04-20-65 City Council Minutes63 iEGU1AR MEETING of the VILLAGE COUNCIL April 20, 1965 Pursuant to due call and notice thereof, a regular meeting of the Village Council of the Village of Golden Valley, Hennepin County, Minnesota, was held at 7800 Golden Valley Road in said Village on April 20, 1965, at 7:30 o'clock P. M. The following members were present: Flannagan, Garis, Nadasdy, Schaphorst, and Teresi; the following were absent: None. Invocation: Mayor Nadasdy. Present were Village Manager, Roger K. Ulstad; Village Attorney, Robert M. Skare; Village Engineer, Donald Sorensen; Village Clerk, Helen Penniman; Building Inspector, Dan Lynch; President of the Planning Commission, Robert Raugland. Minutes of April 6, 1965: MOVED by Teresi seconded by Schaphorst carried to approve the minutes, with the addition of the word "substitute" on page 5 paragraph 5 before the word brick in the second line of said paragraph, as submitted to the Council. Continued Public Hearing - 65 -BS -21; 65 -CG -8: The Village Manager stated that this was a continued public hearing called on April 6, 1965, on certain proposed public improvements, 65 -BS -21; 65 -CG -8. The Mayor announced that this was the time and place for the continued public hearing above referred to and all persons who desired to do so were afforded opportunity to express their views thereon, and all written objections here- to fore filed with the Clerk were presented and considered as follows: OBJECTOR OBJECTION None None The Mayor closed the public hearing. MOVED by Schaphorst seconded by Garis carried to order construction of public improvements 65 -BS -21 and 65 -CG -8. Public Hearing - Watermains: The Village Clerk presented an affidavit showing publication in the official newspaper of the Notice of Public Hearing on Certain Proposed Public Improve- ments (65-WM-1, 3, 93 10, 12, 144 153 163 17, 18, 193 203 21, 223 23 and 24), described in the resolution of this Council relating thereto, adopted on March 16, 1965. Said affidavit was then examined, approved and ordered filed in the office of the Village Clerk. m Regular Meeting of the Village Council, April 20,.1965 The Mayor then announced that the meeting was open for public hearing on said proposed public improvements, and all persons present to do so were afforded opportunity to express their views thereon. No persons presented objections except the following: OBJECTOR OBJECTION None None 65-WM-12: 12.5% signers on petition. MOVED by Teresi seconded by Flannagan carried to continue the public hearing on 65-WM-12 to the meeting of May 4, 1965. Mr. Pederson of General Mills stated they were neither in favor nor opposed, but wanted the wishes of the majority of the residents considered. Member Teresi introduced the following resolution and MOVED its adoption: "RESOLUTION ORS)ERING CONSTRUCTION OF CERTAIN PROPOSED PUBLIC IMPROVEMENTS" (65 WX-1, 3, 9, 10, 12, 14, 15, 16, 172 18, 192 202 21, 22, 23 & 24) The motion for the adoption of the foregoing resolution was duly seconded by Member Flannagan and, upon vote being taken thereon, the following members voted in favor thereof: Flannagan, Garis, Nadasdy, Schaphorst, and Teresi; and the following voted against the same: None, whereupon said resolution was declared duly passed and adopted, signed by the Mayor, and his signature attested by the Village Clerk. See Resolutions Book page Member Flannagan introduced the following resolution and MOVED its adoption: "RESOLUTION APPROVING PLANS AND SPECIFICATIONS AND ORDERING ADVERTISEMENT FOR BIDS" (65 wm-1, 3, 9, 103 12, 143 153 163 173 18, 193 203 213 223 23, 24) The motion for the adoption of the foregoing resolution was duly seconded by Member Garis and, upon vote being taken thereon, the following members .voted in favor thereof: Flannagan, Garis, Nadasdy, Schaphorst, and Teresi; and the following voted against the same: None, whereupon said resolution was declared duly passed and adopted, signed by the Mayor, and his signature attested by the Village Clerk. Said affidavit was then examined, approved and ordered filed in the office of the Village Clerk. The Mayor announced that the meeting was open for public hearing on' said proposed public improvements, and all persons present to do so were afforded opportunity to express their views thereon. Peterson owns eight