03-15-60 City Council Minutesm REGULAR MEETING of the VILLAGE COUNCIL March 15, 1960 Pursuant to due call and notice thereof, a regular meeting of the Village Council of the Village of Golden Valley, Hennepin County, Minnesota, was held at 7800 Golden Valley Road in said Village on March 15, 1960, at 7:30 o*clock P. M. The following members were present; Bies, Flannagan, Nadasdy, Scherer, and Teresi; and the following was absent; None. Present were Village Manager & Clerk, Roger K. Ulstad; Village Attorney, Stanley D. Kane; Village Engineer, Donald Sorensen; Building Inspector, Dan Lynch; Deputy Clerk, Helen Penniman; President of the Planning Commission, George Pennock. The Mayor called the meeting to order at 7:40 o•clock P. M. Invocation: Rev. Norman Long, Golden Valley Community Church of the Brethren, 8641 Medicine Lake Road. Minutes of March_l, 1960; MOVED by Teresi seconded by Flannagan carried to approve the minutes of March 1, 1960, as submitted to the Council. Public Hearing -Zoning -Robert Moser 5645 St Croix Avenue, R.L.S. #331: The Village Manager presented an affidavit of publication in the official newspaper of notice of public hearing on said rezoning as described in said affidavit. Said affidavit was examined, approved and ordered placed on file in the Clerk*s office. The Mayor announced that this was the time and place for the Public Hearing above referred to and all persons who desired to do so were afforded an opportunity to express their views thereon, and all written objections heretofore filed with the Clerk were presented and considered as follows: OBJECTOR None OBJECTION None The following residents asked questions concerning said rezoning: Mr. Gordon Garis, 5920 Wolfberry Lane; Mr. L. The Village -Manager presented the recommendation of the Planning Commission. (see Minutes of March 10, 1960). MOVED by Teresi seconded by Flannagan carried to give a first reading to an ordinance, upon recommendation by the Planning Commission, entitled: "AN ORDINANCE AMENDING THE ZONING CODE" (Moser - Commercial, Multiple Dwelling) MOVED by Flannagan seconded by Scherer carried to approve the ordinance here- in ere-in quoted by title on its first reading. MOVED by Flannagan seconded by Teresi carried to give a second reading to the above entitled ordinance on the grounds that a public urgency exists. MOVED by Teresi seconded by Flannagan carried to approve the ordinance herein quoted by title on its second reading and to order publication thereof. See Ordinance Book page. Request for Public Hearing, Raymore Pankonie, 6731 Golden Valley Road, Zoning: MOVED by Flannagan seconded by Bies carried to call a public hearing on April 19, 1960, to rezone the above referenced property from Institutional to Business & Professional Zone. Request to Call for Bids -Street Construction & Maintenance Materials: The Village Manager presented the request to advertise for bids for street construction and maintenance materials on April 5, 1960. Member Teresi introduced the following resolution and MOVED its adoption: "RESOLUTION MAKING ESTIMATES OF MATERIALS & EQUIPMENT & ORDERING ADVERTISEMENT FOR BIDS" (Miscellaneous, Street & Other Improvements - 1960) The motion for the adoption of the foregoing resolution was duly seconded by Member Flannagan and, upon vote being taken thereon the following voted in favor thereof: Bies, Flannagan, Nadasdy and Teresi; and the following voted against the same: None, whereupon said resolution was declared duly passed and adopted, signed by the Mayor and his signature attested by the Clerk. Ordinance Waiver - C B Johnson, 6600 Glenwood Avenue: Mr. George Pennock, president of the Planning Commission, presented the recommendation of the Planning Commission. (see minutes of 3-10-60). The following residents appeared and objected to said ordinance waiver: Mrs. Maller, 6610 Glenwood Avenue; Mr. J. W. McCabe, 6633 Glenwood Avenue; Mr. Maller, 6610 Glenwood Avenue. Foss, Winsdale & Mendelssohn Avenue. Mr. George Pennock, President of