11-19-63 City Council Minutes17 REGULAR MEETING of the VILLAGE COUNCIL November 19, 1963 Pursuant to due call and notice thereof, a regular meeting of the Village Council of the Village of Golden Valley, Hennepin County, Minnesota, was held at 7800 Golden Valley Road in said Village on November 19, 1963 at 7:30 o'clock P.M. The following members were present: Flannagan, Nadasdy, Schaphorst, Scherer, and Teresi; and the following were absent: None. Present were Village Manager, Roger K. Ulstad; Village Attorney, Robert M. Skare; Village Engineer, Donald Sorensen; Village Clerk, Helen Penniman; Building Inspector, Dan Lynch. The meeting was called to order at 7:45 P.M. Invocation: Rev. Stuart Cameron, Valley Community Presbyterian, 3100 No. Lilac Drive. Minutes of November 5, 1963: MOVED by Teresi seconded by Flannagan carried to approve the minutes of November 5, 1963, as submitted to the Council. Continued Public Hearing - Zoning, 6000 Laurel Avenue (Light Industrial): Mr. Al Godward, representing the proponent, appeared to request that the public hearing be continued until a request for an ordinance waiver could be heard by the Planning Commission. MOVED by Schaphorst seconded by Flannagan carried to continue the public hearing to a later date and refer the request for an ordinance waiver to the Planning Commission. Public Hearing - Zoning, Lindsay's 2nd Addition (Light Industrial): The Village Manager presented an affidavit of publication in the official newspaper of the Notice of Public Hearing as described in said affidavit. Said affidavit was examined, approved and ordered filed in the Clerk's office. The Mayor announced that this was the time and place for the public hear- ing above referred to and all persons who desired to do so were afforded opportunity to express their views thereon, and all written objections heretofore filed with the Clerk were presented and considered as follows: OBJECTOR OBJECTION None None Regular Meeting of the Village Council, November 19, 1963 The Mayor closed the Public Hearing. The Village Manager presented the recommendation of the Planning Comm- ission to approve said zoning. (See minutes of 11-14-1963). MOVED by Teresi seconded by Flannagan carried to give a first reading to an ordinance entitled: "AN ORDINANCE AMENDING THE ZONING CODE" (Brechet Sc Richter Co.) LVED by Teresi seconded by Flannagan carried to approve the ordinance herein quoted by title on its first reading. Public Hearing - Zoning, 5700 Duluth Street, Mobil Oil Company: The Village Manager presented an affidavit of publication in the official newspaper of the Notice of Public Hearing as described in said affidavit. Said affidavit was examined, approved and ordered filed in the Clerk's Office. The Mayor announced that this was the time and place for the public hear- ing above referred to and all persons who desired to do so were afforded opportunity to express their views thereon, and all written objections heretofore filed with the Clerk were presented and considered as follows: OBJECTOR OBJECTION None None The proponent requested a continuation of the Public Hearing for one month. Public Hearing - Street Improvement, Bituminous Surfacing (64 -BS -10): The Village Manager presented an affidavit of publication in the official newspaper of the Notice of Public Hearing as described in said affidavit. Said affidavit was examined, approved and ordered filed in the Clerk's office. The Mayor announced that this was the time and place for the public hear- ing above referred to and all persons who desired to do so were afforded opportunity to express their views thereon, and all written objections heretofore filed with the Clerk were presented and considered as follows: OBJECTOR OBJECTION None None 1 Regular Meeting of the Village Council, November 19, 1963 Several neighbors questioned the cost of the improvement. The Council continued the public hearing. Request for Public Hearing - Plat, Spruce Second Addition: The Village Manager presented the request for a Public Hearing to Plat Spruce Second Addition. MOVED by Flannagan seconded by Teresi carried to call a Public Hearing to to Plat Spruce Second Addition on December 17, 1963• Request for Public Hearing - Street Vacation, Olympia Street: The Village Manager presented the request for a Public Hearing for Street Vacation on Olympia Street. NDVED by Flannagan seconded by Teresi carried to call a Public Hearing for Street Vacation on Olympia Street on December 17, 1963. Request for Public Hearing - Zoning, 6705 Olson Highway, Apostolic Lutheran -Church: The Village Manager presented the request for a Public Hearing to zone 6705 Olson Highway for the Apostolic Lutheran Church from Residential to Insti- tutional. MOVED by Teresi seconded by Flannagan carried to call a Public Hearing to zone 6705 Olson Highway for the Apostolic Lutheran Church from Residential to Institutional on December 17, 1963. Request for Public Hearing - Zoning, County Road #66 & Douglas Drive, DeMac, Inc.: The Village Manager presented the request for a Public Hearing to zone prop- erty at County Road #66 and Douglas Drive for DeMac, Inc., from Open Develop- ment to Business & Professional Office, Commercial and Multiple Dwelling. MOVED by Teresi seconded by Flannagan carried to call a Public Hearing to zone the property at County Road #66 & Douglas Drive for DeMac, Inc., from Open Development to Business & Professional Office, Commercial and Multiple Dwelling on December 17, 1963. Request for Public Hearing - Zoning, 6000 Laurel Avenue, Residential: The Village Manager presented the request for a Public Hearing to zone 6000 Laurel Avenue from Open Development to Residential. MOVED by Teresi seconded by Flannagan carried to call a Public Hearing to zone 6000 Laurel Avenue from Open Development to Residential on December 17, 1963. Regular Meeting of the Village Council, November 19, 1963 west for Ordinance Waiver -4010 Wasatch Lane, John Sommers: The Village Manager presented the request for an ordinance waiver of yard requirements at 1010 Wasatch Lane for John Sommers. The Village Manager presented