REGULAR MEETING of the VILLAGE COUNCIL August 16, 1966 Pursuant to due call and notice thereof, the Village Council of the Village of Golden Valley, Hennepin County, Minnesota, was held at 7800 Golden Valley Road in said Village on August 16, 1966, at 8:00 p.m. The following members were present: Flannagan, Garis, Nadasdy, Stockman, and Teresi arrived at 9:30 P.M. Present were Village Manager, Roger K. Ulstad; Village Attorney, Robert M. Skare; Village Engineer, Donald Sorensen; Village Clerk, Helen Penniman; Building Inspector, Dan Lynch; Chief -of -Police, Everett Frandsen. Minutes of August 2, 1966: Council deferred approval of the August 2, 1966, minutes to September 6, 1966. Award of Bids - Concrete Curb & Gutter (66 -CG -10): The Village Manager presented the affidavit of publication in the official newspaper. Sealed bids were received and the Assistant Engineer, Village Clerk and Finance Officer met at the Civic Center at 7800 Golden Valley Road at 11:00 A.M. on August 12, 1966, and have then and there publicly opened and read the bids received. The Engineer tabulated said bids and they were found to be as follows: BIDDER TOTAL BID Hiawatha Cement Company, Inc. $ 13,924.55 Victor Carlson & Sons, Inc. 18,772.50 Arnold Beckman 195358.25 The Village Engineer recommended the bid be awarded to the lowest responsible bidder, Hiawatha Cement Company, Inc., in the amount of $13,924.55• MOVED by Flannagan seconded by Stockman carried to award the bid to the low bidder, Hiawatha Cement Company, Inc., in the amount of $13,92..55, upon recommendation of the Village Engineer. Public Hearing - Public Improvements (66-WM-21,25226,27 66 -LF -18,19; 67 -CP -3,4): The Village Clerk presented an affidavit showing publication in the official newspaper of the Notice of Public Hearing on certain proposed Public improve- ments (Proposed Watermain 66-WM-21,25,26 & 27; Proposed Sanitary Sewer 66 -LF -18 & 19; Proposed Concrete Paving 67 -CP -3 & 4) described in the resolution of this Council relating thereto, adopted on August 2, 1966. Said affidavit was then examined, approved and ordered filed in the office of the Village Clerk. 144 Regular Meeting of the Village Council, August 16, 1966 The Mayor then announced that the meeting was open -for public hearing on said proposed public improvements, and all persons present to do so were afforded opportunity to express their views thereon. Mr. Tyree stated that there would be no benefit to the property, only more taxes. MOVED by Flannagan seconded by Garis carried to construct the entire proposed improvement, but continue the public hearing to September 6, 1966. Request for Temporary Sanitary Sewer Connection - Medicine Lake: The Village Manager read a letter dated July 15, 1966, requesting permission for a temporary connection to the sanitary sewer of Golden Valley by the Village of Medicine Lake. Mr. Gene Smith, Mayor of Medicine Lake, and two Councilmen from Medicine Lake appeared to request a temporary connection to the Golden Valley sanitary sewer. Yx. Smith proposed to submit an engineers report on the proposed sanitary sewer requirements of Medicine Lake for Council consideration. Council agreed to study the proposed engineers report for a temporary connection to the sanitary sewer. Request for Adjustment of Special Assessments,H.E Endress; 4609 Glenwood Avenue: The Village Manager presented a request for adjustment of special assessments for Mr. H. c'.. Endress at 1609 Glenwood Avenue, and a rebate of $369.74, overpayment by Mr. Endress. MOVED by Stockman seconded by Garis carried to rebate an overpayment by Mr. Endress from the General Fund Contingency in the amount of $369.71, since this project was closed out in 1964 and any balance transferred to the General Fund. Request for Building Permit - Feinberg's Meats, 1111 Zane Ave N (Addition): The Building Inspector presented the request for a building permit for Feinberg's Meats at 1114 Zane Avenue North for an addition to their building. Mr. Feinberg was present to answer questions for Council. The proposed addition is for more warehouse space, with a brick front and block construction in the rear. MOVED by Flannagan seconded by Garis carried to approve the request for a building permit for an addition to Feinberg's Meats at 111. Zane Avenue North, subject to the approval of the Building Inspector. 