REGULAR MEETING
OF THE
VILLAGE COUNCIL
April 6, 1970
Pursuant to due call and notice thereof, a regular meeting of the Village
Council of the Village of Golden Valley, Hennepin County, Minnesota, was
held at 7800 Golden Valley Road in said Village on April 6, 1970, at 7:30
o'clock P. M.
The following members were present: Jensen, Paulson, Stockman, and Teresi;
and the following was absent: Bies.
Present were Village Manager Barkley G. Omans; Village Attorney, Robert M.
Skare; Village Engineer, Lowell Odland; Village Clerk, Helen Penniman; Act-
ing Building Inspector, Jon Westlake.
In memory of Daniel J. Lynch, Building Inspector, the Mayor called for a
minute of silent meditation.

Continued Public Hearing - Zoning, Lots Acres to I-3
Institutional Zoning District: Lots 3 5 Busch's
Meadow Acres to M--4 or M-2 Multiple Dwelling Zoning.
District; Lots 1 Busch's Meadow Acres to Resident-
ial Zoning District:
Mr. Glen Christiansen, Chairman of the Planning Commission, presented the recom-
mendation of the Planning Commission (see 3-23-70) and reviewed the recommenda-
tion of Midwest Planning to zone all open development to residential zoning
district. Planned Unit and Comprehensive Planning, a new concept, is recommended
by amending the Zoning Ordinance.
Premier Realty, represented by Robert Brenny, requested a continued public hear-
ing before d full council.
Mr. Dennis D. Gonyea, 13+1 Wisconsin Ave. North, spokesman for the residents
of the area, and Claremore Nursing Home requested that the hearing be held
tonight.

ning and zoning for the entire area. The residents desire low density zoning
on thebalance of lots, townhouse type complex zoning.

The Council requested the Planning Commission to draft an amendment to the
ordinance for Planned Unit Zoning.
Public Hearing - Street Vacation, 26th Avenue North & Dresden Lane
The Village Clerk presented an affidavit of publication in the official news-

paper of the Notice of Public Hearing as described in said affidavit. Said
affidavit was examined, approved and ordered filed in the Clerk's office.
The Mayor announced that this was the time and place for the public hearing
above referred to and all persons who desired to do so were afforded oppor-
tunity to express their views thereon.
Mr. Howard Moore, Attorney, representing Mr. & Mrs. Stickman, 2460 Dresden
Lane, they have a problem with access to their garage. They have been driv-
ing on the street to the rear of their property for eight years. Mr. Moore
requested the Street Vacation on 26th Avenue North at Dresden Lane, be con-
tinued for one month.
Mr. Alvin Schendel, Skyline Builders, requested delay on the street vacation.
Mr. Henry C. Kmnitz, 2500 Dresden Lane, stated they sympathize with the
Stickmans problem, but trash is being dumped on the land and filling Bassett
Creek ponding area. Mr. Kemnitz requested a surveillance and tag trucks
over 3 tons. Mr. Clarence J. Hynes, 2441 Dresden Lane, requested installa-
tion of a curb and cul-de-sac to stop the dumping.
MOVED by Stockman seconded by Jensen carried to continue the public hearing
to May 4, 1970.
Public Hearin - Street Improvement (70 -SI -5) Dresden Lane Cul-de-sac:
The Village Clerk presented an affidavit of publication in the official news-
paper of the Notice of Public Hearing as described in said affidavit. Said
affidavit was examined, approved and ordered filed in the Clerk's office.
The Mayor announced that this was the time and place for the public hearing
above referred to and all persons present to do so were afforded opportunity
to express their views thereon.
The Village Engineer reviewed the plans and area involved in the proposed
improvement (70 -SI -5).
Mr. Roy Busse, builder, in favor of the improvement and stated the builders
in the area are willing to assume the assessment cost.
MOVED by Jensen seconded by Stockman carried to continue the public hearing
to May 4, 1970.
Public Hearing _ Zoning, 2400 UnityAvenue toMultiple Dwelling_M-1:
The Village Clerk presented an affidavit of publication in the official news-
paper of the Notice of Public Hearing as described in said affidavit. Said
affidavit was examined, approved and ordered filed in the Clerk's office.
The Mayor announced that this was the time and place for the public hearing
above referred to and all persons who desired to do so were afforded oppor-

order to obtain a traffic study recommended by the Planning Commission.

the plat of Green Valley Estates.
ADpeal from BZA - 4960 Duluth Street, Douglas Becker, Double Bungalow:
Mr. Douglas Becker, 4960 Duluth Street, requested a continuation of his appeal.
MOVED by Stockman seconded by Jensen carried to continue the matter to the
meeting of May 4, 1970.
Street Vacation Winsdale from Gett sbur to Flag Avenue Earl Wilson:
The Village Engineer recommended a variance to permit a building. -�
Mr. Wilson stated he would give easements for utilities.
Council request that the proponent submit a petition for street vacation and
secure easements from the other property owners. Council took no action.
Complaint - Biirninff & Dum in on P. B. Olson Property - Harold J. Olausen:
A letter was received from Harold J. Olausen, 2350 Kewanee Way, dated March
16, 1970, regarding burning and dumping on the P. B. Olson property. The
Village Manager had responded to certain inaccuracies regarding location
which was in Robbinsdale.

