03-16-65 City Council Minutess REGULAR MEETING of the VILLAGE COUNCIL March 16, 1965 Pursuant to due call and notice thereof, a regular meeting of the Village Council of the Village of Golden Valley, Hennepin County, Minnesota, was held at 7804 Golden Valley Road in said Village on March 16, 1965, at 7:45 o'clock P.M. The following members were presents Flannagan, Garis, Nadasdy, Schaphorst, and Teresi; and the following were absent: None. Invocation: Rev. Stanley D. Hanks, Golden Valley Methodist. Present were Village Manager, Roger K. Ulstad; Village Attorney, Robert M. Skare; Village Engineer, Donald Sorensen; Village Clerk, Helen Penniman, Building Inspector, Dan Lynch; President of the Planning Commission, Robert Raugland; Village Assessor, Robert N. Burns. Minutes of March 2, 1965: MOVED by Schaphorst seconded by Flannagan carried to approve the minutes of March 2, 1965, as submitted to the Council. Award of Bids - Self Propelled Pickup Street Sweeper: MOVED by Flannagan seconded by Garis carried to defer the award of bids for Self -Propelled Pickup Street Sweeper to the meeting of April 6, 1965. Public Hearing - Zoning, Residential Districts: MOVED by Schaphorst seconded by Teresi carried to continue the public hear- ing to the meeting of April 20, 1965. Public Hearing - Zoning, Institutional District: MOVED by Schaphorst seconded by Teresi carried to continue the public hear- ing to the meeting of April 20, 1965. Public Hearing - Zoning, 6300 Wayzata Boulevard, Multiple Dwelling (M-2): The Village Clerk presented an affidavit of publication in the official news- paper of the Notice of Public Hearing as described in said affidavit. Said affidavit was examined, approved and ordered filed in the Clerk's Office. The Mayor announced that this was the time and place for the public hearing above referred to and all persons who desired to do so were afforded oppor- tunity to express their views thereon, and all written objections heretofore filed with the Clerk were presented and considered as follows on Page 39: 1 1 Regular Meeting of the Village Council, March 16, 1965 OBJECTOR Albert B. Yngve 7145 Green Valley Road Mr. Voip of Volp Construction Company 775 Colorado Avenue South Mr. Richard Walsh, Developer OBJECTION Mr. Yngve stated he was concerned about being restricted or required to provide a buffer on their property. Interested as a property owner to the east of the proposed zoning. REASON Presented a revised plot plan as recommended by Planning Commission for 240 apartments of masonry construction with Strout brick finish. Mr. Walsh stated he had no objection to the use of the adjacent land for industrial uses with respect to set -backs. Mr. Robert Raugland, President of*the Planning Commission, presented the Planning Commission recommendation to approve said zoning. (see minutes of 2-11-65). The Mayor closed the public hearing. MOVED by Teresi seconded by Flannagan carried to give a first reading to the ordinance conditioned on the requirement that the proponent provide the buffer area normally required for Multiple Dwelling Zone, said ord- inance entitled: "AN OBDINANCE AMENDING THE ZONING CODE" (6300 Wayzata Boulevard - Multiple Dwelling (M-2)) MOVED by Teresi seconded by Schaphorst carried to approve the ordinance herein quoted by title on its first reading. Public Hearing - Zoning, 7541 Harrold Avenue, Mulitple Dwelling (M-2): The Village Clerk presented an affidavit of publication in the official news- paper of the Notice of Public Hearing as described in said affidavit. Said affidavit was examined., approved and ordered filed in the Clerk's Office. The Mayor annouYced that this was the time and place for the public hearing above referred to and all persons who desired to do so were afforded oppor- tunity to express their views thereon, and all written objections heretofore filed with the Clerk were presented and considered as follows on Page 40: Regular Meeting of the Village Council, March 16, 1965 OBJECTOR OBJECTION Mr. C. P. Sathre Mr. Sathre stated everyone in the 7330 Half Moon Drive area is opposed to this zoning; it will be detrimental to the homes, and no buffer area is provided. Petitions from approximately sixteen residents in opposition to said zoning were presented. PROPONENT REASON Mr. Ferdinand F. Holzheu Owner of property, gave option to 1314 Mississippi St. N. E. Kurtz -Larson Realty. Mr. Robert Raugland, President of the Planning Commission, presented the recommendation of the Planning Commission to deny said zoning. (see minutes of 2-11-65). The Mayor closed the public hearing. MOVED by Flannagan seconded by Schaphorst carried to deny the request for zoning 7541 Harold Avenue to Multiple Dwelling (M-2) upon recommendation of the Planning Commission. Location of New & Used Automobile Sales - Zo!Agn Application: Mr. Robert Raugland, President of the Planning Commission, presented the recommendation of the Planning Commission. (see minutes of 3-11-65). Mr. Raugland, Architect for Anderson Cadillac, stated they proposed to change the site of their location to 7420 Wayzata Boulevard in Industrial Zone. Mr. Paul Senstad,.Chairman of the Ordinance Committee, reviewed the Ordinance Committee report and stated a further report will be presented by the Ordinance Committee. Mr. William Briggs of Anderson Cadillac, stated the building will be a quality Cadillac Building with all new cars and two-thirds of the used cars inside of the building. There will be no banners, balloons, etc. outside the building. Carrs will be parked in an orderly manner. They would like to start construe tion by April 15, 1965. Mr. Jerome