01-04-66 City Council Minutes1 I 1 REGULAR MEETING of the VILLAGE COUNCIL January 4, 1966 Pursuant to due call and notice thereof, a regular meeting of the Village Council of the Village of Golden Valley, Hennepin County, Minnesota, was held at 7800 Golden Valley Road in said Village on January 4, 1966, at ?:30 o'clock P. M. The following members were present: Flannagan, Garis, Nadasdy, Schaphorst, and Teresi; and the following were absent: None. Present were Village Manager, Roger K. Ulstad; Village Attorney, Robert M. Skare; Village Engineer, Donald Sorensen; Village Clerk, Helen Penniman; Building Inspector, Dan Lynch; Village Planner, John Voss; President of the Planning Commission, Robert Raugland. Invocation: Rev. Norman D. Long, Church of the Brethren. Oath of Office - Newly Elected Mayor & Trustee: Judge A. Paul Lommen, Municipal Judge, administered the Oath of Office to Mayor Carl J. Nadasdy, and Trustee William K. Schaphorst who were re-elected to their respective offices. Minutes of December 21, 1965: MOVED by Flannagan seconded by Schaphorst carried to approve the minutes of December 21, 1965, as corrected. Request for Ordinance Waiver - 1448 Toledo Avenue North, Mrs. R. A. Bloom: The Village Manager stated this request was continued from the meeting of December 21, 1965. Mrs. R. A. Bloom was present to request said waiver. Mr. Robert Raugland, President of the Planning Commission, gave a resume of the Planning Commission recommendation to deny said request. (see minutes of 12-16-65). MOVED by Flannagan seconded by Garis carried to deny the request for an ordinance waiver at 1448 Toledo Avenue North, upon recommendation of the Planning Commission. Request for Ordinance Waiver - 5317 Glenwood Avenue, Donald ter Sethre: The Village Manager stated this request was continued from the meeting of December 21, 1965. Mr. Robert Raugland, President of the Planning Commission, presented the recommendation of the Planning Commission to approve said ordinance waiver. (see minutes of 12-16-65). Regular Meeting of the Village Council, January 4, 1966 Mrs. D. W. Sethre appeared to answer questions for Council. Mr. Clark, 5405 Glenwood Avenue, Thomas Arnold, 17 Turnpike Road; V. K. Behounek, 5301 Glenwood Avenue; Gene Altman, 30 Lawn Terrace; neighbors appeared to oppose the ordinance waiver and lot division. MOVED by Flannagan seconded by Teresi carried to deny the request for an ordinance waiver at 5317 Glenwood Avenue. Second Reading Zoning J. Santer & H. Foss (Midland Nursery): MOVED by Teresi seconded by Flannagan carried to give a second reading to an ordinance entitled: "AN ORDINANCE AMENDING THE ZONING CODE" (J. Santer & H. Foss) MOVED by Teresi seconded by Flannagan carried to approve the ordinance herein quoted by title on its second reading and to order publication thereof. See Ordinance Book page f,5; . Second Reading Zoning Residential & Commercial (Medicine Lake Rd. Set -back): MOVED by Garis seconded by Flannagan carried to give a second reading to an ordinance entitled: "AN ORDINANCE AMENDING THE ZONING CODE" (Residential and Commercial Zoning Districts) MOVED by Schaphorst seconded by Garis carried to approve the ordinance herein quoted by title on its second reading and to order publication thereof. MOVED by Flannagan seconded by Schaphorst carried to approve the request for a sign permit for Farmers Insurance Group at 9130 Olson Highway, subject to approval of the Building Inspector. Park & Recreation Commission Appointment - 1966: MOVED by Teresi seconded by Schaphorst carried to reappoint John Byrnes to the Park & Recreation Commission for a three year term expiring in December 1968. Civil Service Commission Appointment: Council deferred action on the above referenced matter. 