Council received a request from Independent School District #281 to use the
Village voter registrations for school elections.

Mr. Robert Van Hauer, representing approximately 200 residents that have
formed a Sweeney Lake Association, stated they were disturbed by the prospect
of storm water being dumped into Sweeney Lake. Silt, snow removal material
and chemical fertilizer will all find their way into the storm sewer and
pollute the lake. Mr. Howard Bloom, 1605 St. Croix, questioned the reason
for construction of the storm sewer at this time.
MOVED by Paulson seconded by Jensen carried to request the Village Engineer
to determine the feasibility of terminating the storm sewer contract and
report to Council.
Request for Approval of Amateur Radio Tower - 8511 Rose Manors A. J. Monti:
The Acting Building Inspector presented a request for a free standing aluminum
radio tower, anchored in concrete.
MOVED By Stockman seconded by Jensen carried to approve the request for approv-
al of a radio tower at 8511 Rose Manor, subject to height limitation of 40" set
by former radio tower permits.
Request for Building Permit - 721 Hampshire Ave. So., Vick's Marine & Auto Body:
The Acting Building Inspector presented a request for a building permit, out-
side storage will be screened.
MOVED by Jensen seconded by Stockman carried to approve the building permit,
subject to the following: brick facing on Laurel Ave., 20' brick return on
the east and south sides of the building, outside storage screened, landscape
plan, landscape bond, screening of mechanical on roof, and approval of the
Building Inspector.
Landscaping Plans - 5801 Duluth Street, Bob Ridgeway - Apartments:
Landscape plans for 5801 Duluth Street, apartments were submitted.
MOVED by Paulson seconded by Jensen carried to approve the landscape plans
and require screening any mechanical on the roof.
Set back Violation, 2301 Zealand Avenue, Wayn Roy Builders:
Wayn Roy Builders are 4" off on side yard set -back at 2301 Zealand Avenue.
Council referred the matter to the Board of Zoning Appeals.
Set -Back Violation, 2240 Pennsylvania Avenue North, Tom DeCola:
A set -back violation of 9/10's of a foot at 2240 Pennsylvania Avenue North.
Council referred the matter to the Board of Zoning Appeals.
Budget Rent-A-Car System - Louisiana & T. H. #12; 6980 Wayzata Boulevard:

All present agreed to add the above item to the agenda.
Mr. Gary Bennett of Budget Rent-A-Car System, 6980 Wayzata Boulevard, Texaco
Service Station, appeared to request approval of auxiliary car rental in a
service station. They meet all requirements of the zoning ordinance. No
Council action necessary.
Utility Building Bids:
Council reviewed the bid tabulation for the Utility Building. (see attached
copies). Page No. 65 in Minute Book.
The Village Manager recommended award to D. J. Kranz on the General at $112,755
less the deduct on Alternate G-7 of $6,000; award to Berghorst, Inc., on the
Mechanical at $25,100 less the deduct on Alternate M-1 of $3,250; award to
Starbird Electric on the electrical at $10,724 plus $1,415 for Alternate E-2.
MOVED by Jensen seconded by Paulson carried to award the bids as recommended
by the Village Manager and listed above.

The Village Manager recommended acceptance of the quotation of Midwest Petrol
Equipment Company for one EC 107 EK Weaver Hoist at $1,300 installed.

Golf Club Pump House - 30 Housepower Motor:
The Village Manager recommended purchase of one 30 horsepower motor for the
Golf Club Pump House, install a new three=phase service and correct some
existing wiring, for $1,500.
Request to Advertise for Bids - Aerial Ladder Truck Fire Department:
The Village Manager requested that ads for bids be taken on May 12, 1970, for
one Aerial Ladder Truck for the Fire Department, approximate cost $57,000.
MOVED by Stockman seconded by Paulson carried to advertise for bids for one
Aerial Ladder Truck for the Fire Department on May 12, 1970.
Request forAppropriation from Contingency Fund $9,000 for Attorne 's Fees:

The Village Manager presented a request to transfer $9,000 from the Contingency
Fund to the 1970 budget for the Village Attorney fees.

Sidewalk Assessment Policy:
The Village Manager submitted a sidewalk assessment policy for Council con-
sideration.
Council tabled the matter pending the report of the Planning Commission and
Safety Council.
Police Reserve:
The Village Manager proposed drafting a new ordinance to replace Section 207
of the Village Code, dealing with uniform and identification and duty assign-
ment.
Council concurred.
Waiver of Platting Ordinance - 25+0 Dresden Lane, Roy J. Busse:

1970.

Planning Commission, term to expire in 1972, withdraw appointment of John
Daly to the Planning Commission at the meeting of March 16, 1970; appoint
Paul Senstad, Donald B. Anderson, James Rydeen, Gerald S. Robinson, Robert
J. Jodan to the Board of Review; Edward M. McAllister to the Safety Council;
and Jerald H. Jackson to the Human Rights Commission.
