09-06-60 City Council MinutesREGULAR MEETING of the VILLAGE COUNCIL September 6, 1960 Pursuant to due call and notice thereof, a regular meeting of the Village Council of the Village of Golden Valley, Hennepin County, Minnesota, was held at 7800 Golden Valley Road in said Village on September 6, 1960, at 8:15 o*clock P. M. The following members were present: Flannagan, Nadasdy, Scherer, and Teresi; and the following was absent: Bies. Present were Village Manager and Clerk, Roger K. Ulstad; Village Attorney, Stanley D. Kane; Village Engineer, Donald Sorensen; Deputy Clerk, Helen Penniman; Chairman of the Zoning Committee, W. Merton Dresser. The Mayor called the meeting to order at 8:15 o•clock P. M. Invocation: Rev. Norman D. Long, Church of the Brethren, 8641 Medicine Lake Road. Minutes of August 16, 1960: MOVED by Teresi seconded by Flannagan carried to defer action on the above referenced minutes to September 20, 1960. Public Hearing - Storm Sewer 60 -SS -4: The Village Manager presented an affidavit of publication in the official newspaper of the notice of public hearing on the proposed public improvement as described in said affidavit. Said affidavit was examined, approved and ordered placed on file in the Clerks office. The Mayor announced that this was the time and place for the public hearing above referred to and all persons who desired to do so were afforded an opportunity to express their views thereon, and all written objections heretofore filed with the Clerk were presented and considered as follows: OBJECTOR UBJECTION Mr. Dillon Moffatt Mr. Moffatt submitted a petition against 4824 Triton Drive said improvement in Yale Garden Homes area. Mrs. Anderson 3320 Regent Ave. North Mr. V. A. Nelson 4812 - 33rd Ave. North Mr. Orlyn D. Zibley 3201 Quail Ave. North Mrs. Anderson stated water doesn't run off their lot, it drains through the sand. The present condition has existed for many years, hopes it can be solved now. Mr. Zibley stated they only need part of the proposed improvement, that they should only be assessed for catch basins in this area. 1 1 1 Member Teresi introduced the following resolution and MOVED its adoption: "RESOLUTION ORDERING CONSTRUCTION OF A CERTAIN PUBLIC IMPROVEMENT (Storm Sewer, 60 -SS -4)" The motion for the adoption of the foregoing resolution was duly seconded by Member Flannagan and, upon vote being taken thereon, the following members voted in favor thereof: Flannagan, Nadasdy, Scherer, and Teresi; and the following voted against the same: None, whereupon said resolution was declared duly passed and adopted, signed by the Mayor and his signature attested by the Village Clerk. See Resolutions Book page ` Member Teresi introduced the following resolution and LVED its adoption: "RESOLUTION APPROVING PLANS AND SPECIFICATIONS AND ORDERING ADVERTISEMENT FOR BIDS (Storm Sewer, 60 -SS -4)++ The motion for the adoption of the foregoing resolution was duly seconded by Member Flannagan and, upon vote being taken thereon, the following members voted in favor thereof: Flannagan, Nadasdy, Scherer, and Teresi; and the following voted against the same: None, whereupon said resolution was declared duly passed and adopted, signed by the Mayor and his signature attested by the Village Clerk, See Resolutions Book page . Mr. Lee Sanford 3211 Orchard Ave. No. Mr. Sanford stated petitions are misleading, he signed same but did not want to kill the project, only modify the size. Mr.proposed 331 2 Noble Avenue Robert Loyd 331 Wouldn*t be benefited by improvement on Noble, asked about the people living behind him. Mr. H. Younghans 4750 - 33rd Ave. North Asked how many homes would be assessed, and how other storm sewers are assessed in Golden Valley. Mr. W. G. Nobles 3120 Noble Avenue Stated he didn't contribute water to the area, Mrs. Marvin A. Bouley Asked if 3312 Regent Avenue catch basins take care of all the storm drainage. PROPONENT - MEO-AT Mr, A. C. Laliberte 4821 Drake . Submitted a petition from Road his neighborhood in favor of construction and asked when construction would begin, The Mayor closed the public.hearing. Public Hearing,Rezoni.n - Robert Halseth (Commercial); The Village Manager presented an affidavit of publication in the official newspaper of the notice of public hearing rezoning as described in