10-20-64 Council Minutes222 REGULAR MEETING of the VILLAGE COUNCIL October 20, 1964 Pursuant to due call and notice thereof, a regular meeting of the Village Council of the Village of Golden Valley, Hennepin County, Minnesota, was held at 7800 Golden Valley Road in said Village on October 20, 1961, at 7:30 o'clock P.M. The following members were present: Garis, Schaphorst, and Teresi; and the following were absent: Flannagan, Nadasdy. Present were Village Manager, Roger K. Ulstad; Village Attorney, Robert M. Skare; Village Engineer, Donald Sorensen; Village Clerk, Helen Penniman; Building Inspector, Dan Lynch. Invocation: Rev. William Adam, Wirth Baptist Church, 1111 Olson Highway. Minutes of September 22, 1964: MOVED by Schaphorst seconded by Garis carried to approve the minutes of September 22, 196., as submitted to the Council. Request for Public Hearing - Plat, Circle Down & Natchez Avenue: The Village Manager presented a request for a public hearing to plat Circle Down and Natchez Avenue on November 4, 1961. MOVED by Schaphorst seconded by Garis carried to call a public hearing to plat Circle Down and Natchez Avenue on November 4, 1964. Request for Public Hearing - Zoning, Sandburg Road & Nevada, John P. Bonner: The Village Manager presented a request for a public hearing to zone Sandburg Road and Nevada for John P. Bonner, on November 4, 1961. Mr. Bonner appeared to request consideration under the Village Zoning Code Section 7.03:.19, rather than a request for a public hearing, for rezoning. Mr. Bonner requested to be placed on the November lith agenda for a build- ing permit. MOVED by Garis seconded by Schaphorst carried to call a public hearing to zone Sandburg Road and Nevada on November 4, 1964. Request for Public Hearng - Zoning, 6439 Golden Valley Road, Maurice Fillister: The Vill-age Manager presented a request for a public hearing to zone 6439 Golden Valley Road for Maurice Filister for November 4, 1964. MOVED by Garis seconded by Schaphorst carried to call a. public hearing to zone 6439 Golden Valley Road on November 4, 1964. Request for Ordinance Waiver —5825 St. Croix Avenue, Colonial Acres Home: The Village Manager presented a request for an ordinance waiver for Colonial Acres Home at 5825 St. Croix_ Avenue, and read the recommendation of the Plan- ning Commission to deny said waiver. (see minutes of 10-15-64). Rev. Hagberg of Colonial Acres Home was present to answer questions for Council. MOVED by Schaphorst seconded by Garis carried to approve the request for an ordinance waiver for Colonial Acres Home at 5825 St. Croix Avenue. Request for Ordinance Waiver - 4900 Golden Valley Road, Medrick Perry: The Village Manager presented a request for an ordinance waiver for Medrick Perry at 4900 Golden Valley Road, and read the recommendation of the Plan- ning Commission to deny said waiver. (see minutes of 10-15-64). MOVED by Schaphorst seconded by Garis carried to defer the matter to the meeting of November 4, 1964. Request for Ordinance Waiver - 7501 Olympia Street, Wayne Field: The Village Manager presented a request for an ordinance waiver at 7501 Olympia Street for Wayne Field, and read the Planning Commission recommend- ation to approve said waiver. (see minutes of 10-15-64). MOVED by Schaphorst seconded by Garis carried to defer the matter to the meeting of November 4, 1964. Request for Ordinance Waiver - 1913 Hillsboro Avenue North, Ray Farmer: The Village Manager presented a request for an ordinance waiver at 1913 Hillsboro Avenue North for Ray Farmer, and read the Planning Commission recommendation to deny said waiver. (see minutes of 10-15-64). MOVED by Schaphorst seconded by Garis carried to defer the matter to November 4, 1964. 