lots on Hillsboro Regular Meeting of the Village Council, April 20, 1965 Avenue and questioned construction of a proposed storm sewer for the area. MVED by Teresi seconded by Flannagan carried to continue the public hearing on 65 -GG -6, to the meeting of May 4, 1965. The Mayor closed the public hearing. The" Mayor announced that this was the time and place for the public hearing above referred to and all persons who desired to do so were afforded oppor- tunity to express their views thereon, and all written objections heretofore filed with the Clerk were presented and considered as follows: OBJECT„ OB None None Regular Meeting of the Village Council, April 20, 1965 Mr. Robert Raugland, President of the Planning Commission, presented the recommendation of the Planning Commission to approve said vacation. (see minutes of March 11, 1965,)'. The Mayor closed the public hearing. Member Flannagan introduced the following resolution and MOVED its adoption: "RESOLUTION" (Street Vacation - Portion of Phoenix STreet) The motion for the adoption of the foregoing resolution was seconded by Member Garis and, upon vote being taken thereon, the following members voted in favor thereof: Flannagan, Garis, Nadasdy, Schaphorst, and Teresi; and the following voted against the same: None, whereupon said resolution was declared duly passed and adopted, signed by the Mayor, and his si nature attested by the Village Clerk. See Resolutions Book page : - Environmental Survey: All present agreed to add the above matter to the agenda. Mr. John 0. Buxell, associate professor in the University of Minnesota school of_`' public health, informed the council that eight of his graduate students will be conducting a survey to determine the environmental health aspects of housing, and the residential environments in Goiden Valley. Council approved the proposed environmental: survey and thanked Mr. Buxell for the opportunity of obtaining valuable information through the survey. Second Reading - Industrial Zoning District, 7420 Wayzata Boulevard: MOVED by Teresi seconded by Schaphorst carried.to give a second reading to an ordinance entitled: "AN ORDINANCE AMENDING THE ZONING CODE" (Industrial Zoning Districts) MOVED by Flannagan seconded by Teresi carried to approve the ordinance herein quoted by title on its second reading and to order publication thereof. Second Reading - Multiple Dwelling, 6300 Wayzata Boulevard: MOVED by Teresi seconded by Flannagan carried to give a second reading to an ordinance entitled: ®AN ORDINANCE AMENDING THE ZONING CODE" (Richard Walsh) The motion for approval of the second reading was lost for want of a motion .to. approve. The matter to be continued to the meeting of May 4, 1965. Regular Meeting of the Village Council, April 20, 1965 Request for Plan Approval - Multiple Dwelling, 6300 Wayzata Boulevard: Mr. Richard Walsh, developer for the proposed multiple dwelling, was present to answer questions for Council regarding the structural soundness of the substitute materei.al called "stout brick". Mr. Walsh agreed to furnish structural specifications to the Building Inspector. MOVED by Schaphorst seconded by Teresi carried to defer action on the matter to the meeting of May 4, 1965. Request for Plan Approval - Liberty Carton, 7425 Laurel Avenue: Mr. Donald Chapman submitted a new proposal and plans for Liberty Carton at 7125 Laurel Avenue, Brick with panels of -stucco alternating with windows. MOVED by Flannagan seconded by Schaphorst carried to give preliminary approval on the proposed plans. Request for Plan A proval - Anderson Cadillac, 7.20 Wayzata Boulevard: Upon request of the proponent, Council deferred the above matter to the meeting of May 4, 1965. Request for Building Permit - Golden Valley State Bank, 505 Winnetka Avenue: Mr. Dave Trach appeared to present the proposed plans and request a building permit for the Golden Valley State Bank at 505 Winnetka Avenue North. A round glass building 70 x 70 with gold roof (standing seam copper). Mr. Trach agreed to modify the ingress and egress to the property upon request by the Village when determined necessary by the Village. Mr. Robert Raugland, President of the Planning Commission, presented the recommendation of the Planning Commission to approve the committee report. (see Minutes of April 15, 1965). MOVED by