01-20-69 City Council MinutesREGULAR MEETING of the VILLAGE COUNCIL July 20, 1965 Pursuant to due call and notice thereof, a regular meeting of the Village Council of the Village of Golden Valley, Hennepin County, Minnesota, was held at 7800 Golden Valley Road in said Village on July 20, 1965, at 8:00 o'clock P. M. The following members were present: Flannagan, Garis, Nadasdy, Schaphorst, and Teresi; and the following were absent: None. Present were Village Manager, Roger K. Ulstad; Village Attorney, Robert M. Skare; Village Engineer, Donald Sorensen; Village Clerk, Helen Penniman; Building Inspector, Dan Lynch; Village Planner, John Voss; President of the Planning Commission, Robert Raugland. Invocation: Rev. William Adam, Wirth Park Baptist Church. Minutes of June 15, July 1, July 6, July 13 1965: MOVED by Schaphorst seconded by Flannagan carried to approve the minutes of June 15, 1965; July 1, 1965; July 6, 1965 and July 13, 1965, as submitted to the Council. Continued Public Hearing - Plat, Windsor Woods Addition: The Village Manager stated that this was a continued public hearing from the meeting of July 6, 1965, and read a report dated July 15, 1965, from the Village Engineer regarding drainage and sanitary sewers for said plat. Mr. J. F. Daly, 6481 Westchester Circle, speaking for the residents in Westchester Addition, requested information on the storm sewer and drainage. Mr. R. W. Swenson, 6475 Westchester Circle, asked the cost of the improve- ment if constructed by the Village and by a private contractor. Mr. Norman Nielsen, developer of the plat, stated they will provide 101 for a drainage easement. The Mayor closed the public hearing. Member Flannagan introduced the following resolution and MOVED its adoption: "RESOLUTION" (Acceptance of Plat - Windsor Woods Addition) The motion for the adoption of the foregoing resolution was seconded by Member Schaphorst and, upon vote being taken thereon, the following voted in favor thereof: Flannagan, Garis, Nadasdy, Schaphorst, and Teresi; and the following voted against the same: None, whereupon said resolution was declared duly passed and adopted, signed by the Mayor and his signature attested by the Village Clerk. Regular Meeting of the Village Council, July 20, 1965 Member Flannagan introduced the following resolution and MOVED its adoption: "RESOLUTION PROVIDING FOR PUBLIC HEARING ON CERTAIN PROPOSED PUBLIC IMPROVEMENTS" (Proposed Storm Sewer; 65 -SS -8) The motion for the adoption of the foregoing resolution was seconded by Member Schaphorst and, upon vote being taken thereon, the following voted in favor thereof: Flannagan, Garis, Nadasdy, Schaphorst, and Teresi; and the following voted against the same: None, whereupon said resolution was declared duly passed and adopted, signed by the Mayor, and his signature attested by the Village Clerk. Continued Public Hearing - Performance Standards for Service Stations: Mr. Norm Cruse, Assistant Secretary for Petroleum Council, appeared on behalf of the petroleum industry and requested the matter be continued so that they might review the proposed ordinance with the Planning Commission. MOVED by Teresi seconded by Garis carried to continue the public hearing on Performance Standard for Service Stations until further notice. Public Hearing - Public Improvement, Curb & Gutter (65 -CG -11): The Village Clerk presented an affidavit showing publication in the official newspaper of the Notice of Public Hearing on Certain Proposed Improvements (Proposed Curb & Gutter 65 -CG -11), described in the resolution of this Council relating thereto, adopted on June 22, 1965. Said affidavit was then examined, approved and ordered filed in the office of the Village Clerk. The Mayor then announced that the meeting was open for public hearing on said proposed public improvements, and all persons present to do so were afforded opportunity to express their views thereon. No persons presented objections except the following: OBJECTOR OBJECTION Mr. Claude J. Newman Opposed because of unusual situation 7350 Ridgeway Road of his lot. Disproportionate assess- ment on his property, consider curb & gutter on same basis as blacktop assess- ments. The Mayor closed the public hearing. Mr. Oldrich 0. Otypka, 7100 Half Moon Drive, is in favor of the improvement if the Village Engineer will grade the street to suit him. Member Teresi introduced the following resolution and MOVED its adoption: "RESOLUTION ORDERING CONSTRUCTION OF CERTAIN PROPOSED PUBLIC IMPROVEMENTS" (Proposed Curb & Gutter - 65 -CG -11) Regular Meeting of the Village Council, July 20, 1965 The motion for the adoption of the foregoing resolution was duly seconded by Member. Member Flannagan introduced the following resolution and MOVED its adoption: "RESOLUTION APPROVING PLANS AND SPECIFICATIONS AND AUTHORIZING CONTRACT CHANGES PURSUANT TO MINNESOTA STATUTES 429.041, SUBD. 7" (Proposed Concrete Curb & Gutter - 65 -CG -11) The motion for the adoption of the foregoing resolution was duly seconded by Member Teresi; and upon vote being taken thereon, the following