146 Regular Meeting of the Village Council, August 16, 1966 Communication - Request for Waiver of Platting Requirements;Golden Plaza, Inc.: The Village Manager submitted a written request dated July 13, 1966, for a waiver of platting requirements and waiver of restrictions on filing and recording conveyances from Golden Plaza, Inc. Mr. Karlins, Attorney, representing Golden Plaza, Inc., agreed that the plat needed a cul-de-sac on the proposed Market Street. The Village Attorney stated that the Platting Authority could approve Tract Q of the Registered Land Survey #648 in Golden Plaza, Inc. without referral to the Planning Commission. MOVED by Garis seconded by Flannagan carried to waive platting requirements insofar as they might be applicable and that the plat include a cul-de-sac on Market Street and the construction of said street to meet Village standards. Request for Building Permit - T.H. #100 & County Rd. #66, Preliminary Approval, Proposed Shopping Center, Krause --Anderson: The Building Inspector presented the proposed plans for a shopping center at T. H. #100 & County Road #66 for Krause -Anderson. Mr. Ingles, President of Krause -Anderson, was present to answer questions for Council. Mr. Ingles stated they proposed 115,000 square feet with approx- imately 6 to 8 stores with parking for 150 cars, that they will meet the Village requirements on materials and construction. Member Garis stated he is opposed to any future service station on the property. The Mayor informed the proponent that the Council has under consideration a Sunday Closing Ordinance in the event any of the proposed operations might be a discount type store. Council expressed a preference for brick exterior or equivalent on the proposed buildings. MOVED by Flannagan seconded by Garis carried to grant preliminary approval of the proposed shopping center at T.H. #100 & County Road #66 as presented to Council. Rental of Village Property Holiday Inn Sign, T. H. #100: The Village Manager submitted a request for approval of the rental of Village property on T. H. #100, annual fee of $250.00 for the Holiday Motor Hotel Sign. MOVED by Flannagan seconded by Garis carried to approve the rental of village property on T. H. #100 for the Holiday Motor Hotel Sign for the annual amount of $250.00. 1 147 Regular Meeting of the Village Council, August 16, 1966 Second Reading Ordinance Zone, 1000 Zane Avenue North (Light Industrial): MOVED by Garis seconded by Teresi carried to give a second reading to an ordinance entitled: "AN ORDINANCE AMENDING THE ZONING CODE" (Light Industrial Zoning District) (H. T. Lindsay & John Hudak) MOVED by Teresi seconded by Flannagan carried to approve the ordinance herein quoted by title on its second reading and order publication thereof. See Ordinance Book page -Z Discussion & First Reading, Ordinance re: Towing Contract (Vehicles): The Village Attorney reviewed the proposed ordinance regarding towing contract for vehicles. The Chief -of -Police gave a resume of background information relating to the preparation of the proposed ordinance. MOVED by Flannagan seconded by Teresi carried to give a first reading to an ordinance entitled: "AN ORDINANCE AMENDING THE VILLAGE CODE" (Regulating Appointment of Towing Contractor and removal and Impounding of Illegally Parked, Abandoned or Stolen Vehicles, and Emergency Removal of Standing Vehicles) MOVED by Flannagan seconded by Garis carried to approve the ordinance herein quoted by title on its first reading. Discussion & First Reading, Ordinance re: Noise Abatement: The Village Attorney reviewed the proposed ordinance regarding the prohibition of unnecessary noises. MOVED by Teresi seconded by Flannagan carried to give a first reading to an ordinance entitled: "AN ORDINANCE AMENDING THE VILLAGE CODE" (Prohibiting Unnecessary Noises) MOVED by Teresi seconded by Ftockman carried to approve the ordinance herein quoted by title on its first reading. Request for Sign Permit - Anderson Cadillac, 7400 Wayzata Boulevard: The Building Inspector presented the request for a sign permit for Anderson Cadillac at 7400 Wayzata Boulevard, which exceeds the square feet allowed under the sign ordinance. Regular