07-07-64 Council Minutes138 REGULAR MEETING of the VILLAGE COUNCIL July 7, 1964 Pursuant to due call and notice thereof, a regular meeting of the Village Council of the Village of Golden Valley, Hennepin County, Minnesota, was held at 7800 Golden Valley Road in said Village on July 7, 1964, at 8:00 o'clock P.M. The following members were present: Flannagan, Garis, Nadasdy, Schaphorst, and Teresi; and the following were absent: None. Present were Village Manager, Roger K. Ulstad; Village Attorney, Robert M. Skare; Village Attorney, Donald Sorensen; Village Clerk, Helen Penniman; Building Inspector, Dan Lynch; President of the Planning Commission, Joe L. Brown. The meeting was called to order at 8:10 P.M. Invocation: Rabbi Marc Liebhaber, Tifereth B'Nai Jacob Synagogue. Minutes of June 16, 1964: MOVED by Teresi seconded by Flannagan carried to approve the minutes of June 16, 1964, as submitted to the Council. Public Hearing - Plat, Leber Addition: The Village Clerk presented an affidavit of publication in the official newspaper of the Notice of Public Hearing as described in said affidavit. Said affidavit was examined, approved and ordered filed in the Clerk's Office. The Mayor announced that this was the time and place for the public hearing above referred to and all persons who desired to do so were afforded oppor- tunity to express their views thereon, and all written objections heretofore filed with the Clerk were presented and considered as follows: OBJECTOR OBJECTION Mr. Lawrence Ellstrom Mr. Ellstrom questioned how the plat 15 Meadow Lane North would affect his property which abuts the proposed plat. Green 135 Meadow Lane North Stated if the road was changed to the north boundary of the plat, they would then be able to have water service. REASON Stated the plat needed sewer and water; he had not considered black- top for the proposed road at this time. Mr. Joe L. Brown, President, of the Planning Commission, presented the recom- mendation of the Planning Commission to approve said plat. (see minutes of June 11, 1964). MOVED by Flannagan seconded by Schaphorst carried to refer the plat to the Planning Commission to consider changing the road and to continue the Public Hearing to the meeting of July 21, 1964. Public Hearing - ZoninF., Apostolic Lutheran Church, 6000 Duluth Street: The Village Clerk presented an affidavit of publication in the official news- paper of the Notice of Public Hearing as described in said affidavit. Said affidavit was examined, approved and ordered filed in the Clerk's Office. The Mayor announced that this was the time and place for the public hearing above referred to and all persons who desired to do so were afforded oppor- tunity to express their views thereon, and all written objections heretofore filed with the Clerk were presented and considered as follows: OBJECTOR None C� : ��ii�[i�i►1 None Several residents in the area viewed the plat proposed to be zoned to I-1 Institutional for the Apostolic Lutheran Church, 6000 Duluth Street. PROPONENT REASON Rev. Hendrickson Appeared to request said zoning and 2455 Zane Avenue North stated the completion date for the proposed church is two years. The Mayor closed the public hearing. Mr. Joe L. Brown, President of the Planning Commission, presented the recom- mendation of the Planning Commission to approve said zoning. (see minutes of June 11, 1964). 139 140 Regular Meeting of the Village Council, July 7, 1964 MOVED by Flannagan seconded by Garis carried to give a first reading to an ordinance entitled: "AN ORDINANCE AMENDING THE ZONING CODE" (Apostolic Lutheran Church) MOVED by Teresi seconded by Flannagan carried to approve the ordinance herein quoted by title on its first reading, subject to homes being con- structed as shown on two sides of the proposed church. Public Hearing - Zon Part of Aud. Sub. East of Jersey & North of T.H. . The Village Clerk presented an affidavit of publication in the official newspaper of the Notice of Public Hearing as described in said affidavit. Said affidavit was examined, approved and ordered filed in the Clerk's Office. The Mayor announced that this was the time and place for the public hear- ing above referred to and all persons who desired to do so were afforded opportunity to express their views thereon, and all written objections heretofore filed with the Clerk were presented and considered as follows: OBJECTOR OBJECTION Mr. & Mrs. Wesley Harding Owners of said property, requested 6705 - 6th Avenue North it to be left in Open Development Zone. Mr. Harding stated there were better uses than residential. Mr. Robert Beib, representing Dahlberg Company PROPONENT Mrs. Kate Rutkowski 6823 - 6th Avenue North