voted in favor thereof: Flannagan, Garis, Nadasdy, Schaphorst, and Teresi; and the following voted against the same: None, whereupon said resolution was declared duly passed and adopted, signed by the Mayor, and his signature attested by the Village Clerk. Public Hearing - Alley Vacation, Glenwood Addition: The Village Clerk presented an affidavit of publication in the official news- paper of the Notice of Public Hearing as described in said affidavit. Said affidavit was examined, approved and ordered filed in the Clerk's Office. The Mayor announced that this was the time and place for the public hearing above referred to and all persons present who desired to do so were afforded opportunity to express their views thereon. No persons presented objections except the following: OBJECTOR OBJECTION Mr. L. M. Moore Requested that the petition be with - 529 Meadow Lane North drawn for the alley vacation. Mr. Robert Raugland, President of the Planning Commission, presented the recommendation of the Planning Commission to approve the alley vacation. (see minutes of June 10, 1965). The Mayor closed the public hearing. MOVED by Teresi seconded by Schaphorst carried to continue the public hear- ing for one month to secure easements for the power company. Regular Meeting of the Village Council, July 20, 1965 Request for Ordinance Waiver - 2200 Orchard Avenue North: Mr. Robert Raugland, President of the Planning Commission, presented the recommendation of the Planning Commission to deny said ordinance waiver. (see minutes of 7-15-1965). Mr. & Mrs. William Richter appeared before Council to answer questions. MOVED by Garis seconded by Teresi carried to approve the request for an ordinance waiver at 2200 Orchard Avenue North. Request for Ordinance Waiver - 9400 Winsdale Street: Mr. Robert Raugland, President of the Planning Commission, presented the recommendation of the Planning Commission to approve said ordinance waiver. (see minutes of 7-15-65). MOVED by Teresi seconded by Garis carried to approve the request for an ordinance waiver at 9400 Winsdale Street, upon recommendation of the Planning Commission. Request for Ordinance Waiver - 325 Sunwridae Lane: Mr. Robert Raugland, President of the Planning Commission, presented the recommendation of the Planning Commission to approve said ordinance waiver. (see minutes of 7-15-1965). MOVED by Flannagan seconded by Schaphorst carried to approve the request for an ordinance waiver at 325 Sunn4yridge Lane, upon recommendation of the Planning Commission. Request for Ordinance Waiver - 1040 Angelo Drive: Mr. Robert Raugland, President of the Planning Commission, presented the recommendation of the Planning Commission to approve said ordinance waiver. (see Minutes of 7-15-1965). MOVED by Teresi seconded by Flannagan carried to approve the request for an ordinance waiver at 1040 Angelo Drive, upon recommendation of the Planning Commission. Request for Ordinance Waiver - 3250 Orchard Avenue North: Mr. Robert Raugland, President of the Planning Commission, presented the recommendation of the Planning Commission to approve said ordinance waiver. (see minutes of 7-15-1965). MOVED by Flannagan seconded by Teresi carried to approve the request for an ordinance waiver at 3250 Orchard Avenue North, upon recommendation of the Planning Commission. I Regular Meeting of the Village Council, July 20, 1965 Request for Ordinance Waiver - 6900 Western Avenue: Mr. Robert Raugland, President of the Planning Commission, presented the recommendation of the Planning Commission to deny said ordinance waiver. (see minutes of 7-15-1965). MOVED by Flannagan seconded by Schaphorst carried to deny the request for an ordinance waiver at 6900 Western Avenue, upon recommendation of the Planning Commission. Request for Sign Permit - Woodfill's Shell Station, 5500 Golden Valley Road: Mr. Stan Johnson, Shell Oil Company and Perry Woodfill were present to request a sign permit for the Shell Service Station at 5500 Golden Valley Road. The Building Inspector stated they were in violation of the sign ordinance on the square foot limitations and in violation of the use of set -back with the trailor rental. MOVED by Teresi seconded by Schaphorst carried to defer the matter to the meeting of August 3, 1965. Request for Sign Permit - A & W Root Beer, 25.0 Winnetka Avenue North: MOVED by Flannagan seconded by Garis carried to approve the request for a sign permit as submitted by the Building Inspector for A & W Root Beer at 2540 Winnetka Avenue North, subject to the approval of the Building Inspector. Drainage - Bassett Creek: Mr. J. A. Kliment, 2160 Zane Avenue North, stated the silt was filling up a pond in front of his home. Mr. Robert Raugland, President of the Planning Commission, reviewed the history of the plat. Rev. Hendricks of the Minneapolis Apostolic Lutheran Church, owner of property on County Road #66 or Duluth Street, spoke regarding the drainage of their property. Council directed the Village Engineer to investigate secur9ng a permit and using a drag line to.remove the silt from the pond in Bassett's Creek in front of 2160 Zane Avenue North. Request for Ordinance Waiver - 5308 St. Croix Avenue: All present agreed to add the above matter to the agenda. Mr. Knaeble of 5308 St. Croix Avenue, requested an ordinance waiver for 5 inches in violation of set -back requirements. 