02-04-69 City Council Minutes7 REGULAR MEETING of the VILLAGE COUNCIL February 4, 1969 Pursuant to due call and notice thereof, a regular meeting of the Village Council of the Village of Golden Valley, Hennepin County, Minnesota, was held at 7800 Golden Valley Road, in said Village on February 4, 1969, at 7:30 o'clock P.M. The following members were present: Bies, Carlson, Garis, Stockman, and Teresi; and the following were absent: None. Present were Acting Village Manager, John Murphy; Village Attorney, Robert M. Skare; Village Engineer, Lowell Odland; Village Clerk, Helen Penniman; Building Inspector, Dan Lynch; Chief -of -Police, Everett Frandsen. Request for Public Hearing - Proposed Change to Light Industrial District Permitted Uses: The Acting Village Manager presented a request for a public hearing on March 4, 1969, to change Light Industrial District permitted uses. MOVED by Stockman seconded by Carlson carried to call a public hearing on Proposed Change to Light Industrial District Uses on March 4, 1969. Request for Building Permit - Final Plans, 9405 Medicine Lake Road: The Building Inspector presented final plans and request for building permit for Mobil Oil Company at 9405 Medicine Lake Road for an all brick service station. MOVED by Carlson seconded by Stockman carried to approve the building permit for Mobil Oil Company at 9405 Medicine Lake Road, subject to closing in the vending machine area and a $2,000 landscape bond now on file, approval of the Building Inspector. Request for Building Permit - Final Plans, 935 Decatur Avenue, Ryan Construction• The Building Inspector presented final plans and request for building permit for Ryan Construction at 935 Decatur Avenue. MOVED by Carlson seconded by Garis carried to approve the final plans for Ryan Construction at 935 Decatur Avenue, subject to planting of screening trees four feet between branches south of the driveway, 12 feet between centers of trees north of the driveway, $5,000 landscape bond, and approval of the Building Inspector. Request for Building Permit - Inside Remodeling, 7001 Golden Valley Road: r� Regular Meeting of the Village Council, February 4, 1969 The Building Inspector presented the request for a building permit to remodel 7001 Golden Valley Road, Golden Valley Country Club. MOVED by Stockman seconded by Carlson carried to approve the request for a building permit to remodel the interior of Golden Valley Country Club at 7001 Golden Valley Road, subject to approval of the Building Inspector. Request for Building Permit - Inside Remodeling, 650 Ottawa Avenue North: The Building Inspector presented the request for a building permit to remodel 560 Ottawa Avenue North, Volp Construction. MOVED by Bies seconded by Carlson carried to approve the request for a building permit to remodel the interior at 650 Ottawa Avenue North for Volp Construct- ion, subject to approval of the Building Inspector. Request for Approval of Emergency Sewer Repairs: The Village Engineer presented a request for approval of emergency sanitary sewer repairs by installation of gate valves in the sanitary sewer line where liability loss has been experienced in the past. Estimated cost of repairs $3,000.00 MOVED by Stockman seconded by Carlson carried to approve the request for emergency sanitary sewer repairs, upon recommendation of the Village Engineer. Revocation of Approval of Building Permit Applications: The Building Inspector presented the following applications for building permits which have not been issued: Approved Address Application 7-16-68 601 Boone Avenue Pure Oil Company 3-6-68 4000 Olson Mem. Highway Dairy Queen 8-16-66 1114 Zane Avenue North Feinberg Meats MOVED by Carlson seconded by Stockman carried to revoke the approval fdr building permit application on the above referenced buildings. Proposed Ordinance Amending Liquor Law Violations: The Chief -of -Police reviewed liquor law violations and recommended a minimum penalty of 5 days suspension upon conviction. MOVED by Carlson seconded by Garis carried to give a first reading to an ordinance entitled: "AN ORDINANCE AMENDING THE VILLAGE CODE" (Liquor Law Violations) In Regular Meeting of the Village Council, February 4, 1969 MOVED by Carlson seconded by Bies carried to approve the ordinance herein quoted by title on its first reading. Proposed Ordinance - Possession Drug Paraphernalia: The Chief -of -Police reviewed the proposed ordinance for possession of drug paraphernalia. MOVED by Garis seconded by Stockman carried to give a first reading to an ordinance entitled: "AN ORDINANCE AMENDING THE VILLAGE CODE" (Possession of Drug Paraphernalia) MOVED by Garis seconded by Bies carried to approve the ordinance herein quoted by title on its first reading. Proposed Ordinance - Regulating Excavating in Streets: The Village Engineer reviewed the proposed ordinance regulating excavating in streets or alleys. MOVED by Garis seconded by Carlson carried to give first reading to an ordinance entitled: "AN ORDINANCE AMENDING THE VILLAGE CODE" (An Ordinance Regulating the Excavating of Streets, Avenues or Alleys) MOVED by Garis seconded by Bies carried to approve the ordinance herein quoted by title on its first reading. Report on Record Check for On -Sale License, Golden Valley Lanes: The Police Chief report the record check showed a clear record for the licensee at Golden Valley Lanes, 9220 Olson Memorial Highway, for 3.2 On -Sale non -intoxicating beer license. MOVED by Garis seconded by Stockman carried to approve the report and to issue the license to Golden Valley Lanes, 9220 Olson Memorial Highway. Appointment —Planning Commission: MOVED by Garis seconded by Stockman carried to defer appointments to the Planning Commission. Appoint - Board of Zoning Appeals: MOVED by Garis seconded by Stockman carried to defer appointments to the Board of Zoning Appeals. Regular Meeting of the Village Council, February 4, 1969 Appointment - Park & Recreation Commission: MOVED by Garis seconded by Stockman carried to appoint Malvin Weisenburger, 8150 Patsy Lane to the Park & Recreation Commission. Appointment - Civil Defense Director: MOVED by Garis seconded by Bies carried to defer appointment of a Civil Defense Director. Appointment - Human Rights Commission: MOVED by Bies seconded by Garis carried to rescind the motion of January 21, 1969, appointing Roger K. Ulstad to the Human Rights Commission. MOVED by Stockman seconded by Carlson carried to appoint Ron Krank, 3014 Kyle Avenue North; Lloyd "Mick" Lee, 5025 St. Croix Avenue; Stephan B. Swartz, 220 Kentucky Avenue North, to the Human Rights Commission. Appointment - Weed Inspector: MOVED by Stockman seconded by Carlson carried to defer appointment of a Weed Inspector. Appointment - Golden Valley Safety Council: MOVED by Bies seconded by Carlson carried to appoint the following residents to the Golden Valley Safety Council: Richard L. Mason, 2945 Regent Avenue North; Tom Morgan, Jr., 2340 Orkla Drive; Eldon H. Ranney, 2370 Zealand Avenue North. Appointment of Village Manager: MOVED by Carlson seconded by Garis carried to appoint Barkley G. Omans as Village Manager effective March 1, 1969• Communication - Re: Minnesota Pollution Control Agency: The Acting Manager presented a resolution recommended by the Minnesota Society of Professional Sanitarians regarding the Minnesota Pollution Control Agency. Member Stockman introduced the following resolution and MOVED its adoption: "RESOLUTION" (Minnesota Pollution Control Agency) The motion for the adoption of'the foregoing resolution was duly seconded by Member Carlson, and upon vote being taken thereon the following members voted in favor thereof: Bies, Carlson, Garis, Stockman, and Teresi; and the following voted against the same: None whereupon said resolution was declared duly passed and adopted, signed by the Mayor and hissignature attested by the Village Clerk.