the Planning Commission recommendation to approve said request. (see minutes of 11-14-1963)• MOVED by Flannagan seconded by Scherer carried to approve the request for an ordinance waiver at 4010 Wasatch Lane for John Sommers, upon recommend- ation of the Planning Commission. Three Town Water Agreement - Final Approval: The Village Manager presented the final draft of the Three Town Water Agree- ment for Council consideration. MOVED by Flannagan seconded by Teresi carried to approve the final draft of the Three Town Water Agreement as submitted to Council. Glenview Terrace Park Area, Petition for Street Lights: A petition by several residents in the Glenview Terrace Park area for street lights in the park and the intersections of Byrd Avenue North, McNair Drive Crestview Avenue. Council continued the matter to the meeting of December 4, 1963. Second Reading - Sign Ordinance: MOVED by Teresi seconded by Scherer carried to continue the matter of the second reading of the sign ordinance to December 4, 1963• Request for Building Permit - 6980 Wayzata Boulevard, Texaco Service Station: The Building Inspector presented the request for a building permit for a Texaco Service Station at 6980 Wayzata Boulevard. Mr. Carlson and Mr. Thom- son of the Rees-Thomson-Scroggins Realtors also appeared to answer questions for Council. NDVED by Flannagan seconded by Teresi carried to approve the request for a building permit by the Texaco Service Station at 6980 Wayzata Boulevard, subject to a reasonable bond for landscaping purposes. Request for Building Permit - 5720 Wayzata Boulevard, South Side Lumber Co.: The Building Inspector presented the plans and request for a building permit for South Side Lumber Company at 5720 Wayzata Boulevard. NDVED by Teresi seconded by Flannagan carried to approve the request for a building permit for South Side Lumber Company at 5720 Wayzata Boulevard, sub- ject to the approval of the building Inspector. O _N Regular Meeting of the Village Council, November 19, 1963 The Building Inspector presented the plans and request for a building permit for a Ham Radio Tower at 2335 Decatur Avenue North, 40 feet in height. MOVED by Flannagan seconded by Teresi carried to approve the request for a building permit for a Ham Radio Tower at 2335 Decatur Avenue, subject to the approval of the Building Inspector. Request for Sign Permit - Advertising Creative Center, Nevada Ave. & Medicine Lake Rd.: The Building Inspector presented the request for a sign permit for the Advertising Creative Center at Nevada Avenue and Medicine Lake Road. LVED by Flannagan seconded by Teresi carried to approve the request for a sign permit for the Advertising Creative Center at Nevada Avenue and Medicine Lake Road, subject tothe approval of the Building Inspector. Request for Sign Permit - Ewald Brothers Dairy, 2919 Golden Valley Road: The Building Inspector presented the request for a sign permit for Ewald Brothers Dairy at 2919 Golden Valley Road. MOVED by Teresi seconded by Scherer carried to approve the request for a sign permit for Ewald Brothers Dairy at 2919 Golden Valley Road, subject to the approval of the Building Inspector. Exercise Call Option on Bonds: The Village Manager presented a proposed Call of Bonds dated November 19, 1963• MOVED by Flannagan seconded by Teresi carried to exercise a Call Option on Bonds as proposed on February 1, 1964. Approval of North Suburban Mutual Aid Agreement (Fire Department): The Village Manager presented the North Suburban Mutual Aid Agreement for the Fire Department. MOVED by Teresi seconded by Flannagan carried to approve the North Suburban Mutual Aid Agreement for the Fire Department and directed the proper officials to execute the same. Report of Committee on Reorganization of Municipal Court: The Village Manager presented the Committee Report on Reorganization of Muni- cipal Court. LVED by Scherer seconded by Flannagan carried to order said report on the Reorganization of Municipal Court placed on file in the Clerk's office. Regular Meeting of the Village Council, November 19, 1963 Request for Stock Transfer Approval - Holiday Motor Hotel: The Village Manager read a letter dated October 23, 1963, requesting an approval of stock transfer in the Anmar Motel, Inc. d.b.a. Holiday Motor Hotel. MOVED by Teresi seconded by Scherer carried to approve the stock transfer the Anmar Motel, Inc., d.b.a. Holiday Motor Hotel. Report on Survey - Golden Valley Safety Council: The Village Manager presented a report on a survey taken by the Golden Valley Safety Council dated November 15, 1963, recommending that Golden Valley re- quest the Minnesota Highway Department to close the interspace between the North and South bound lanes on #100 in front of the G. H. Tennant Company, immediately. MOVED by Flannagan seconded by Scherer carried to place said report on file and use the same in negotiations with the State Highway Department to obtain the closing of this opening in the highway. Resolution Establishing Suburban Sanitary Sewer Commission: The Village Manager presented the Resolution establishing Suburban Sanitary Sewer Commission. MOVED by Flannagan seconded by Scherer carried to approve in principle the resolution subject to review by the Village Attorney. Request for Dance Permit - Rats-Fo-Theb: Mr. Bruce Goldstein and Bob Glickman appeared before Council to request a dance permit for the Rats-Fo-Theb, to be held at the Viking Motel Ballroom on November 27, 1963. MOVED by Teresi seconded by Flannagan carried to approve the request for a dance permit, subject to approval of the Police -Chief and Village Attorney; and the Village Manager's check of references. Request for Building Permit - 6830 Sandburg Lane: All present agreed to add the above matter to the agenda. The Village Manager presneted a request for a building permit for a residence in an Open Development area at 6830 Sandburg Lane. MOVED by Flannagan seconded by Teresi carried to approve the request for a building permit for a residence in an (Open Development Zone at 6830 Sandburg Lane, subject to the approval of the Building Inspector.