E. Rau, 5101 Circle Downs, stated that Anderson Cadillac stored damaged cars outside until they were repaired. The Council gave informal consideration to the new location at 7.20 Wayzata Boulevard, subject to all limitations established by the Planning Commission. Regular Meeting of the Village Council, March 16, 1965 MOVED by Teresi seconded by Flannagan carried to call a Special Council meeting on March 23, 1965, to consider this matter and to meet with the Golden Valley Park and Recreation Commission. Request for Building Permit - 701 Lilac Drive North, G. H. Tennant _Compan The Building Inspector presented a request for a building permit for an addition at 701 Lilac Drive North for G. H. Tennant Company. MOVED by Schaphorst seconded by Flannagan carried to approve the request of G. H. Tennant Company at 701 Lilac Drive North for a.building permit for an addition, subject to the approval of the Building Inspector. Request for Ordinance Waiver - 6515-6523 Plymouth Avenues The Village Manager presented the request for an ordinance waiver at 6515- 6523 Plymouth Avenue for Mr. Eric R. Lelvis. Mr. Robert Raugland, President of the Planning Commission, presented the recommendation of the Planning Commission to approve said ordinance waiver. (see minutes of 3-11-65). MOVED by Flannagan seconded by Garis carried to approve the request for an ordinance waiver at 6515-6523 Plymouth Avenue for Mr. Eric R. Lelvis, upon recommendation of the Planning Commission. Request for Ordinance Waiver - 1301-1305 Gettysburs Avenue: The Village Manager presented the request for an ordinance waiver at 1301- 1305 Gettysburg Avenue for Mr. J. Liss. Mr. Robert Raugland, President of the Planning Commission, presented the recommendation of the Planning Commission to deny said ordinance waiver. (see minutes of 3-11-65). Mr. J. Liss and his attorney were present to answer questions for Council. MOVED by Flannagan seconded by Schaphorst carried to approve the request for an ordinance waiver It 1301-1305 Gettysburg Avenue for Mr. J. Liss. Request for Sign Permit - Holiday Motor Hotel, Location 1001 Lilac Dr. No.: The Building Inspector presented the request for a sign permit for the Holiday Motor Hotel, location at 1001 Lilac Drive North, on Village property. MOVED by Schaphorst seconded by Garis carried to approve the request for a sign permit for a sign at 1001 Lilac Drive North on Village property, sub- ject to the size and rental being determined by the Village Staff. 1 M 42 Regular Meeting of the Village Council, March 16, 1965 Bassett Creek Flooding - Mr. N. Clyde Nielsen, 5301 - 33rd Avenue North: Mr. Nielsen, 5301 - 33rd Avenue North, appeared before Council to request the Village to dredge out the drainage ditch emptying into Bassett Creek. The Village Engineer reviewed the conditions in the area and the progress for the Council. Mr. N. C. Jepsen, 3390 Scott Avenue North, stated that his property was flooded three or four times during 1963• The culvert on Scott Avenue acts as a dam for the run-off. The residents requested two culverts to be installed and to secure waivers along the ditch to Culver Road. Council agreed to attempt some work providing the waivers were obtained. Request for Management Office in Multiple Dwelling District, Village Terrace: The Village Manager presented the request for a property management office located in a Multiple Dwelling, Village Terrace, 241-273 Yosemite Circle, and presented the recommendation of the Planning Commission to deny said use in Multiple Dwelling District. (see minutes of 3-11-65). MOVED by Garis seconded by Schaphorst carried to deny the request for a property management office in a Multiple Dwelling District, at 241-273 Yosemite Circle, upon recommendation of the Planning Commission. Discussion of Industrial and Commercial Land Value Comparisons, Village Assessor: The Village Assessor presented a list sampling Industrial and Commercial Land Value Comparisons and Increases and gave a.resume of the policy on land values in assessing. An informal discussion followed. Council took no action. Reconsideration of Deferred Assessments: The Village Assessor presented information regarding deferred special assess- ments on Lot 1 and Lot 10, Busch's Golden Valley Acres pending development of the plat. MOVED by Schaphorst seconded by Flannagan carried to discontinue the defer- ment of special assessments on Lot 1 and Lot 10, Busch's Golden Valley Acres. Request for Preliminary Plan Approval - Minneapolis Clinic, 42225 Golden Valle Road: The Building Inspector presented the preliminary plans for the Mince apolis Clinic at 1.225 Golden Valley Road. 2 Regular Meeting of the Village Council, March 16, 1965 MOVED by Flannagan seconded by Schaphorst carried to approve the preliminary plans for the Minneapolis Clinic at 4225 Golden Valley Road, subject to the approval of the Building Inspector. Resolution Re: Proposed PERA & OASDI Coordination.- Member oordination: Member Teresi introduced the following resolution and MOVED its adoption: "RESOLUTION" (PERA-OASDI COORDINATION) The motion for the adoption of the foregoing resolution was seconded by Member Flannagan and, upon vote being taken thereon, the following voted in favor thereof: Flannagan, Garis, Nadasdy, Schaphorst, and Teresi; and the following voted against the same: None, whereupon said resolution was declared duly passed and adopted, signed by the Mayor and his signature attested by the Village Clerk. Council discussed the matter and recommended the usual procedure in the case of a first :violation by a licensee by followed i.e. "suspension of license for a 10 day period".