Teresi seconded by Flannagan carried to approve the request for a building permit for the Golden Valley State Bank at 505 Winnetka Avenue North, subject to the approval of the Building Inspector. for Building Permit - Service Bureau Corporation, 8919 Wayzata The Building Inspector presented the request for a building permit for the Service Bureau Corporation for an office building at 8919 Wayzata Boulevard. Request for Ordinance Waiver, 50.5 - 33rd Avenue North: Mr. Robert Raugland, President of the Planning Commission, presented the recommendation of the Planning Commission to approve said ordinance waiver. (see minutes of April 15, 1965)• MOVED by Flannagan seconded by Schaphorst carried to approve the request for an ordinance waiver at 5o45 - 33rd Avenue North, upon recommendation of the Planning Commission. Request for Ordinance Waiver - 5730 Olson Highway, Valleyview Nursing Home, Inc.: a Regular Meeting of the Village Council, April 20, 1965 Mr. Robert Raugland, President of the Planning Commission, presented the recommendation of the Planning Commission to approve said ordinance waiver. (see minutes of April 15, 1965) MOVED by Teresi seconded by Flannagan carried to approve the request for an ordinance waiver at 5730 Olson Memorial Highway for the Vaileyview Nursing Home, Inc., upon recommendation of the Planning Commission. Request for Ordinance Waiver - 6005-6055 Duluth Street: Mr. Robert Raugland, President of the Planning Commission, presented the recommendation of the Planning Commission to approve said ordinance waiver. Continued Public Hearing - Zoning. Residential Districts: The Village Manager announced that this was a continued public hearing called for March 16, 1965. MOVED by Flannagan seconded by Schaphorst carried to close the public hearing above referred to and call a public hearing on zoning residential districts for May 18, 1965. Continued Public Hearing - Zoning, Institutional District: The Village Manager announced that this was a continued public hearing called for March 16, 1965. Second Reading Ordinance - Amending Village Building Code Electrical MOVED by Teresi seconded by Schaphorst carried to defer the above refer- enced matter to the meeting of May 4, 1965. New Hope Sanitary Sewer Bill: All present agreed to add the above matter to the agenda. Council discussed the outstanding bill of New Hope for Sanitary Sewer. MOLTED by Teresi seconded by Flannagan carried to approve the administrative lot divisions as submitted to Council. Labor Union Request: The Village Manager presented a request by Local 49 of IUOE for an increase in pay for five men in the Sewer & Water Department and two men in the Park Department, providing for additional increase over and above the annual appropriation in the amount of $411.00 for the year 1965. Length of Park Bond Issue: Council discussed the number of years the proposed Park Bond Issue for the amount of $185,000 will run. MOVED by Teresi seconded by Flannagan carried that the proposed Park Bond Issue for $185,000 will run for twenty years. Condemnation - Etzler Property: All present agreed to add the above matter to the agenda. The Village Manager submitted a request for approval of settlement on the condemnation award on the Etzler property in the amount of $540.00. MOVED by Flannagan seconded by Teresi carried to approve the settlement of condemnation award for the Etzler property in the amount of $5.0.00. Sign Rental - Holiday Motor Hotel: All present agreed to add the above matter to the agenda. Council approved the proposal to rent sign space on Village property at 1001 Lilac Drive North to the Holiday Motor Hotel in the amount of $250.00 annually. Payment for Cost of 1965 Census: All present agreed to add the above matter to the agenda. The Village Manager presented the final payment for census takers of the 1965 census in the amount of $2,527.87. MOVED by Flannagan seconded by Schaphorst carried to approve the payment of $2,527.87, for census takers for the 1965 census. Re: Animal Rescue Lague Patroling: The Village Manager requested additional hours of patroling by the Animal Rescue League for a period of six weeks. MOVED by Flannagan seconded by Teresi carried to approve the request for an additional three hours per week for six weeks of patroling the Village by the Animal Rescue Lague.
