the plat by the developer. Aaker had',resigned for per- conal reasons'_ MOVED by Rahn seconded by Stark to accept Mrs. Aaker's resignation with the deepest appreciation for her long and meritorious seri,ices. Resignation: Mr. John Pond: The Administrator advised the council that NIr. Pond had resigned to accept a position in another governmental agency. MOVED by Rahn seconded by Stark carried to accept Mr. Pond's resignation with regret, to thank him for his services, and to wish him success in his future endeavors. Hardshi Waiver: Lot 17 Jessen's Addition, b13. Nelson: MOVED by Rahn seconded by Teresi carried to grant Lot 17, Jessen's Addition a hardship waiver per the recommendation of the ordinance committee of the planning commission. License: MOVED by Rahn seconded by Stark carried to issue license number 1165 for one pool table in :the sum of $5.00 to the Valley Inn, 4040 Olson_Memorial Highway, per application on file. Assessment Policy -Lover Terrace Storm Sewer: The Council agreed to meet at 11:00 o'clock on Wednesday, May 23, 1956, at the Village Hall for the purpose of discussing the Lowry Terrace assessment policy. Law Suit MinneaiDolis Park Board: MOVED by Atark seconded by Rahn carried to instruct the Village Attorney to defend the interests of the Village of Golden Valley to the fullest possible extent as such interests are set forth in the ordinances under attack. Sanitary Sewers Contract With St. Louis Park: MOVED by Stark seconded by Rahn carried to instruct the administrator to x 120 attempt to negotiate with the City of St. Louis Park for the prepayment to the Village of Golden Valley of all money due to Golden Valley by reasons of the construction of the Tyrol Hills Portion of the South Trunk Sewer. MOVED by Rahn seconded by Stark carried to approve the following bills in the total amount of 35787.50._.._.. MOVED by Rahn seconded by Stark carried that the meeting adjourn.