Mr. G. F. Klund 512 Jersey Avenue North The Mayor closed the public hearing. Mr. Geib stated that the Dahlberg opposed the residential zoning. REASON Circulated petition, 83 signers in favor of zoning to residential. In favor of residential zoning, has lots 18 and 21. Mr. Joe L. Brown, President of the Planning Commission, presented the recom- mendation of the Planning Commission to approve said zoning. (see minutes of 2-15-62 and 2-11-64). MOVED by Teresi seconded by Garis to deny the rezoning request. Public Hearing -,Public Improvements (64 -CP -4, 5, 6, 7, 8): The Village Clerk presented an affidavit showing publication in the official newspaper of the Notice of Public Hearing on Certain Proposed Public Improve- ments (Concrete Paving with Integral Curb - 64 -CP -4, 64 -CP -5, 64 -CP -6, 64 -CP -7, 64 -CP -8) described in the resolution of this Council relating thereto, adopted on June 16, 1964. Said affidavit was examined, approved and ordered filed in the office of the Village Clerk. The Mayor announced that the meeting was open for public hearing on said pro- posed public improvements, and all persons present to do so were afforded opportunity to express their views thereon. Kimmer_le 8204 Duluth Street OBJECTION Questioned if the cost included the driveway. REASON In favor of improvement, and asked when the work would be done. Mr. W. K. Smith Mr. Smith stated he was in favor of 8161 Duluth Street the concrete pavement. The Mayor closed the public hearing. Member Teresi introduced the following resolution and MOVED its adoption: "RESOLUTION ORDERING CONSTRUCTION OF CERTAIN PROPOSED PUBLIC IMPROVEMENTS" (Concrete Paving with Integral Curb - 64 -CP -4, 64 -CP -5, 64 -CP -6, 64 -CP -7, 64 -CP -8) The motion for the adoption of the foregoing resolution was duly seconded by Member Flannagan and, upon vote being taken thereon, the following mem- bers voted in favor thereof: Flannagan, Garis, Nadasdy, Schaphorst, and Teresi; and the following voted against the same: None, whereupon said resolution was declared duly passed and adopted, signed by the Mayor, and his signature attested by the Clerk. The Village Engineer recommended this project not be constructed to give the street time to settle; water installed this year. 64 -BS -27: Mr. R. G. Christensen stating that he has no deed for this improvement at this time. MOVED by Flannagan seconded by Schaphorst carried to continue the Public hearing pending negotiations for street right-of-way. The Mayor closed the public hearing. Member Teresi introduced the following resolution and MOVED its adoption: "RESOLUTION WAIVING THE PUBLIC HEARING PURSUANT TO MINNESOTA STATUTES 429.031, Sub. 3, AND ORDERING CONSTRUCTION OF A CERTAIN PROPOSED PUBLIC IMPROVEMENT (64-WML-75) The motion for the adoption of the foregoing resolution was duly seconded by Member Flannagan and, upon vote being taken thereon, the following members voted in favor thereof: Flannagan, Garis, Nadasdy, Schaphorst, and Teresi; and the following voted against the same: None, whereupon said resolution was declared duly passed and adopted, signed by the Mayor and his signature attested by the Village Clerk. Request for Building Permit - 1114 Zane Avenue North, Feinberg Meats: The Building Inspector presented the request for a building permit for Feinberg Meats at 1114 Zane Avenue North. Mr. Ron Rank, Architect, appeared to answer questions for Council. MOVED by Teresi seconded by Flannagan carried to approve the building permit for Feinberg Meats at 1114 Zane Avenue North, subject to posting a $2,000.00 Landscaping Bond and the approval of the Building Inspector. Request for Building Permit - 7600 Wayzata Boulevard, Heilicher Bros., Inc.: The Building Inspector presented the request for a building permit for Heilicher Brothers, Inc., at 7600 Wayzata Boulevard. iso Regular Meeting of the Village Council, July 7, 1961 MOVED by Flannagan seconded by Schaphorst carried to approve the building permit for Heilicher Brothers, Inc., at 7600 Wayzata Boulevard, subject to the approval of the Building Inspector. Request for Building Permit - 5250 Wayzata Boulevard, Medical Building: The Building Inspector presented a request for a building permit for a Medical Building at 5250 Wayzata Boulevard, and submitted preliminary plans. Mr. Charles Green and Mr. Amundson, Architect, were present to answer questions for Council. MOVED by Flannagan seconded by Schaphorst carried to approve the preliminary plans as submitted by the Building Inspector. Request for Building Permit - 8200 Olson Highway, Minneapolis Savings & Loan: The Building Inspector presented a request for a building permit for Minneapolis Savings & Lown at 8200 Olson Highway.