224 Regular Meeting of the Village Council, October 20, 1964 uest for Public Hearin - Street Vacation (Lots 49-53 Belmont Mr. Kelly: The Village Manager presented a request for a public hearing for street vacation for the above referenced location on November 4, 1964. MOVED by Garis seconded by Schaphorst carried to call a public hearing to vacate a street in Lots 49-53, Belmont on November 17, 1964. Re: Policy on Street Pattern - Oregon Avenue, Duluth to Plymouth: The Village Manager presented a request to Council to view the area to determine policy on street patterns, and presented the recommendation of the Planning Commission to approve the proposed street pattern. (See minutes of 10-15-64). Moved by Schaphorst seconded by Garis carried to defer the matter above referred to, to the meeting of November 4, 1964. Administrative Recommendation - Lot Divisions: The Village Manager presented the recommendation of the Planning Commission to approve said lot divisions. (see minutes of 10-15-64). MOVED by Garis seconded by Schaphorst carried to approve the lot divisions as recommended by the Planning Commission and to waive the Platting Reg- ulations as recommended by the Planning Commission. Request for Building Permit - 5250 Wayzata Blvd., Drug & Liquor Store: The Building Inspector presented the request for a building permit for a Drug and Liquor Store at 5250 Wayzata Boulevard. Mr. Ralph Green and Harry Garish, Architect, presented preliminary plans for a Drug and Liquor Store at 5250 Wayzata Boulevard, and answered ques- tions for Council. MOVED by Schaphorst seconded by Garis carried to approve the preliminary plans for the Drug and Liquor Store at 5250 Wayzata Boulevard, subject to the approval of the Building Inspector. Request for Building Permit - Research Building, Glenwood Hills Hospital: The Building Inspector presented a request for a building permit to move a building for research onto the Glenwood Hills Hospital property. MOVED by Schaphorst seconded by Garis carried to defer the matter until Mr. VanHauer could be present to answer questions for Council. 1 Regular Meeting of the Village Council, October 20, 1964 Request for Building Permit - 2.30 Nevada Ave. No , Technical Publications• The Building Inspector presented a request for a building permit for an office building at 2.30 Nevada Avenue North for Technical Publications. The proposed building is planned to be block and brick or stucco and brick finish. MOVED by Schaphorst seconded by Garis carried to approve a footing permit for a building to be constructed with stucco and brick, subject to a $2,000 landscape bond and the approval of the Building Inspector. Council will consider final plans at the meeting of November 4, 1964. Request for Building Permit - Lyons Food Company, 2301 Nevada Avenue North: The Building Inspector presented the request for a building permit for the Lyons Food Company at 2301 Nevada Avenue North. Mr. Pilgrim, Attorney for Lyons Food Company and Mr. Roger Stahr appeared to answer questions for Council. Mr. Pilgrim stated it was impossible to obtain a bond against odors, but that they could get a performance bond based on construction. The officials of the Lyons Food Company agreed to guarantee in writing until the building progressed to the stage where a performance bond could be obtained, they agreed to a cash bond and a $1,500 bond for filters for the ventilation system with the approximate value of $10,000 valuation. MOVED by Garis seconded by Schaphorst carried to approve the building per- mit, subject to a $5,000 cash bond for a two year period, the expense of any arbitration to be born by the $5,000 bond, a $3,000 landscaping, and subject to the approval of the Building Inspector. Request for Building Permit - 8101 W. 10th Avenue North, Nortronics• The Building Inspector presented the request for a building permit to con- struct a concrete slab at the rear of 8101 W. 10th Avenue North for Nor- tronics. MOVED by Schaphorst seconded by Garis carried to 'approve the building per- mit for a concrete slab to the rear of 8101 W. 10th Avenue North for Nor- tronics, subject to the approval of the Building Inspector. Request for Building Permit - 145 Jersey Avenue South, Church of Good Shephe All present agreed to add the above matter to the agenda. The Building Inspector presented a request for a building permit for an addition to the Church of G000d Shepherd at 145 Jersey Avenue South. 