the Planning Commission, presented the recommendation of the Planning Commission. (see minutes of 3-10-60). MOVED by Bies seconded by Scherer carried to approve the ordinance waiver of 13 feet on the setback from Winsdale on Lot 17, Block 5, Lakeview Heights, upon recommendation of the Planning Commission. Ordinance Waiver - D. W. -Foss, Nailer Street -& Independence Avenue Mr. George Pennock, president of the Planning Commission, presented the recommendation of the Planning Commission. (see minutes of 3-10-60). MOVED by Bies seconded by Scherer carried to approve the ordinance waiver of 13 feet setback from Naper Street on Lot 12, Block 5, Lakeview Heights, upon recommendation of the Planning Commission. Ordinance Waiver - 6670 & 6680 Glenwood Avenue - E. S. Patten: Mr. George Pennock, president of the Planning Commission, presented the recommendation of the Planning Commission. (see minutes of 3-10-60). MOVED by Flannagan seconded by Scherer carried to approve the ordinance waiver upon recommendation of the Planning Commission. Second Reading -Ordinance Zones Douglas Drive (E ��nghauser, Nelson & Enghauser)• Mr. McVey of Mobile Oil Company was present to answer questions regarding the proposed building on said location. MOVED by Teresi seconded by Flannagan carried to give a second reading to an ordinance entitled: "AN ORDINANCE AMENDING THE ZONING CODE" (Enaco, Douglas Drive) MOVED by Teresi seconded by Flannagan carried to approve the ordinance here- in quoted by title on its second reading and to order publication thereof. Request for House Moving Permit-Robt L Burnett 8930 6th Avenue North: MOVED by Flannagan seconded by Bies carried to approve the request for a house moving permit for Robert L. Burnett, the house to be moved from 8930 6th Avenue North to 6680 Glenwood Avenue. Re: Platting Requirements for Storm Sewer: Mr. Bergstrom and Mr. Matzke appeared with their attorney Mr. T. I. Colyer, and Mr. Don Mender of Mender Engineering to request a waiver on storm sewer platting requirements (Sec. #6 part C & D) on the following subdivisions. a. Bergstrom*s Valley Heights Addition b. Brentwood Addition c. Matzke*s Terra Linda Addition d. Wisconsin Terrace Addition MOVED by Flannagan seconded by Bies carried to waiver platting requirements (Sec. #6 part C & D) on storm sewer on the above referenced subdivisions, said waiver not to establish a precedent for future developers. Mr. Bergstrom and Mr. Matzke discussed the construction of a private community water system. No action was taken. Request for Public Hearing on 1960.2L movements: The Village Engineer presented the request for a public hearing on 1960 improvements. Preliminary Approval-kossetta Heights, E2 of Lot 2 Yale Garden Homes: The Village Manager presented the request for preliminary approval for Rossetta Heights, E2 of Lot 2, Yale Garden Homes. Said plat meets the requirements established for platting in Yale Garden Homes. MOVED by Bies seconded by Scherer carried to grant preliminary approval of Rossetta Heights, EZ of Lot 2, Yale Garden Homes. Street Name Changes: Mr. George Pennock, president of the Planning Commission, presented the request for street name changes on the following streets: Zealand Avenue to Aquila, Orkla Drive to 24th Avenue, St. Croix Avenue to Sandburg Road, Un -named street south of Medicine Lake Road, 660 ft. West of Douglas Drive to Florida Avenue. Panel Report, Mr. Larkin McClellan: The Village Manager presented the Adjustment Panel Report dated February 15, 1960..Said report was ordered placed on file in the Clerk's office. MOVED by Teresi seconded by Flannagan carried to increase wages of heavy equipment operators $3.90 per month and light equipment operators $3.00 per month. Member Bies abstained from voting. Audit Report for 1959• Council deferred action on the above matter to the meeting of April 5, 1960. Report on Edina's Operation of Swimming Pool Council discussed the report and ordered a copy placed on file in the Clerk's office. No action was taken.