14' Regular Meeting of the Village Council, July 20, 1965 Council suggested that the fee required for an ordinance waiver be waived and referred the matter to the Planning Commission. Animal Hospital - 9100 Olson Highway: All present agreed to add the above matter to the agenda. Dr. Gibbs presented a letter from Insulation Sales Company dated June 29, 1965, which was read by the Village Manager, regarding the noise barrier as requested by the Council before issuing a building permit. Report on Street Alignment, Spruce 3rd Addition (Lee Avenue_North): The Village Engineer reported on the progress and stated that they were attempting to negotiate without condemnation for the right-of-way for Lee Avenue North extended in Spruce 3rd Addition. MOVED by Teresi seconded by Schaphorst carried to defer the matter to the meeting of August 3, 1965. Preliminary Report of Planning Commission, Performance Standards -Car Wash: Council deferred the above matter pending further study and a report from the Planning Commission. Preliminary Plans - Automatic Car Wash: The request was withdrawn by the proponent. State of Minn. v. Morton Salt Co. et al, Price -Fixing Suit: The Village Attorney reviewed the costs of entering into a price fixing suit with the State of Minnesota vs. Morton Salt Company et al. MOVED by Teresi seconded by Flannagan carried to authorize the attorney for the State of Minnesota to represent the Village of Golden Valley in the above referenced suit. Request for Public Hearing - Zoning, 2200 Winnetka Avenue North: MOVED by Teresi seconded by Garis carried to call a public hearing to zone 2200 Winnetka Avenue North from Open Development to Multiple Dwelling (M-2) on August 3, 1965. Traffic Signals- Winnetka Avenue North & 6th Avenue North: The Village Engineer presented the plans for a complete signal system with the County participating in 25% of the cost of the construction and the Village sharing the 75% remaining portion of the construction cost. MOVED by Teresi seconded by Flannagan carried to approve the construction of traffic signals at the intersection of Winnetka Avenue North and 6th Avenue North, upon recommendation of the Village Engineer. City of Minneapolis - Village of Golden Valley, Interconnection of Trunk Sewer: The Village Manager, Village Attorney, and Village Engineer reported on their meeting with the City of Minneapolis representatives regarding the inter- connection of the Golden Valley sanitary sewer with the City of Minneapolis sewer system. The Village Manager submitted a letter dated July 19, 1965, from Orr-Schelen- Mayeron regarding the rates for Consulting Engineering Service for the Proposed interconnection of the Golden Valley sanitary sewer system with theCity of Minneapolis MOVED by Teresi seconded by Flannagan carried to defer action on the above referenced matter to the meeting of August 3, 1965. 1 h Regular Meeting of the Village Council, July 20, 1965 T,�Jording for Plaques - (Awards): Council approved the proposed wording for the plaques to be awarded to the following citizens who have served as representatives on committees of the Village. MOVED by Flannagan seconded by Garis carried to approve the administrative lot division at 8805 Medicine Lake Road, upon recommendation of the Planning Commission. Administrative Lot Division - 2409 Winnetka Avenue North: The Village Manager presented the request for approval of an administrative lot division at 2109 Winnetka Avenue North. (see Planning Commission minutes of July 15, 1965). MOVED by Flannagan seconded by Garis carried to approve the administrative lot division at 2409 Vinnetka avenue North, upon recommendation of the Planning Commission. Administrative Lot Division - 2800 Kyle Avenue North: The Village Manager presented the request for approval of an administrative lot division at 2800 Kyle Avenue North.(see Planning Commission minutes of July 15, 1965.) Administrative Lot Division - 3120 Manor Drive: The Village Manager presented the request for approval of an administrative lot division at 3420 Manor Drive. H. x`55 & County Road tr''18 Interchange Plans The Village Manager informed the Council that the State of Minnesota Highway ?'epartment has called a public hearing regarding the -interchange at T.H. tt55 and County Road #18 for 7:30 o'clock P. M. on Tuesday, July 27, 1965. Bills: MOVED by Flannagan seconded by Garis carried to approve the bills as submitted on the prelist. Request for Rezoning - 5110 Duluth Street• All present agreed to add the above matter to the agenda. The Village Manager presented a request to rezone 5110 Duluth Street to Residential Zone. MOVED by Flannagan seconded by Teresi carried to refer the request to rezone 5110 Duluth Street to Residential Zone to the Planning Commission for recommendation.