226 Regular Meeting of the Village Council, October 20, 1964 MOVED by Garis seconded by Schaphorst carried to approve the building permit for an addition to the Church of the Good Shepherd at 145 Jersey Avenue South, subject to the approval of the Building Inspector. Re: Sodding & Driveway, Sidney Shields, 115 Maddaus Lane: Council deferred the above matter to the meeting of November 4, 1964. Request for Sign Permit - Texaco Service, 6980 Wayzata Boulevard: The Building Inspector presented a request for a sign permit for Texaco Service at 6980 Wayzata Boulevard, for a rotary sign. MOVED by Garis seconded by Schaphorst carried to deny the request for a sign permit for a rotary sign at 6980 Wayzata Boulevard for Texaco Service. Request for Speed Survey of All Villages & County Streets: The Village Manager presented a request for speed survey of all Villages and County streets. MOVED by Schaphorst second by Garis carried to approve the request for speed surveys on all Village and County streets in the Village. Resolution Calling for Sale of Improvement Bonds: The Village Manager presented a resolution calling for Sale of Improve- ment Bonds on November 17, 1964, and to employ T. G. Evensen and Assoc- iates as financial advisors. MOVED by Schaphorst seconded by Garis carried to call for the sale of $550,000 Improvement Bonds of 1964, on November 17, 1964, and to employ T. G. Evensen and Associates as financial advisors. Request for Street Lights - 5705 Glenwood Avenue, E. B. Nafstad: The Village Manager read a letter from Mr. Nafstad, 5705 Glenwood Avenue, requesting installation of street Lights on Glenwood Avenue. MOVED by Schaphorst seconded by Garis carried to deny the request for street lights on Glenwood Avenue at approximately 5705. Correspondence - Hennepin County, Branch F., County Ditch #18: The Village Engineer read a letter dated October 16, 1964, from L. P. Pederson regarding Branch F. of County Ditch #18, agreement cannot be reached since no funds are available. Council suggested the residents, if they so desire, petition the Board of County Commissioners for action. Regular Meeting of the Village Council, October 20, 1964 Council took no action on the matter. License: MOVED by Schaphorst seconded by Garis carried to approve the following license: No. Licensee Type Fee 3166 B & H Trucking Company Haul Garbage (Tag #344) $26.00 Bills : MOVED by Schaphorst seconded by Garis carried to approve the bills as submitted on the prelist. Re: Resolution on Water Pollution Control Commission: All present agreed to add the above matter to the agenda. The Village Manager presented a Notice of Meeting and Resolution regard- ing a "Proposed Method of Apportioning and Financing the Sewage Works Costs of the Southwest Region". Member Garis introduced the following resolution and MOVED its adoption: "RESOLUTION" The motion for the adoption of the foregoing resolution was seconded by Member Schaphorst and, upon vote being taken thereon, the following mem- bers voted in favor thereof: Garis, Schaphorst, and Teresi; and the following voted against the same: None, whereupon said resolution was declared duly passed and adopted, signed by the Mayor, and his signature attested by the Village Clerk. See Resolutions Book page 2 Taconite Amendment: All present agreed to add the above matter to the agenda. MOVED by Schaphorst seconded by Garis carried that the Council be re- corded as being in favor of the Taconite Amendment to be voted upon in the November 3, 196L election. Petition for Bituminous Surfacing (64 -BS -47): All present agreed to add the above matter to the agenda. The Village Engineer presented a petition for bituminous surfacing on Adeline Lane, Angelo Drive South to Cul-de-sac. Regular Meeting of the Village Council, October 20, 1964 Member Schaphorst introduced the following resolution and MOVED its adoption: "RESOLUTION WAIVING THE PUBLIC HEARING PURSUANT TO MINNESOTA STATUTES 129.031, SUED. 3 AND ORDERING CONSTRUCTION OF A CERTAIN PROPOSED PUBLIC IMPROVEMENT" (Proposed Bituminous Surfacing - 64 -BS -47) THE motion for the adoption of the foregoing resolution was duly seconded by Member Garis and, upon vote being taken thereon, the following members voted in favor thereof: Garis, Schaphorst, and Teresi; and the following voted against the same: None, whereupon said resolution was declared duly passed and adopted, signed by the Mayor and his signature attested by the Village Clerk.