Meeting of the Village Council, August 16, 1966 MOVED by Teresi seconded by Garis carried to deny the request for a sign permit for Anderson Cadillac at 7.00 Wayzata Boulevard. Request for Public Hearing - Zoning, 1109 Zane Avenue North (Light Industrial): The Village Manager presented a request for a public hearing to zone 1109 Zane Avenue North to Light Industrial for Volp Construction Company. MOVED by Garis seconded by Stockman carried to call a public hearing on September 6, 1966, to zone 1109 Zane Avenue North to Light Industrial District. Request for Public Hearing - Zoning, 7700 Wayzata Boulevard (Commercial): The Village Manager presented a request for a public hearing to zone 7700 Wayzata Boulevard to Commercial for Ridahl Construction Inc. MOVED by Garis seconded by Stockman carried to call a public hearing on September 61 1966, to zone 7700 Wayzata Boulevard to Commercial District. Request for Public Hearing - Zoning, 2120 Douglas Drive North (Business & Professional) : The Village Manager presented a request for a public hearing to zone 2120 Douglas Drive North to Business & Professional for Ross A. Craig. MOVED by Garis seconded by Stockman carried to call a public hearing on September 6, 1966, to zone 2120 Douglas Drive North to Business & Professional District. Waiver of Platting Ordinance - 3221 Regent Avenue North: The Village Manager presented the request for a waiver of platting ordinance for 3221 Regent Avenue North to divide the lot and read the recommendation of the Planning Commission. (see minutes of August 11, 1966). MOVED by Garis seconded by Stockman carried to approve the request for the waiver of platting ordinance for 3221 Regent Avenue North, upon recommendation of the Planning Commission. Resolution Ordering Dust Treatment (67 -DA -1 & 2): Member Teresi introduced the following resolution and MOVED its adoption: "RESOLUTION ORDERING DUST TREATMENT FOR CERTAIN STREETS" (67 -DA -1 & 2) The motion for the adoption of the foregoing resolution was duly seconded by Member Stockman and, upon vote being taken thereon, the following members voted in favor thereof: Flannagan, Garis, Nadasdy, Stockman, and Teresi; and the following voted against the same: None, whereupon said resolution was declared duly passed and adopted, signed by the Mayor and his signature attested by the Village Clerk. Discussion of Metropolitan Section Membership & By -Laws: Member Stockman reported on the Metropolitan Section Membership meeting at the university and recommended further consideration by the Council and the Hennepin County League of Municipalities. Council took no action. Request for Building Permit - 7500 Olson Highway, Skyline Builders (Town House): The Village Attorney informed the Council that Skyline Builders have not posted the required developers bond or filed the plat per their agreement. MOVED by Teresi seconded by Stockman carried to deny the request for a building permit, upon recommendation of the Village Attorney. Appointment of Members to Storm & Drainage Committee: MOVED by Stockman seconded by Teresi carried to defer the above referenced matter to the meeting of September 6, 1966. Communication - Hennepin County Relief Board: The Village Clerk presented a letter dated August 16, 1966, from the Hennepin County Relief Board regarding the semi-annual meeting of the Board on Thursday, September 15, 1966, at the Hopkins City Hall. MOVED by Stockman seconded by Garis carried to support county system of relief. Communications - The Pillsbury Company: The Mayor read a letter dated August 12, 1966, from the Pillsbury Company regarding their proposed new premium distribution warehouse to be located in Golden Valley. Council requested the Village Manager to send a reply to the Pillsbury Company. Request for Building Permit - Meadowbrook Grade School: All present agreed to add to the agenda the above referenced matter. The Village Manager presented the request for a building permit for the Meadowbrook Grade School at 5430 Glenwood Avenue Regular Meeting of the Village Council, August 16, 1966 MOVED by Teresi seconded by Stockman carried to approve the request for a building permit for the Meadowbrook Grade School at 5430 Glenwood Avenue, subject to the approval of the Building Inspector.
