03-03-64 Council MinutesREGULAR MEETING of the VILLAGE COUNCIL March 3, 1964 Pursuant to due call and notice thereof a regular meeting of the Village Council of the Village of Golden Valley, Hennepin County, Minnesota, was held at 7800 Golden Valley Road in said Village on March 3, 1964, at 7:30 o'clock P.M. The following members were present: Flannagan, Garis, Nadasdy, Schaphorst, and Teresi; and the following were absent: None. Present were Village Manager, Roger K. Ulstad; Village Attorney, Robert M. Skare; Village Engineer, Donald Sorensen; Village Clerk, Helen Penniman; Building Inspector, Dan Lynch; President of the Planning Commission, Joe L. Brown. The meeting was called to order at 7:40 P.M. Invocation: Mayor Nadasdy gave the invocation. Minutes of February 18, 1964: MOVED by Teresi seconded by Schaphorst carried to approve the minutes of February 18, 1964, as submitted to the Council. Continued Public Hearing - Plat, Nyberg Addition: The Village Manager stated this was a continued public hearing from the meeting of February 18, 1964. MOVED by Flannagan seconded by Schaphorst carried to continue the public hearing to the meeting of March 17, 1964. Second Readin Ordinances - Zoning; 1910 Douglas Drive, 6155 Duluth Street, 6150 St. Croix Street: Mr. DeVries of DeMac, Inc., appeared to request that the proposed Multiple Dwelling classified in District II. Mr. DeVries agreed that the proposed multiple dwelling would not exceed 24� stories in height. MOVED by Flannagan seconded by Garis carried to defer the 2nd reading on all three rezonings until the building plans for the proposed multiple dwelling are submitted and approved by Council. Village Street Lights - Delphian Heights; Glenview Terrace Park: The Village Manager presented a plan for approximately 26 street lights in Delphian Heights for an estimated annual cost of $1,000.00. 1 Regular Meeting of the Village Council, March 3, 1111 Several residents of the area appeared to report illegal activities in the area which they felt would be improved by installation of street lighting. Council discussed assessing the cost of maintenance being spread over either five or ten years. TMDVED by Teresi seconded by Garis carried to order installation of said street lights immediately and to call a public hearing on April 7, 1964. Member Teresi introduced the following resolution and MOVED its adoption: "RESOLUTION PROVIDING FOR PUBLIC HEARING ON CERTAIN PROPOSED PUBLIC IMPROVEMENTS" (Street Lights -Delphian Heights) The motion for the adoption of the foregoing resolution was seconded by Member Garis and, upon vote being taken thereon, the following voted in favor thereof: Flannagan, Garis, Nadasdy, Schaphorst, Teresi; and the following voted against the same: None, whereupon said resolution was declared duly passed and adopted, signed by the Mayor and his signature attested by the Village Clerk. See Resolutions Book page �2 MOVED by Schaphorst seconded by Flannagan carried to direct the Village Manager to submit a written request to the Minneapolis Park Board and the Park Board Police for park lights and additional park police protect- ion. MOVED by Flannagan seconded by Teresi carried to direct the Golden Valley Police Department to supply additional patroling if necessary of the area after receiving report from Police Chief and compile the activities of the area and submit a report to council at a Public Hearing on April 7, 1964. Request for Building Permit - 8105 Lewis Road, Beim Construction Company: The Building Inspector presented a request for preliminary approval for a building permit at 8105 Lewis Road for Beim Construction Company. MOVED by Teresi seconded by Schaphorst carried to grant preliminary approval for a building permit at 8105 Lewis Road for Beim Construction Company, sub- ject to a buffer fence to cover pipe storage and approval of the Building Inspector. Request for Building Permit - 9100 Olson Highways Animal Hospital: The Building Inspector presented a request for final approval for a build- ing permit at 9100 Olson Highway for an Animal Hospital. MOVED by Teresi seconded by Flannagan carried to approve the final plans for a building at 9100 Olson Highway for an Animal Hospital, subject to the approval of the Building Inspector. 