03-19-68 City Council Minutes1 REGULAR MEETING of the VILLAGE COUNCIL March 19, 1968 Pursuant to due call and notice thereof, a regular meeting of the Village Council of the Village of Golden Valley, Hennepin County, Minnesota was held at 7800 Golden Valley Road in said Village on March 19, 1968, at 7:30 o'clock P. M. The following members were present: Bies, Carlson, Garis, Stockman, and Teresi; and the following were absent: None. Present were Village Manager, Roger K. Ulstad; Village Attorney, Robert M. Skare; Village Engineer, Lowell Odland; Village Clerk, Helen Penniman; Building Inspector, Dan Lynch; Presiden of Planning Commission, Paul Senstad. Minutes of February 20, 1968: MOVED by Garis seconded by Stockman carried to approve the minutes of February 20, 1968, as submitted to Council. Public Hearing - Zoning, 3901-4001 Olson Highway, Multiple Dwelling, Louis H. Graca: The Village Manager presented an affidavit of publication in the official newspaper of the Notice of Public Hearing as described in said affidavit. Said affidavit was examined, approved and ordered filed in the Clerk's office. The Mayor announced that this was the time and place for the public hearing above referred to:and all persons who desired to do so were afforded oppor- tunity to express their views thereon. No persons presented objections except the following: OBJECTOR Mr. Joe Maller 421 France Avenue North Mr. C. Dennis Gilbert 321 Sunnyridge Lane Mr. L. F. Johnson 625 Meadow Lane Mr. J. Ocken 3910 Poplar Drive OBJECTION Mr. Maller presented a petition with 102 signers and map showing location of signers who oppose said zoning. Questioned the cost of the building and said there was not enough information to decide tonight. Asked how many children would be added to the school district. Asked if the entrance would be on Meadow Lane. Would like to see more middle class residents in Golden Valley. 41 42 Regular Meeting of the Village Council, March 19, 1968 OBJECTOR OBJECTION Mr. Dale B. Martin If you can finance one 6 story 325 France Avenue North building, why not two 4 story, and asked what would prevent another builder from constructing a cheaper building. Mr. Philip 0. Lysne Asked what studies have been made 303 Sunnyridge Lane to determine the zoning. Mr. C. Dennis Gilbert Stated all the neighbors favor two 321 Sunnyridge Lane four story buildings over an eight story towering over everything. Mr. A. H, Changling This zoning was turned down two years ago. Everything is relative, would be a Washington monument. Mr. Dale E. Gerdin Is the parking all underground? 4221 Beverly Avenue Mr. J. Ocken Stated economics is of no importance, 3910 Poplar Drive only the neighbors. Mr. P. Larson Questioned the limit of number of 425 France Avenue North units on this site. PROPONENT REASON Dr. Louis H. Graca A resident of Golden Valley, plans 501 Meadow Lane South a luxury type apartment building with 1, 2 & 3 bedrooms. Mr. Robert Raugland, Architect, explained the building plans and showed the proposed plans. One building in the center of two blocks with underground garages. Mr. Entrikin of Raugland Entrikin Domhold & King Inc., described the preliminary design, exterior of brick with either natural or cast stone, thermo aluminum windows with colored glass. Building 58' x 176, x 90' high at the entrance on Meadow Lane. Mr. John Gibbon In favor of the proposed building. Mr. Dennis Ryan of Objected, not enough time to Minneapolis Park Board present to the Park Commission. The Mayor closed the public hearing. Mr. Paul Senstad, President of the Planning Commission, presented the recommendation of the Planning Commission, to approve said zoning. (see minutes of 2-15-1968). 