said affidavit. Said affidavit was examined, approved and ordered filed in the Clerk's office. The Mayor announced that this was the time and place for the public hearing above referred to and all persons who desired to do so were afforded an opportunity to express their views thereon, and all written objections heretofore filed with the Clerk were presented and considered as follows: OBJECTOR OB ECTION None None The Mayor closed the Public Hearing, Mr. W. Merton Dresser, Chairman of the Zoning Committee of the Planning Commission, presented the recommendation of the Planning Commission approv- ing the request (see minutes of August 11, 1960). MOVED by Scherer seconded by Teresi carried to give a first reading to an ordinance entitled: "AN ORDINANCE AMENDING THE ZONING CODE" (Halseth) MOVED by Teresi seconded by Scherer carried to approve the ordinance herein quoted by title on its first reading. Public Hearin -Rezoning - Robert Moser {Institutional); The Village Manager presented an affidavit of publication in the official newspaper of the Notice of Public Hearing rezoning as described in said affidavit. Hurd Mrs. Hurd stated their property value has a colored 1310 Welcome Avenue gone down due to industry and f amily in the area. Mrs. Harry P. Lucas Mrs. Lucas stated they were promised new 1324 Welcome Avenue homes in the surrounding area. Questioned how much money the congregation Mr. L. V. Mr. John S. Washburn Mr. Washburn stated he did not object to 5545 Golden Valley Road the proposed zoning. Mr. Berg stated the congregation has agreed Mr. Roy A. Berg to reside the church building. 1620 No. Florida The Mayor closed the Public Hearing. Council discussed the proposed rezoning. MOVED by Scherer seconded by Flannagan carried to approve building permit for the addition to the Church of the Goodthe j Shepherd, subject to the approval of the Building Inspector. Request for Bju)ilding Permit Wheaton -Thomas CompanF, 9010 Olson Hi hwa : The Village Manager submitted the proposed building plans for a commercial building for the Wheaton -Thomas Company, 9010 Olson Memorial Highway. The proponents were present and agreed to a minimum of 10 feet brick return on the east and west walls. MOVED by Teresi seconded by Scherer carried to approve the request for a sign permit for the Willys Motors Company at 5730 Wayzata Boulevard, subject to the approval of the Building Inspector. Re: Harry Lev 1933 Xerxes Avenue North Parking Problem: Mr. Levy appeared before Council regarding parking within 5 feet of his side lot line of a truck. The Village ordinances do not cover this complaint. Council took no action. Condemnation Fed k Addition 34th & Quail Avenue North: Mr. Fedyk appeared in reg and to the condemnation of his property at 34th & Quail Avenue North. The Village Attorney reviewed the condemnation and the commissioners award. Council deferred the matter to the meeting of September 20, 1960. Discussion Re: sump Pum at 5785 Westbrook Road Paul En hauser: Mr. Enghauser appeared before Council to discuss a sump pump for 5785 Westbrook Road. Council approved the installation of a sump pump at 5785 Westbrook Road. Council agreed that each such problem would be considered individually. Renest for Public Hearin - Gradin & Graveling: The Village Engineer presented the request for a public hearing for grading and graveling work, Oct. 18, 1960. See Resolutions Book page. Request to Advertise for Bids, Addition to Village Garage: The Village Manager presented the request to advertise for bids for an addition to the Village Garage. MOVED by Teresi seconded by Flannagan carried to authorize the Manager to hire an architect to submit plans for the proposed addition to the Village garage at the meeting of September 20, 1960. Budget Discussion: The Village Manager discussed a proposed meeting for the purpose of budget discussion for the year 1961. Council agreed to meet at 1:30 P.M. on Wednesday, September 14, 1960. Discussion of Question of Water Election: Council discussed at length the matter of submitting a question of municipal water on the Village election on December 6, 1960. MOVED by Scherer seconded by Flannagan carried to submit the question "SHALL TH3: VILLAGE GO INTO THE WATER BUSINESS" on the ballot at the Village election on December 6, 1960.
