05-22-56 Special MeetingSPECIAL MEETING of the VILLAGE COUNCIL May 22, 1956 -Pursuant to.due call and notice thereof a special meeting of the Village Council of the Village of Golden Valley, Hennepin County, Minnesota, was held at the Village IIall in said Village on May 22, 1956, at 7:30 o'clock P.M. The Mayor called the meeting to order at 5:10 o' clock P� M. and mill -- call was taken. The following members were present: Bies, Nadasdy, Rahn, and Teresi: and the following arrived after the meeting had begun: Member Stark. Re: Condemnations for Meadow ?rook High School: Mr. Bruce blcNiel, representative of the architectural firm of Hammel and Green, brought before the Council the problem of land condemnations for the proposed Meadow Brook High School. The problem of street design, loca- tion, construction, and maintenance were discussed; Also discussed was the division of certain property into residential lots. ivioved by Rahn seconded by Teresi carried that the entire matter be referred to the planning commission with the request that the planning commission call a special meeting and report their recommendations to the Council at the June 5, 1956 Council meeting. n , n .c-: East 1 Yale Garden Homes: The Council previously had instructed Attorney Kane to condemn property for 'newer and street easements, however, it was agreed condemnations should be avoided if possible, Mr. Kane was instructed to get definite answers from property owners to determine if condemnation is necessary. Re: Building Permits on low S a a ropert : Mrs. Spake questioned whether or not building permits would be issued for - new lots in Past I Yale Garden Homes. Mr. Fredrickson, Village Engineer, reported that if building requirements are fulfilled and groperty owners adhere to final plat plans building permits will be issued upon proper application. Ret Servi.ceabilit of Ouail between33rdand 34th: Mr. Ralph Willard questioned when (wail would be fired so he could have access to his property. The Village Engineer stated that the Village has been waiting for street ded- ications, therefore the delay. The -Council instructed the Engineer to fix wail so Mr. Willard will be able to get to his property. ' 125 �e: Condemnation Proceedin s: Attorney Kane explained Condemnation proceedings and warned the prople that no one gets rich by having their land condemned, that any costs of condemning land is assessed back, which could very easily be much more than they would receive through condemnation. Mrs. Spake at this time asked if their street easement were acquired by condemnation would they still be assessed for street improvements. Attorney Kane stated that they would pay street assessments if easements were acquired by dedication or condemnation and that if it was acquired by condemnation they would also pay the condemnation costs. Rahn moved. Attorney be instructed to write a letter to the 42 property owners asking them questions bearing on what each owner wants to do re- garding proposed street right of way. Included in motion by Member Stark,was a time element of two weeks for property owners to give their reply to Attorney Kane. Motion was seconded by Bies and carried. Re: -Ado tion of Resolution: Member Rahn introduced the following written resolution,and moved its adoption: RESOLUTION CREATING 1955 IMPROV:&,trNT NO. 19 FUND PROVIDING FOR AND APP ROPRIATING SPECIAL ASSESSMENTS FOR TFTr SUPPORT AND MAINTENANCE, T[ REOF,_ AND DIRECTING ISSUANCE OF IMPROVEMENT BONDS OF 1955. The motion for the adoption of the foregoing resolution was duly seconded by Member Bies and upon vote being taken thereon the following members voted in favor thereof; Bies, Nadasdy, Rahn, Stark and Teresi; The following voted against the same: None: Whereupon the said resolution was declared duly passes and adopted, signed by the Mayor, and his signature attested by the Clerk. Re: Buildin Permit for Leaf Construction Comn - Moved by Stark that a building permit be granted to Leaf Construction Company providing they give thirty foot street easement for Laurel Avenue, and they must landscape premises with trees and shrubs. Roll call vote was taken on above motion. The following members voted in favor of it: Bies, Nadasdy, Stark, and Teresi and the following voted against the same: Member Rahn, Where- upon the Mayor declared said motion carried.