4 Regular Meeting of the Village Council, March 19, 1968 MOVED by Garis seconded by Carlson to deny the zoning at 3901-4001 Olson Highway to Multiple Dwelling M-4. Upon roll call vote being taken thereon the members were recorded as voting as follows: Bies YES Garis YES Carlson YES Stockman YES Teresi YES The Mayor declared the motion carried and the rezoning denied. Public Hearing -Zoning, 650 Ottawa Avenue No Industrial, Schaper Mfg CO The Village Manager presented an affidavit of publication in the official newspaper of the Notice of Public Hearing as described in said affidavit. Said .affidavit was examined, approved and ordered filed in the Clerk's office. The Mayor announced that this was the time and place for the public hearing above referred to and all persons who desired to do so were afforded oppor- tunity to express their views thereon. No persons presented objections except the following: OBJECTOR OBJECTION None None The Mayor closed the public hearing. MOVED by Carlson seconded by Stockman to give a first reading to an ordinance entitled: "AN ORDINANCE AMENDING THE ZONING CODE" (Industrial Zoning District) (Schaper Mfg. -Co.) Public Hearing - Amending Zoning Code, Administration Section 14.08: The Village Manager presented an affidavit of publication in the official newspaper of the Notice of Public Hearing as described in said affidavit. Said affidavit was examined, approved and ordered filed in the Clerk's office. Public Hearing - Plat, GlenwM Slopes Fourth Addition: The Village Manager presented an affidavit of publication in the official newspaper of the Notice of Public Hearing as described in said affidavit. Said affidavit was examined, approved and ordered filed in the Clerk's office. The Mayor announced that this was the time and place for the public hearing above referred to and all persons who desired to do so were afforded oppor- tunity to express their views thereon. No persons presented objections except the following: OBJECTOR Mr. Harry Hamman 6001 Glenwood Avenue Mr. J. E. Saunders 325 Brunswick Ave. S. Mr. G. M. Eiden 345 Brunswick Ave. South OBJECTION Mr. Hamman asked if any land was being left for street right-of-way on the plat, along Laurel Avenue. Mr. Hamman asked if the County determined where drainage ditch is located. Wants single family home only, is a drainage ditch on the plat? Asked regarding drainage easement in the rear, wants all the property platted at one time to residential. 1 1 1 5 Regular Meeting of the Village Council, March 19, 1968 OBJECTOR Mr. Leo Breitman 205 Dakota Ave. South The Mayor closed the public hearing. OBJECTION Would like all lots platted so screening can be planted. Mr. Paul Senstad, President of the Planning Commission, presented the recommendation of the Planning Commission to approve the plat. (see minutes of 7-13-1967). The Village Manager stated the Planning Commission would present a recommend- ation as to the use of Laurel Avenue. The proponents stated there was no need for Laurel Avenue on their plat, but will not include the 30 feet along Laurel Avenue in their replat. Member Carlson introduced the following resolution and MOVED its adoption: "RESOLUTION" (Acceptance of Plat - Glenway Slopes Fourth Addition) The motion for the adoption of the foregoing resolution was seconded by Member Garis, and upon vote being taken thereon, the following voted in favor thereof: Bies, Carlson, Garis, Stockman, and Teresi; and the following voted against the same: None, whereupon said resolution was declared duly passed and adopted, signed by the Mayor and his signature attested by the Village Clerk. See Resolutions Book page Public Hearing - Public Improvement, Storm Sewer (68 -SS -2): The Village Clerk presented an affidavit showing publication in the official newspaper of the Notice of Public Hearing on certain proposed Public Improve- ments (Proposed Storm Sewer - 68 -SS -2) described in the resolution of this Council relating thereto, adopted on February 20, 1968. Said affidavit was then examined, approved and ordered filed in the office of the Village Clerk. The Mayor then announced that the meeting was open for public hearing on said proposed public improvements, and all persons present to do so were afforded opportunity to express their views thereon. No persons presented objections except the following: OBJECTOR OBJECTION None None The Village Engineer outlined the area included in the improvement. The Mayor closed the public hearing. M Regular Meeting of the Village Council, March 19, 1968 Member Stockman introduced the following resolution and MOVED its adoption: "RESOLUTION ORDERING CONSTRUCTION OF CERTAIN PROPOSED PUBLIC IMPROVEMENTS" (Proposed Storm Sewer - 68 -SS -2) The motion for the adoption of the foregoing resolution was duly seconded by Member Bies, and upon vote being taken