3 Regular Meeting of the Village Council, January 4, 1966 Appointment of Suburban Rate Authority Representative & Alternate: MOVED by Teresi seconded by Schaphorst carried to reappoint Arthur Flannagan as Respresentative and Roger K. Ulstad as Alternate to the Suburban Rate Authority for 1966. Honeywell Planting and Landscaping: The Village Manager read a letter from Mr. C. S. Puleston representing the neighbors around Honeywell, dated December 21, 1965, protesting the violation of Honeywell's promise to landscape their property. Council agreed unanimously with the sentiments expressed in the above referenced letter and requested that a copy of said letter be forwarded to Honeywell with the requests expressed being the minimum requirement requested by Council. Council suggested that a competent landscape architect be em- ployed by Honeywell and more complete plans be submitted to Council, pending forfeiture of their $20,000.00 Landscaping Bond on file with the Village of Golden Valley. "Off -Sale" Liquor License Application - James Hummel: The Village Clerk presented the application for an "Off -Sale" liquor license for James Hummel in a proposed shopping center on T. H. #100 and County Road #66. Mr. Humel was present to answer questions for Council. MOVED by Teresi seconded by Garis carried to defer approval of said liquor license pending the presentation of building plans for the entire shopping center by the builder, however Mr. Hummel will have first choice for an "Off -Sale" liquor license at T. H. #100 and County Road #66. Request to Operate Crusher - Bury & Carlson, 6008 Wayzata Boulevard: The Village Manager read a letter from Bury & Carlson dated December 31, 1965, requesting permission to operate a crusher approximately two or three weeks at 6008 Wayzata Boulevard. Said letter was ordered placed on file in the Village Clerk's office. Mr. Bury was present to answer questions for Council and stated that dust control would be provided if necessary and to stop operation if there were complaints regarding either noise or dust from this operation. MOVED by Teresi seconded by Garis carried to approve the temporary permit to operate a crusher by Bury and Carlson at 6008 Wayzata Boulevard, subject to stopping of said operation upon complaints regarding noise or dust. Request for Piling Permit - Beim Construction Company; 8165 Lewis Road: All present agreed to add the above matter to the agenda. in Regular Meeting of the Village Council, January 4, 1966 The Building Inspector presented the request for a piling permit for Beim Construction Company at 8165 Lewis Road, a proposed warehouse. MOVED by Teresi seconded by Schaphorst carried to approve the request for a piling permit for Beim Construction Company at 8165 Lewis Road. Appointment of Acting Mayor: MOVED by Schaphorst seconded by Garis carried to appoint Cliff Teresi as Acting Mayor upon the absence of the Mayor for 1966. Appointment of Village Health Officer and Doctor: MOVED by Flannagan seconded by Schaphorst carried to reappoint Dr. Albert Kreiser as Village Health Officer and Doctor. Appointment of Weed Inspector: MOVED by Schaphorst seconded by Flannagan carried to reappoint Harry Hamman as Village Weed Inspector. Designation of Official Depository: MOVED by Schaphorst seconded by Flannagan carried to redesignate the Golden Valley State Bank as the official depository for the Village. Designation of Official Publication: MOVED by Flannagan seconded by Schaphorst carried to redesignate the Golden Valley Press as the official publication for the Village. Licenses: MOVED by Teresi seconded by Flannagan carried to approve the licenses as follows: No. Licensee 3605 Point Supper Club 3606 Bobbie Fern's Hair Stylists Bills: Type Fee Cigarette $12.00 Cigarette 12.00 MOVED by Teresi seconded by Schaphorst carried to approve the bills as submitted on the prelist. Communication - Re: Modified Plan for Bassett Creek & Water Shed District: The Village Manager presented communications from the U. S. Army Engineer District and Assistant County Attorney regarding a public hearing to establish a Watershed District. 11 1 1 LI 1 Regular Meeting of the Village Council, January 4, 1966 Council requested that the Village Manager notify the Bassett Creek Committee to meet regarding the proposed public hearing and requested that the committee make a study and recommendation to Council on January 18, 1966, prior to said public hearing regarding the proposed Watershed District. MOVED by Flannagan seconded by Schaphorst carried to rename the Bassett Creek Committee as Golden Valley Flood & Drainage Committee. Conference for Newly Elected Mayors & Councilmen: The Village Manager notified the Council of a conference for newly elected Mayors and Councilmen on Saturday January 8, 1966, at the Nolte Center for Continuing Education at the University of Minnesota.