36 Regular Meeting of the Village Council, March 3, 1964 Request for BuildinE Permit - 2325 Nevada Avenue North, North American Van Liiness The Building Inspector presented a request for preliminary approval for a building permit for North American Van Lines at 2325 Nevada Avenue North. The proponents appeared before Council to answer questions and agreed to construct the building of shadow block with modular construction, the office and front wall of warehouse with return on the ends to be brick faced. MOVED by Teresi seconded by Schaphorst carried to give preliminary approval to the request for a building permit for North American Van Lines at 2325 Nevada Avenue North. Re: Land Development - Lamphere & Jones: The Village Manager gave a resume of the background of action of the above referenced property. Mr. Harley A. Degen, Attorney, representing Lamphere & Jones appeared and requested a public hearing be reinstated for Multiple Dwelling Zoning of said property. Mr. Lamphere and Mr. Fred Jones both appeared before Council to answer questions. Council discussed the matter at length. MOVED by Teresi seconded by Flannagan carried that no action be taken on the request to reinstate a public hearing. Ordinance Violation - Willard C. Flannagan, 400 Turnpike Road: All present agreed to add the above matter to the agenda. The Village Manager read a letter dated January 23, 1961, from the Chief - of -Police to Mr. Flannagan regarding his violation of Village Ordinances. Mr. Willard C. Flannagan, 400 Turnpike Road and Mr. Clement Harris, 401 Turnpike Road appeared before Council to answer questions. Mr. Flannagan agreed to clean up his yard. Council requested the matter be placed in the hands of the Chief -of -Police, the Village Attorney and the Village Manager. The violation must be cleared up to the satisfaction of the Chief -of -Police, and within two weeks time. Report on Special Village Census: The Village Manager submitted a report from the Village Treasurer estimat- ing the revenue from a special census in 1965. MOVED by Flannagan seconded by Teresi carried to approve the request for a Special Village Census in 1965 Regular Meeting of the Village Council, March 3, 1964 Re: Former Park Property, Mrs. Etzler: The Village Manager reported that the special assessments due on the former park property owned by Mrs. Etzler totaled $6,675.00, which Mrs. Etzler has agreed to pay. MOVED by Flannagan seconded by Garis carried to approve the settlement of special assessments due on the former park property owned by Mrs. Etzler in the amount of $6,675.00, upon recommendation of the Vj.11age Manager. Re: Garbage and Rubbish License, Ray Kowalczyk: The Village Manager reported to Council that Mr. Kowalczyk is licensed in Robbinsdale and Minneapolis as a garbage and rubbish hauler. MOVED by Flannagan seconded by Garis carried to approve the garbage and rubbish license for Mr. Ray Kowalczyk for 1964. Resolution Relating to Classification and Sale of Tax Forfeited Properties: The Village Manager presented the classification and non -conservation list x'577 -C" of tax forfeited properties authorized by the Board of County Commissioners. Member Teresi introduced the following resolution and MOVED its adoption: "RESOLUTION RELATING TO CLASSIFICATION AND SALE OF TAX FORFEITED PROPERTIES (List "577-C") The motion for the adoption of the foregoing resolution was seconded by Member Flannagan and, upon vote being taken thereon, the following voted in favor thereof: Flannagan, Garis, Nadasdy, Schaphorst, Teresi; and the following voted against the same: None, whereupon said resolution was declared duly passed and adopted, signed by the Mayor and his si nature attested by the Village Clerk. See Resolutions Book page Establish Organizational Meeting Date - Annual Village Lilac Celebration: The Village Manager informed the Council that the dates for the Annual Lilac Celebration are May 28, 29, 30, and 31st. MOVED by Flannagan seconded by Schaphorst carried to call an organizational meeting of the civic groups in Golden Valley on March 24th at 7:30 P.M. Northern States Power Company - Reduction in Electric Rates: The Village Manager presented a communication from Northern States Power Company dated February 11, 1964, regarding a reduction in residential, all electric residential, general service, all electric general service, general heating and cooking service, and large general service customer rates effective after March 2, 1964, of approximately 5%. JO Regular Meeting of the Village Council, March 3, 1964 Dutch Elm Committee Report: The Village Manager presented the minutes of the last meeting of the Dutch Elm Committee dated February 20, 1961. No action was taken. Civil Defense Courses: The Village Manager informed the Council of a Civil Defense Meeting March 12th and Civil Defense Conference on March 23rd and 24th, at the University Extension Division. Request to Advertise for Additional Voting Machines: The Village Manager presented a request to advertise for six additional voting machines. MOVED by Teresi seconded by Flannagan carried to approve the request to advertise for six additional voting machines on April 21, 1961. Request for Public Hearing - Zoning, 300 Ensign Ave. No. (Multiple Dwelling): The Village Manager presented a request for a public hearing to zone 300 Ensign Avenue North to Multiple Dwelling. MOVED by Schaphorst seconded by Teresi carried to call a public hearing to zone 300 Ensign Avenue North to Multiple Dwelling on April 7, 1964.