thereon, the following members voted in favor thereof: Bies, Carlson, Garis, Stockman, and Teresi; and the following voted against the same: None, whereupon said resolution was declared duly passed and adopted, signed by the Mayor, and his signature attested by the Village Clerk. "RESOLUTION APPROVING PLANS AND SPECIFICATIONS AND ORDERING ADVERTISEMENT FOR BIDS" (Proposed Storm Sewer - 68 -SS -2) The motion for the adoption of the foregoing resolution was duly seconded by Member Garis, and upon vote being taken thereon, the following voted in favor thereof: Bies, Carlson, Garis, Stockman, and Teresi; and the follow- ing voted against the same: None, whereupon said resolution was declared duly passed and adopted, signed by the Mayor and his signature attested by the Village Clerk. See Resolutions Book page C-) Second Reading - Ordinance Zoning, 7500 Olson Highway, Commercial, Skyline Builders: The Village Manager reviewed the council action on Skyline zonings in the area. Mr. Ralph Tully, Attorney for Murphy Oil Company and a representative from Murphy Oil Company presented proposed plans for a service station at 7500 Olson Highway. Mr. Philip Krelitz, 4624 Sunset Ridge, spoke in favor of the proposed service station. Mr. Al LeSage, 7350 Olson Highway, objected to the proposed service station for the following reasons: traffic problems, in the midst of residential area, no commercial activity at present, and a service station is too severe a use for the area. The Mayor closed the public hearing. See Ordinance Book page Request for Deferrment of Special Assessment of Lateral Sewer, 7542 -6th Ave. North, Carl Quist: The Village Manager presented the request for deferrment of special assess- ment for lateral sewer on the rear portion of 7542 -6th Avenue North for Carl Quist. MOVED by Stockman seconded by Garis carried to approve the deferrment of special assessments for lateral sewer on the rear portion of 7542 - 6th Avenue North, until such time as a buildable lot can be obtained, with approval of rebate on said special assessment in the amount of 435.35, upon recommendation of the village staff. Request for Building Permit - 5900 Golden Valley Road, Hidden Village, John Cross: The Building Inspector presented the request for a building permit for 5900 Golden Valley Road, Hidden Village, a multiple dwelling for John Cross. Mr. John Cross; James Cooperman, Architect; and William Dolan, Engineer, were present to answer questions for council. MOVED by Garis seconded by Carlson carried to approve the request for a building permit for a multiple dwelling at 5900 Golden Valley Road, subject to the $5,000 landscape bond and approval of the Building Inspector. Request for Waiver of Platting Regulations - 5901 Westbrook (Lot Division): The Village Manager presented the request for waiver of platting regulations for 5901 Westbrook for a lot division. MOVED by Bies seconded by Carlson carried to approve the waiver of platting regulations subject to corrected survey of both parcels as follows: 5900 Westmore Way: The East 180 feet of the North 4 of the Southwest 4 of the Northwest 4 of Section 28, Township 118, Range 21; except the North 168 feet thereof. Subject to road easement over the East 30 feet and the South 30 feet thereof. 5901 Westbrook Road: The North 168 feet of the East 180 feet of the North 4 of the Southwest 4 of the Northwest 4 of Section 28, Township 118, Range 21; subject to road easement over the North 30 feet and the East 30 feet thereof. Regular Meeting of the Village Council, March 19, 1968 Mr. Hamman was present to answer questions for council. MOVED by Stockman seconded by Carlson carried to deny the request for waiver of Platting Regulations at 6001 Glenwood Avenue. Request for Approval of Plans for County Road #18: The Village Engineer presented the final plans for County Road #18 Project No. 27-618-15. Request to Advertise for Bids - 2 Way Mobile Radio Units, 2 Way Walkie Talkie Radio Units, Tone Acuated Monitor Radio Receivers; Radio Base Equipment: MOVED by Bies seconded by Carlson carried to advertise for bids for 2 Way Mobile Radio Units, 2 Way Walkie Talkie Radio Units, Tone Acuated Monitor Radio Receivers on May 21, 1968; and advertise for bids for Radio Equip- ment on May 21, 1968.
